having considered said report, hereby resolves:
1. That the said report and the same is hereby approved with no alternatives, and that the estimated cost thereof
is $2,845.00, is to be financed by assessments.
2. That a public hearing be had on said improvement on the 1 Sth dav of Febnxarv, 2009, at 5:30 o'clock p.m., in
the Council Chambers of the City Hall and Court House Building in the City of Saint Paul.
3. That notice of said public hearing be given to the persons and in the manner provided by the Charter, stating
the time and place of hearing, the nature of the improvement and the total cost thereof as estimated.

The problem "defective sidewalk" was caused by multiple problems, tree roots, poor subgrade materials, freezelthaw cycles, service
life limits, chemical additivies, extreme temperature variations, e[c. These problems occur on a citywide basis and must be addressed
and coirected annually. Left uncorrected, the sidewalk condiUOn would worsen to a state where it would be unusable and subject to
increased pedestrian injuries froms falls and possible litigations.
Advaqtages If Approved:
The communiry will benefit from this project because it will provide safe defect free sidewalks for its citizens. The sidewalk contracts
aze done by private contractors generating public sector jobs as a result.
Disadvanpges If Approved:
Historically, the sidewalk reconstrucHon has created negarive feedback because of construcrion procedures and assessments. Having
to assess for walk reconstruction remains a controversial issue. .
Disadvantages If Not Approved:
This option would ailow [he infrastructure of sidewallc stock to deteriorate, which in turn, will generate more personal injury suits,
resuldng in the expenditure of larger dollar amounTS in repairs and replacements, as weli as ciaim payouts.

INITIATING ACTION.• This order was initiated by the Director of Public Works as
public necessity on the basis of a request from the property owner and an inspection of
the walk.
This walk is poured concrete with cracked and tree heaved
panels.
