WHEREAS, the City Council agreed to sell park land; and
WHEREAS, the petitioner submitted payment of $31,000 to the City as required by Council File 93-832, and
WHEREAS, Council File 93-832 states that the monies received should be paid to the Park Land Replacement
Fund 720 Activity 50087; and
WHEREAS, the funds were inadvertently deposited in Fund 001 Activity 01300; and
WHEREAS, the City is not in compliance with the City Charter that states that sale proceeds received for park
land must be kept in a separate fund (Chapter 13.0101 E); and
13 WHEREAS, The Mayor, pursuant to Section 10.07.1 of the City Charter, does certify that there are available
14 for appropriation revenues in excess of those estimated in the 1995 budget; and

RESOLVED, that upon the petition of Patricia M. Krezowski per Finance
Department File No. 5-1993, those parts of Highland Park lying between
Shelby Place, Edgcunbe Road and West 7th Stzeet, hereinafter described,
are hereby vacated and discontinued as public property.
The vacated areas are described as follows:

vacated) as originally platted and dedicated on the plat of
Kentucky Terrace, Ramsey County, Minnesota, described as
follows: Beginning at the southeast corner of Lot 1, Joseph
M. and Martin E. Thorr�ton's Addition; thence westerly along the
south line of Lots 1 and 2 of said Addition, to an intersection
with the east line of the west 70.00 feet of said Lot 2; thence
southerly along the southerly extension of said east line of the
west 70.00 feet of Lot 2 to the southerly line of said Summit
Avenue South (now vacated); thence easterly along said southerly
line of Summit Avenue South (now vacated) to the northeast

This vacation shall be subject to the following conditions:
1. That this vacation shall be subject to the terms and
conditions of Chapter 130, codi£ied March 1, 1981, of
the Saint Paul Legislative Code as amended.

2. That a permanent utility easement be retained within
the vacated area to protect the interests of Northern
States Power Company.
3. That the petitioner, her successors and assigns shall
pay $31,000.0o as compensation for this vacation
which is due and payable within 60 days of the
publication date of this resolution. Said compensation
shall be paid into Parkland Replacement Fund 720
Activity 50087.
4. That the Council of the City oP Saint Paul hereby
authorizes the proper City Officials to execute a
Quit Claim Deed which conveys the above described
vacated land to the Petitioner.
5. That the petitioner, her successors, and assigns
by acceptance of the terms and conditions of this
resolution, hereby agree to indemnify, defend,
and save harmless the City of Saint Paul, its
officers, and employees against all suits,
actions, or claims of any character brought
as a result of injuries or damages received
or sustained by any persan, persons, or property on
account o£ this vacation or petitioner's use of this
property including but not limited to a claim brouqht
because of any act of omission, negZect, or
misconduct of said petitioner or because of any
claims or liability arising from any violation of any
law or regulation made in accordance with the
law whether by the petitioner or any of its
agents or employees.

6. That the petitioner, her successors, and assigns
shall within 60 days of the publication date of
this resolution, file with the City Clerk, an
acceptance in writing of the conditions of this
resolution and shall within the period(s)
specified in the terms and conditions of this
resolution, comply in all respects with these
terms and conditions.
