Whereas, The Boazd of Water Commissioners of the City of Saint Paul by its
resolution No. 4331, adopted October 10, 1994, found and detemuned that We Boazd
and City of Saint Paul could agree to provide a partial release of a flooding and drainage
easement over property located in Vadnais Heights, based on the fact that Vadnais
Boulevazd had been relocated northerly on a new roadway ali�ment; and
Whereas, The Council is requested to concur in the decision of the Board and to
authorize the execution of the partial release on behalf of the City of Saint Paul; now
therefore be it
Resolved, That the Council of the City of Saint Paul does hereby concur in the
decision of the Boazd, and that the Mayor, Director of the Department of Finance and
Management Services, and the City Clerk be and are hereby authorized and directed to
execute the partial release of flooding and drainage easement on behalf of the City of
Saint Paul.

The relocation resulted in the Utiiity having a legal easement interest in a sma11 sliver of
land now bordering and adjacent to the south side of newly relocated Vadnais Boulevard. The
Utility's interest is very small and the developer has requested that the Utility release its
interest in this sma21 area to basically clear the owner's title. No compensation to be
received for Chis primarily legai clarification.

WHF.RFaS, The roadway known as Vadnais Boulevard was platted as a part of the original
Vadnais Lake Villas platting; and
WAFRFAS, The Board reached agre�ment with the County of Ramsey to pond water on che
roadway right-of-way; and
��HRRF.AS, Vadnais Boulevard was relocated northeriy on a new roadway alignment, which
created a legal interest by the Board in a small parcel of land south of and adja:ent to the
relocated roadway; and
�i'HEREAS, The subsequent owner of the land containing this interest has requesYed the �c+ard
release its easement interest in this pucel to clear the owner's tide; and
WHEREAS, Staff has reviewed this release and does recommend said release at no
wmpensation; now, therefore, be it
RFSOLVEA, That the Board does concur with staff's recommendation and aut�horizes the
proper officers of the Board to execute said easemenY zelease.
