WHEREAS, the Council of the City of Saint Paul, by resolution C.F. 155463 approved March 15,
1951, and resolution C.F. 156176, approved May 29, 1951, vacated land describes as follows:
That alley which extends in a general easterly and westerly direc6on and abuts Lots one (1) to
nine (9} both inclusive, and Lots riventy-one (21) to twenty-nine (29) both inclusive, in Block
Nine, "Merrill's Division of Rice Street Villas", according to the duly recorded plat thereof on
file and of recard in the office of the Register of Deeds within and for Ramsey County,
Minnesota; and,
That alley which ettends in a general northerly and southeriy direction and abuts the
aforemenrioned a11ey as well as Lots ten (10) through twenty (20), both inclusive, and Lots
nine (9) and twenty-one (21) in Block 9, "MerrilPs Division of Rice Street Villas", according
to the recorded plat thereof on file and of record in the Office of the Register of Deeds within
and for Ramsey County, Minnesota.
WHEREAS, based upon utility easement Certificates of Intended Non-Use filed voluntarily on
behalf of U S West Communications, Inc. Northern States Power Company, District Energy and
Cooling Saint Paul, Inc., Continentai Cablevision of Saint Paul, Inc., the Water Utility, and the
Department of Public Works, and made a part hereof by this reference and filed in the office of the
City Clerk of Saint Paul, the City for itself and on behalf of these corporations and departsnents,
waives the right to utility easements in the vacated areas as described in the certificates incorporated
herein.
NOW THEREFORE, BE TT RESOLVED, pursuant to Section 134.06 of the St. Paul Legislative
Code and on behalf of the City of St. Paul and those persons for whom the City has reserved
easements, the Council of the City of St. Paul does hereby waive and release the retained Utility
Easements in the vacated public property as described above.

BE IT FLiRTHER RESOLVED, that upon passage of this resolution, the City Clerk is hereby
authorized and directed to record a copy of this resolufion in the o�ce of the Registraz of Deeds,
Ramsey County, and that the CiTy Clerk shall maintain a copy of all Certificates of Intended Non-Use
referenced in this resolution on file in the office of Citizen Services.
