s THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

8 Section 427.07 of the Saint Paul Legislative Code is hereby amended to read as follows:
10 Sec. 427.07. Construction, maintenance and staff requirements.
11 The following requirements shall apply to the construction, maintenance and staffing of the licensed

16 (13) Exception to on duty staffing rule. An exercise only facility may operate without a staff member on
17 the premises as required by paragraph (11) and (12) above under the following conditions:

19 a. The exercise only facility must be on the ground level of a commercial or traditional
2o neighborhood zoned building, or on the skvway level with skywa�access, The space
21 within the building must be at least five hundred (500) square feet with at least seventy-five
22 (75) square feet of external windows or windows facin� the skvway that allow passers by,
23 licensing officials, and police to see clearly into the building and allow meinbers to easily
24 see outside the facility. The facility shall have at least ten (10) cardiovascular exercise
25 machines including but not limited to treadmills, elliptical trainers and stationary bicycles;
26 and at least ten (10) st�ength training machines.

3o f. The exercise only faciliry shall have a working video surveillance system to provide
31 documentation of all activities on the interior of the facility (excluding locker rooms, rest
32 rooms and tanning facilities) and the exterior of the facility including the parking lot within
33 fifiy (50) feet of the entrance to the facility ox the skvway as faz as�ossible up to fiftv (501
34 feet of the entrance . If city police determine a preferred placement for cameras, licensee
35 shall position cameras as directed by city police. Recordings must be retained for ninety
36 (90) days and made available to the city police department or the department of safety and
37 inspections immediately upon request. In addition, the city police department and
38 department of safety and inspections shall be provided electronic access to the surveillance
39 system in order to monitor actions on the premises in live time.

g. All external or skyv✓av doors to the fitness only facility shall be equipped with tail�ating
alarms. All tailgating alarms shall be reported to the department of safety and inspections
along with the time and circumstances of the alarm.
Section 2
This ordinance shall take effect and be in force thirty (30) days following its passage, approval and
publication.
