In the Matter of Acquiring Property Rights necessary to purchase vacant land
owned by the Burlington Northern Santa Fe Railroad (BNSF) and located in the
Lower Phalen Creek area as shown on the attached map (Exhibit "A").
The Council of the City of Saint Paul having received the report of the
Mayor upon the above improvement, and having considered said report, hereby
resolves:
1. That the said report and the same is hereby approved with no
alternatives, and that the cost thereof to the City of Saint Paul
is $1,897,000.00, financed by federal and state grants.
2. That a public hearing be had on said improvement on Wednesday,
November 7, 2001, at 5:30 o'clock P.M., in the Council Chambers of
the City Hall and Court House Building in the City of Saint Paul.
3. That notice of said public hearing be given to the persons and in
the manner provided by the Charter, stating the time and place of
hearing, the nature o£ the improvement and the total cost thereof
as estimated.

Creek area for future development for trails and parkland. The ��� �
Trust for Public Land has been negotiating on behalf of the City
to purchase the properly and convey it to the City by end of 2001.
This Preliminary Order would set a public 6earing date for the HE COiJNCIL HEARING ON
Final Order to authorize ac uisition of the ro e
THIS MATTER IS SET FOR

The City will have a vatuable urban green space for future park
and trail develo ment. NOVEMBER 7�2�01
ISADVANTAGES IF APPROVED:
The City will be required to devote additional resources to the
maintenance and u kee of this new ark s ace.

The City will be unable to acquire and develop this valuable
natural resource.
