The Council of the City of Saint Paul having received the report of the
Mayor upon the above improvement, and having considered said report, hereby
resolves:
l. That the said report and the same is hereby approve with no
alternatives, and that the estimated cost thereof is $8,506.50 financed by
assessments.
2. That a public hearing be had on said improvement on the 19 day of
August, 2009, at 5:30 o'clock p.m. in the Council Chambers of the City Hall
and Court House Building in the City of Saint Pau1.
3. That notice of said public hearing be given to the persons and in the
manner provided by the Charter, stating the time and place of hearing, the
nature of the improvement and the total cost thereof as estimated.

Addition, Block 53 (Bounded by Seventh, Smith, Chestnut and Kellogg)
Please take the steps necessary to schedule a public hearing on the following matter:
Improve the westernmost 160 feet of the alley in Rice and Irvine's Addition, Block 53 (Bounded
by Seventh, Smith, Chestnut and Kellogg) by milling the existing surFace and overlaying with
bituminous materiai. Also, condemning and taking an easement in the land necessary for the
slopes, cuts and fills, including right of removal of lateral support from subject land or land
remainder thereof, occasioned by excavation thereof or construction of slopes in the milling and
overlaying of said alley.
Attached are a Summary of Engineering Recommendations, an area map, and a Green Sheet. Please
notify me in advance of the mailing of the Public Hearing notice, so that we may include in the
mailing a notice of a neighborhood meeting to be held a few weeks prior to the Councii heazing.

PROJECT

and taking an easement in the land necessary for the slopes, cuts and fills, including right of removal of lateral
support from subject land or land remainder thereof, occasioned by excavation thereof or construction of slopes in
the milling and overlaying of said alley.
INITIATING ACTION ,
This improvement was initiated by a petition signed by 33% (58% by abutting footage) of the abutting property
owners.
EXISTING CONDITIONS
The alley is platted 15 feet wide. The alley is unimproved. The surface of the alley is bituminous.
PROPOSEDIMPROVEMENT
Mill the existing surface in the alley to a width of 15 feet and overlay with hot mis bituminous pavement.
