In the Matter of acquiring the property rights necessary for the proposed conshuction of the Ayd Mill Road
Bicycle/Pedestrian Trail between Ayd Mill Road and the Canadian Pacific Railway from Marshall Avenue to
Victoria Street. Property rights to be acquired include permanent public way easements and temporary
construction easements affecting properties along the trail route as shown on Exhibit A.
The Council of the City of Saint Paul having received the report of the Mayor upon the above improvement,
and having considered said zeport, hereby resolves:
1. That the said report and the same is hereby approved with no alternatives, and that the estimated cost
thereof is $1,700,000, financed by project funds.
2. That a public hearing be had on said improvement on the 2" dav of September, 2009, at 530 pm., in
the Council Chambers of the City Hall and Court House Building in the City of Saint Paul.
3. That notice of said public hearing be given to the persons and in the manner provided by the Charter,
staUng the time and place of hearing, the nature of the improvement and the total cost thereof as
estimated.

5UMMARY OF ENGINEERING RECOMMENDATIONS
Ayd Mill Road Bicycle/Pedestrian Trail
Right of Way Acquisition

PROJECT:
Acquire right of way for the proposed construction of the Ayd Mill Road
Bicycle/Pedestrian Trail between Ayd Miil Road and Canadian Pacific Railway from
Marshall Avenue to Victoria Street.
INITIATING ACTION:
This project was initiated by St. Paul Public Works. The City desires to consmzct a
bicyclelpedestrian path along the Canadian Pacific Railway from Victoria Street a11 the
way to the west City limits. This project is one phase of a ttuee phase project. This
bicycle /pedestrian trail will be connected to the Midtown Greenway wnstructed by
Minneapolis which terminates at the City limits. Right of Way acquisition for the otl�er
two phases will be performed at a later date under separate orders.
PROPOSEDIMPROVEMENTS:
It is proposed to acquire right of way between Ayd Mill Road and Canad'aan Pacific
Railway to allow for the installation of a BicyclelPedestrian Trail from Marshall Avenue
to Victoria Street. The construction project will be administered by Saint Paul Public
Works. City Council approval for the construction project will be completed under a
separate final order. Construction is planned to be completed in 2013.
PROPOSED RIGHT OF WAY ACQUISITION:
The right of way proposed to be acquired is between Ayd Mill Road and the Canadian
Pacific Railway from Marshall Avenue to Victoria Street as shown on the attached map.
ADVERSE EFFECT5:
The project will require permanent and temporary right of way acquisition on properties
on the west side of the Canadian Pacific Railway between Marshall Avenue and Victoria
Street. The acquisition process being managed by City of St. Paul will provide relocation
payments and services to owners of acquired property in accordance with the Uniform
Relocation Assistance and Real Properties Acquisition Policies Act of 1970, as amended
and required under state law.
TIME SCHEDULE:
The properiy acquisition will be completed in winter 2010 and conshuction will be
completed in 2013 or 2014 depending on Federal Funding.
