The vacated area is described as follows: That part of the northeasterly one-half of Neill Street lying between East Seventh Street and Bast Sixth Street, subject to East Seventh Street as widened. This vacation shall be subject to the following conditions: 1. That this vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended. 2. That the petitioner, his heirs and assigns shall pay $500.00 as an administrative fee for this vacation which is due and payable within 60 days of the effective date of this resolution. 3. That the petitioner, his successors and assigns shall take over the responsibility of and all costs for, the maintenance, operation and repairs of the catch basin and connecting drain in said vacated Neill Street as described herein. 4. That tbe peUtioner, his successors and assigns shall pay all costs for the reconstruction of the street intersection along the southerly side of East Seventh and said vacated Neill Street, including but not limited tq all costs for construction of new sidewalk and curb with driveway, and shall also pay all costs for signs and the installation thereof that indicate that said vacated Neill Street is no longer a public thorougbfare, subject to the approval of the Department of Public Works. All work shall be performed under permit issued by the Department of Public Works Sidewalk Division. Petitioner shall contact Tom Keefe at 266-6121, for the procedures on this requirement. This work shall be completed within 90 days of the effective date of this resolution. 5. � That a permanent utility easement shall be retained within the vacated area to protect the interests of US West Communications, Inc. That the petitioner his heirs, and assigns, by acceptance of the terms an condition of this resoluti0n agree to indemnify, defend and save harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character brought as a result of injuries or damages received or sustained by any person, persons, or properry on account of this vacation or petitioner's use of this property, including but not limited to a claim brought because of any act of omission, neglect, or misconduct of said petitioner or because of any claims or liability arising from any violation of any law or regulation made in accordance with the law, whether by the petitioner or any of his agents or employees 8.
