A L Green Sheet # 28807 RESOLUTION CITY OF SAINT PAUL, MINNESOTA , .� � r, > , Presented By Referred To Committee: Date 2 WHEREAS, the Boazd of Water Commissioners did purchase in 1959 certain lands 3 in Anoka County to be used for the construction of an additional conduit to transport water 4 from the Mississippi River in Fridley, Minnesota to Charlie Lake in North Oaks, Minnesota. W�REAS, the Board did declare by Resolution No. 4338 a certain pazcel of land within said land hereinafter referred to as the Properry and described as follows: 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 The north 35 feet of the south 75 feet of the west 180 feet of Lot 24 of Auditor's Subdivision No. 152, Anoka County, Minnesota. to be no longer required for maintenance, construction or operation of the conduits and therefore surplus property; and WHEREAS, City staff dces concur with the Boazd that the Property is no longer required by the Boazd or by any other City department, and has determined the Property to be surplus; and WHEREAS, R.M. Parranto and Associates, Inc., a certified Real Estate Appraisal Company, has prepazed an appraisal of the Property which states that the use of the Properry is limited by local zoning code to expansion of the adjoining parcel of land lying immediately north thereof, and estimates the fair market value of the Property at $9,450 based upon the sale of comparable land near the Property, and the real estate manager of the City of Saint Paul dces concur in the amount of said appraisal; and WHEREAS, the owner of the adjoining pazcel of land lying immediately north of the Property, Artistic Screening Company, Inc., desires to purchase the Property for the full amount of said appraised value•, and WHEREAS, the Boazd by adoption of said Resolution No. 4338 did approve the sale of the Property to Artistic Screening Company, Inc. and direct the City of Saint Paul real estate manager to proceed with the sale of the Property in accordance with Chapter 51 of the Saint Paul Legislative Code for a cash purchase price of $9,450; now, therefore, be it RESOLVED, that the City Council of the City of Saint Paul hereby concurs with the acdon of the Board of Water Commissioners and dces approve the sale of the Property to Artisric Screening Company, Inc., and be it 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 FINALLY RESOLVED, that the proper officers of the City of Saint �� �� Paul aze hereby authorized and directed to execute a quit claim deed on behalf of the City conveying title to the above described property to Artistic Screening Company, Inc. Parranto and Associates, Inc. appraised the property on August 29, 1994 at $1.50 per square foot or $9,450 and stated that local zoning code restriction rendered the property usable to only the sole adjacent property owner, Artistic Screening, Co., Inc. The Saint Paul Real Estate Manager agreed with the appraisal on September 30, 1994. Saint Paul Board of Water Commissioners approved the sale at full appraisal value by adoption of Board Resolution No. 4338 on November 14, 1994.
