An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the Gity of Saint Paul and the zoning maps
thereof:
WHEREAS, Pursuant to Minnesota Statutes §462.357 and § 64.400 of the Legislative
Code, Ted And Lynn LLC duly petitioned to rezone 1389 Hawley St and 0 Hawley St.,
Parcel Identification Numbers (PIN) 192922320158 and 192922320157, legally described
as Hagers Subdivision Of Lots1 Vac Alley Adj & Lots 26 & 27 Blk 5 and Hagers Subdivision
Of Lots1 Vac Alley Adj & Lots 28 Bik 5, from RM2 Medium-Density Multiple-Family
Residential to TN2 Traditional Neighborhood; the petition having been certified by the
Planning Division on March 24, 2010, as having been consented to by at least 67 percent of
the owners of the area to be rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within 100 feet of the total contiguous property
within one year preceding the date of the petition; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
April 1, 2010, for the purpose of considering the rezoning petition, and pursuant to §107.03
of the Administrative Code, submitted its recommendation to the Planning Commission for
approval; and
WHEREAS, the Pianning Commission considered the rezoning petition at its meeting held
on April 9, 2010, and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the Gity Council on said rezoning petition was
duly pubiished in the official newspaper of the City on April 1, 2010, and notices were duly
mailed to each owner of affected property and property situated wholly or partly within 350
feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on April 21,
2010, at which all interested parties were given an opportunity to be heard, the Council
having considered all the facts and recommendations concerning the petition; now,
therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 4, as incorporated by
reference in § 60.301 of the Saint Paul Legislative Code, as amended, is hereby further
amended as foilows:

Patricia James presented the staff report with a recommendation of approval for the Rezoning.
Patricia James also stated District 6 recommended approval, and there was letter in support,
and 0 letters in opposition.
Lynn Natus, #he applicant explained that the buiidings currentiy located at 1386 Rice Street are
the United Rental buildings that, have been vacant for a long time, and that they have owned the
property for about two years. She stated that they would like to improve Rice Street and expand
their business by redeveloping the propefij. Ms. Natus also stated they witl be maintaining the
location across Rice Street after they complete this redevelopment. .�
Kerry Antrim, District 6, expiained that District 6 is very careful regarding rezoning cases and
takes each development at its own merit. She sfated that District 6 beiieves that the
redevelopment would be a huge community benefit, especiaily for Rice Street; and they support
if one hundred percenf. She stafed that Disfricf 6 agrees fhat if is nof spot zoning.
Danief Pollastrini, 3805 Oxford Drive, Woodbury, NIfV, of Pope Archifects offered to answer any
questions the Committee has regarding the building pfans. Mr.,Pollastrini presented a sample
of the buifding material to be used for Hamernick's.
The public hearing was ciosed.
Gommissioner Barbara Wencl moved approval of the Rezoning. Commissioner Jon Commers
seconded the motion.
The motion passed by a vote of 6-0-0. �

On March 1, 2010, you applied rezone property at 1389 and 0 Hawley St. After a public
hearing by the Saint Paul Planning Commission's Zoning Committee on April 1, 2010, the
Commission voted to recommend approval of your request on April 9, 2010.
. The Planning Commission's recommendation is being forwarded to the City Council for their
action. Minnesota Statutes 15.99 requires that all city action on zoning applications be
completed within 60 days of the date the application is made, but ailows the City to extend this
period for an additional 60 days (totaf of 120 days). The City Councii public hearing on this
rezoning has been scheduled for April 21, 2010, and it appears that the deadline for action will
be met. Fiowever, in order to ensure sufficient time for acfion on your rezoning, the City of Saint
Paul is hereby extending the deadline for action from April 30, 2010, (original 60 day deadline)
to June 29, 2010 (additional 60 day deadfine). This e�ension will have no impact ori your
development schedule as long as the Cifij Councii acts on your petition to rezone on April 21.

F. HISTORYiDISCUSSION: There is no zoning history for these parceis. An application for
variances of TN design standards that includes these parcels as well as 1386 Rice St. has
been submitted (Z.F. # 10-106-605) along with this application. A site pfan has afso been
submitted for review by City staff (Z. F. # 10-113-485).
G. DISTRICT COUNCIL RECOMMENDATION: The District 6 Planning Council recommends
approvai of the rezoning.
H. FINDINGS:
1. The applicant is proposing to redevelop property at 1386 Rice for a home decorating
showroom and warehouse. The plans include using these lofs for parking and for
maneuvering of trucks making deliveries to the business. Since these parcels will
become part of the larger development, the applicant is requesting their rezoning to TN2
to be consistent with the rest of the site.
2. The proposed zoning is consistent with the way this area has developed. It appears th�t
these lots have been used for parking in the past by the previous rent-all business on
Rice.

3. The proposed zoning is consistent with the Comprehensive Plan. The 20�5 Rice Street
Small area plan vision includes: Rice Street should be a safe, successfu/ commercia4
area that welcomes pedestrians as well as automobiles.... Buildings are built up to�he
sidewalk, with doors and v✓indows opening to the street.... The District 6 North
End/South Como plan includes a policy "...to Maintain and Enhance the Built
Environment by ...preserving the mainstreet character of Rice Streef... The
development proposed will have the main building at the corner of Rice and Cottage. .
4. The proposed zoning permits a mix of residential and commercial uses and is
compatible with the mixed nature of development in the area and is consisterrt with the

Land Use Plan {2010}, which identifies Rice Street as. a mixed use corridor and supports
a mix of uses in these corridors (Policy 1.24).
5. Cour# ru6ngs have determined fhat °spot zoning i§ illegal in Minnesota. Minnesota
coufts have stated tfiat this term ° applies to zoning changes, typically limited to smal/,
plots ofland, which esfablish a use classification inconsistent with the surrounding uses
and creates an isfand of nonconforming use wifhin a larger zoned district, and which
dramatically reduce the value for uses spec�ed in the zoning ordinance of either the
rezoned plot or abutting properiy_' Because the proposed use is consisfent with the
zoning to the west and fhe area already contains a mix of uses, changing the zoning
dassification to TN2 would not constitute spot zoning. .
6. The petition was found sufficient on March 24, 2010: 21 parcels eligible, 14 parcels
required, 14 parcels signed.
I. STAFF RECOMMENDATION: Based on the above findings, staff,recommends approvai of
