An ordinance pursuant to Minnesota Statutes § 410.12, subd. 7(2009) amending Charter Section 5.03
regarding the Office of the City Attorney.
The Council of the City of Saint Paul does Ordain:
Section 1.
10 Pursuant to Minnesota Statutes § 410.12 subd. 7(2009), on February 17, 2010, the Saint Paul
11 Charter Commission recommended to tl�e Ciry of Saint Paul that a certain charter amendment, as more
12 fully stated below, be made by ordinance. Public notice has been given and a public hearing has been held
13 according to law. The Council of the City of Saint Paul, by unanimous vote, hereby amends Charter
14 Section 5.03 as follows:

Section 2.
Sec.5.03. Staff.
The city attorney may appoint icsvve-(�j three 3 deputy assistants, one of whom may be desi¢nated
the chief deputy�and such other assistants as in the city attorney's judgment are needed to carry on
the legal business of the city. The deputy assistants and other assistants shall be in the unclassified
service. The deputy assistants shall hold office at the pleasure of the city attorney, and the other
assistants shall be removable at pleasure during their fixst yeas of service, but shall not thereafter be
discharged except in the manner provided by administrative ordinance for employees in the
classified service.
Section 3.
27 This ordinance shall take effect ninety (90) days after passage, approval and publication.

Re: Charter Commission Recommendation to Amend Charter Section. 5.03
Dear Ms. Moore:
This letter is to advise you that on March 22, 2010, the Charter Commission of the City of Saint
Paul voted to recommend that Section 5.03 of the Charter be amended by ordinance adopted
unanimously by the Council, pursuant to Minnesota Statutes § 410.12, subd. 7(2009).
Minnesota Statutes § 410.12, subd. 7(2008) requires the city to publish notice of a public
hearing on this proposal within one month of receiving this recommendation. The notice must
contain the text of the proposed amendment. The city council must hold the public hearing at
least two weeks, but not more than one month after the notice is published. Within one month of
the public hearing, the city council must vote on the proposal. It is adopted if it recelves the
affirmative vote of all the councilmembers and is approved by the mayor. The ordinance must
be published as in the case of other ordinances.
For your convenience I have also enclosed a proposed ordinance to accomplish the amendment.
On a related point, Section 3.03 of the Administrative Code contains language similar to Charter
Section 5.03, so it is necessary to amend that as well. I have also enclosed a proposed ordinance
for that purpose. Whi1e the statutory timelines do not apply to this Administrative Code
amendment, for convenience sake you may choose to schedule it with the Charter amendment
ordinance. Note also that the Administrative Code amendment needs only four votes for passage
even though the Charter amendment requires a unanimous vote.
