RESOLVED, that upon execution and delivery of a release in full to the City of Saint
Paul, the proper City officers are hereby authorized and directed to pay out of the Tort
Liability Fund 09070-0511 to Thomas Benedum the sum of $7,900.00 in full settiement of
his claim for damages sustained August 29, 1994, as a result of an accident with a city-owned
vehicle at or near Case and Forest 5treets.

On August 24, 1994, a City of Saint Paul squad car being driven by
Terrance D. Erdman collided with a car being driven by Thomas Benedum
at the intersection of Case and Forest 5treet in Saint Paul. Officer
Erdman was enroute to an in-process police call and was traveling
at a speed in excess o£ the speed limit with the emergency lights
on, but without the siren on. The intersection of Case and Forest
Streets is a 4-way stop. Of£icer Erdman failed to stop at the
sl�m��ection an co ide with Mr. Benedum in e midd e o t e
intersection, Mr. Benedum has claimed damages in excess of $9,500.
This office has reached a compromise settlement with Mr. Benedum
in the amount o£ $7,9o0. �������
