In the Matter of Condemnation and taking of permanent and temporary easements
for the construction and future maintenance of the 7th/Cedar Area Combined Sewer
Separation Project under and across the following described property:
Subject to existing buildings, a 20.00 foot wide permanent easement for storm
sewer purposes under and across that part of vacated Market Street and vacated
Spring Street in the City o£ Saint Paul, Section 6, Township 29 North, Range 22
West, Ramsey County, Minnesota, which lies 10.00 feet on each side of a
centerline described as commencing at the northeast corner of Lot 1, Block 21,
Rice and Irvine's Addition to St. Paul, according to the recorded plat thereof,
Ramsey County, Minnesota; thence North 61 degrees 34 minutes 17 seconds East
(assuming the easterly line of said Block 21 bears North 9 degrees 06 minutes 45
seconds West) a distance of 27.48 feet to the point of beginning of the
centerline to be described; thence South 4 degrees 53 minutes L& seconds East a
distance of 36.44 feet to a point hereinafter referred to as "Point A"; thence
continuing South 4 degrees 53 minutes 18 seconds East a distance of 76.24 feet;
thence South 17 degrees 59 minutes 38 seconds East a distance of 73.83 feet;
thence along a line South 38 degrees 14 minutes 42 seconds East a distance of
32.82 feet to the northerly right-of-way of the Soo Line Railroad property;
thence continuing southeasterly on a line which lies 2.5 feet westerly of and
parallel to the centerline of said vacated Market Street to the southerly right-
of-way line of the Soo Line Railroad property, also being the northerly line of
Shepard Road and there terminating. The easterly and westerly lines of said
easement are to be prolonged or shortened to terminate northerly at a line drawn
from the northeast corner of said Lot 1, Block 21, to the intersection of the
west line of Lot 8, Block 20, said Rice and Irvine's Addition to St. Paul, and
the South line of Kellogg Boulevard as widened, and to terminate southerly at the
northerly right-of-way line of Shepard Road. The portion of said easement
extending from said north line of the above described property to said "Point A"
lies between the elevations of 0 feet and 30.0 feet, City of St. Paul Datum.
Also, temporary easements for construction purposes as shown on file with the
Real Estate Division, Room 140 City Hall, Saint Paul, Minnesota. Said temporary
easements to expire January 1, 1996, or at the completion of said project,
whichever occurs first.

The Council of the City of Saint Paul having received the report of the Mayor
upon the above improvement, and having considered said report, hereby resolves:
1. That the said report and the same is hereby approved with no
alternatives, and that the estimated cost thereof is $8,730.
financed by Sewer Revenue Bonds.
2. That a public hearing be had on said improvement on the 22nd day
March, 1995, at the hour of 3:30 p.m., in the Council
Chambers of the City Hall and Court House Building in the City
of Saint Paul.
3. That notice of said public hearing be given to the persons and
in the manner provided by the Charter, stating the time and place
of hearing, the nature of the improvement and the total cost
thereof as estimated.
