pertaining to zoning for the City of Saint Paul and the zoning maps
thereof:

WHEREAS, Pursuant to Minnesota Statutes § 462.357 and § 64.400 of the Legislative
Code, New Harmony Care Ctr Inc duly petitioned to rezone 130 Rose Ave E, being legally
described as RANSOM'S ADDITION TO ST. PAUL LOTS 24 25 AND LOT 6 BLK 2,
RANSOM'S ADDITION TO ST. PAUL LOTS 24 25 AND LOT 26 BLK 2, RANSOM'S
ADDITION TO ST. PAUL LOT 11 BLK 2, SOO LINE PLAT NUMBER 4 LOTS 22 & 23 BLK
2 RANSOMS ADDITION & IN SD SOO LINE PLAT NUMBER 4 PART OF AGATE ST VAC
ADJ EAST & LOT F, and RANSOM'S ADDITION TO ST. PAUL LOTS 27 AND LOT 28

WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
January 28, 2010, for the purpose of considering the rezoning petition, and pursuant to
§107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission for approva; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held
on February 5, 2010, and recommended approval to the City Council; and
WHEREAS, notices of public hearing before the City Council were duly mailed to each
owner of affected property and property situated wholly or partiy within 350 feet of the
property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on March 3,
2010, at which all interested parties were given an opportunity to be heard, the Council
having considered all the facts and recommendations concerning the petition; now,
therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 5, as incorporated by
reference in §60.301 of the Saint Paul Legislative Code, as amended, is hereby further
amended as follows:

application in accordance with the requirements of § 61.303 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Pianning Commission, based on the evidence presented to its Zoning
• Commi�tee at the pubiic hearing as substantially reflected in the minutes, made the following findings
of fact:
1. The appficant, New Harmony Care Center Inc., proposes to construct, operate and maintain a
48-unit assisted Iiving facility. The 49,010 s.f. building will be four stories, at a height of 4S feet.
The applicant proposes to provide 40 parking spaces for the proposed facility, incliading 32
spaces in a subterranean parking garage and eight spaces in a surface parking lot adjacent to
the skilled nursing facility with access from Geranium Street; a single family residential
structure on Geranium will be deinolished for construction of the surface parking lot. An
existing parking lot for the skilled nursing facility will be reconfigured to provide 21 parking
spaces. In addition, the applicant proposes to construct a ground-level link between the
existing skilled nursing facility and the proposed assisted living facility.
2. The proposed zoning is consistent with the way this area has developed. 7he area is
developed as a mix of residential uses. The appiicant operates a skilled nursing facility
adjacent to the proposed project site; the skilled nursing facility is zoned RM2 Medium Density
Multiple Family Residential district. Single family residential is the predominate development in
the surrounding neighborhood.

3. The proposed zoning is consistent with fhe Comprehensive Plan. The current Land Use and
Hoiasing cliapters of the. Comprehensive Plan support the production of housing. The Housing
chapfer (Policy 5.2) states, in part: Promote good design solutions for housing that meets
newer maiicet needs and compleri�en�s existing Saint Paul neighborhoods. ... Tfie Land Use
chapter (Policy 5.3.1) states: Each of the 17 planning districts in the city should have life cyde
housing, that is, a m&ture of single-family housi�g, townhouses, condominiums, aparfinents,
and seniors housing. The preliminarily approved Housing and Land Use chapters of the
Comprehensive Plan updafe also support the production of housing. The Housing chapfer
(Polioy 2.18) states: Support the expansion of housing choices for seriiors, particularly in .
neighborhoods that are underserved. The Land Use chapfer includes two policies, including
promoting housing choiees for people of all ages (Policy 1.39) and Policy 1.40, P�omote the
deve%pment of a range of housing iypes and housing values in each of the �7 planning
districts. The adopted North End-South Como. District Plan (Dislrict 6) inciudes an
unnumbered paragraph that reads, rn part, Among the priorities fornewhousing is the
development of a variety of unit types fo meet the life-cycle needs of rreighborhood residents.

4. The proposed development is compatible with residential uses, including fhe skilled nursing

III. Planning Director's Announcements
Donna Drummond announced that the orientauon for the new comtnissioners will occur after the
regulaz Planning Commission meeting today, and she invited any current commissioner who
would like to attend to stay. Ms. Drummond said the orientaUon will include basic Planning
Commission procedures, the organization of PED, the current work program and an overview of
zoning.
Ms. Drummond also distributed a memo regazding zoning procedures from Peter Wamer,
Assistant City Attorney, who was not able to attend today's orientation session. Mr. Wazner had
suggested that it be passed out to all the commission members as a refresher and for their
information.

neighborhood; and the use is inconsistent with the Dishict 9 Plan Summary. Coznmissioner
Wazd seconded the motion.
Chair ponnelly-Cohen called for a roll call vote, and reminded Commissioners voting for the
moUOn to state their reasons, which could be the reasons provided by the maker of the motion.

Couunissioner Nelson said he assumes all lots-would be tied into a single pazcel. He also asked
that, if variances permitting construction of surface pazldng were denied but the pazcel next to ihe
sldlled nursing facility was rezoned to RM2, was it the applicant's intenuon to demolish the
single family housing? Penelope Simison, PED staff, said the applicant has not made a decision
regazding demolition of the single faznily house. Patricia James PED staff, added that if the
applicant redesigned the surface partdng so that variances were not required, they woald be able
to demolish the house. She added that her recoIlection from the committee testimony was that •
because of the grade change on the property between Rose and Geranium, the surface parldng
was intended for visitors to the sldlled nursing facility.
Commissioner Nelson said he did not think the surface pazking could be designed to provide a
required setback of 12.5 feet along the wesiem property fine. Ms. Simison said ihe site plan
showed all of the required set backs for the surface pazldng but, during t6e site plan review
process, the setback along the western property line was reduced to accommodate additional
landscaping for a buffer adjacent to the single family house in the R4 district.
Commissioner Nelson also asked about [he link between the sldlled nursing facility and the
assisTed ]iving facility, and whether variances were needed to allow it to be developed. Ms.
Simison stated that, if tlie commission recommends rezoning to RM2 and the council adopts it,
the entire property would be RM2 and variances would not be needed.
MOTION: Commissioner Morton moved the Zorting Commi#ee's recommendation to approve
the rezoning. The motiors carried unanimously on a voice vote.

standards. Property ]ying west of Pigs Eye Lake, east of Mississippi River, south of St. Paul

Commissioner Smitten wanted to lmow if staff has heazd from our parmers, DNR and the
National Pazk Service. Are they part of the review process of the restoration and erosion control
measures?
Josh Williams, PED staff, said the applicant did speak with the National Pazk Service and the
DNR. The National Pazk Service's concem was that the project avoid their land, which it does
and the DNR is alright with that.
Commissioner Smitten asked if the DNR or the National Pazk Service provided written comments
to the Metropolitan Council regazding the plan or will they be involved,in the review process of
the restoration strategy?
Mr. Williams said no. But there have been continued conversations with U.S. Fish and Wildlife
Service about some eagles that nest on Pigs Eye Island. The initial informauon was that those
nests were more then 1,000 feet away, but there is one that is about 750 feet away. This meets
the Fish and Wildlife Services conditions. In terms of the restoration the DNR will not be
monitoring it but there will be a third pazty monitoring it to make sure that it is meeting
conditions that aze laid out by the resolurion and that involves the Department of Safety and
• Inspections.
Commissioner Smitten suggested that the applicant contact DNR and other paztners on the
restoration planning. Mr. Williams stated that he thought thaC the applicant would be amenable to
this request.
MOTION: Commissioner Mortan moved the Zoning Committee's recommendation to approve
the corzditional use permit subject to additional conditions. The motion carried unanimausly
on a voice vote.
Commissioner Kramer announced the items on the agenda for the next Zoning Committee
meeting on Thursday, February 11, 2010.
V. Comprehensive Planning Committee
Saint Paul Comprehensive Plan — Report on Metropolitan Council review of Plan; draft resoludon
recommending City Council adoption of the plan. (Penelope Simison, 651/266-6554)
Penelope Simison, PED staff, said the Planning Commission reviewed and recommended
approval of the individual chapters and the Implementation and Introduction sections of the
Comprehensive Plan more than a yeaz ago. After the City Council approved the chapters of the
Plan, [he Metropolitan Council reviewed the Plan and, on December 9, 2009, approved the City's
Plan for consistency with regional planning documents. The changes requested by the
Metropolitan Council were technical in nature and not substantive. The resolution before the
commission recommends that the City Council adopt the Plan. A chart describing the City's

Task Force Reports
Commissioner Sautten announced that the Smith Avenue Revitalization Task Force will be
having their first meeting on Tuesday evening, February 9�' to stazt the Smitfi Avenue planning
work.
Couunissioner Thao announced that the Western, Haznline, and Victoria Steering Committee was
very pleased to heaz the news that these three stations aze going to be built with the initial LRT
conshucrion. They want to thank the Planning Commission for convening the steering committee
and look forwazd to moving ahead.
Commissioner Kramer serves on the 3M Design Advisory Group, but he has not been able to
attend the meetings so he asked if someone is interested in serving on that committee to talk to
him, Chair ponnelly-Cohen, or Luis Pereira who is the city's staff representafive.

Penelope Simison presented the staff report with a recommendafion of approval of the
Rezoning. Penelope Simison also stated District 6 recommended approval, and there was
letter in support, and 0 letters in opposition.
Upon questions from the Commissioners, Ms. Simison explained that the subterranean parking
would be used by staff and residents.
Jeremy Bork, 389 Kellogg Boulevard E, the architect, answered questions regarding the
variances. He stated that the proposed surface parking lot on Geranium Street was also
infended to be used by visitors to the skilled nursing facility.
The public hearing was closed.
No one spoke in support or opposition.
Commissioner Sfephen Gordon moved approval of the Rezoning. Commissioner George
Johnson seconded the motion.
The motion passed by a vote of 6-0-1

E. ZONING CODE CITATION: §61.801(b) provides for changes to the zoning of property
initiated by the property owner.
F. HISTORY/DISCUSSION: The property has been in the R4 district since 1975, when the
current Zoning Code was established.
G. DISTRICT COUNCIL RECOMMENDATION: District 6 had not sent comments at the time
the staff report was written.
H. FINDINGS:
1. The applicant, New Harmony Care Center Inc., proposes to construct, operate and .
maintain a 48-unit assisted living facility. The 49,010 s.f, buiiding will be four stories, at a
height of 45 feet. The applicant proposes to provide 40 parking spaces for the proposed
facility, including 32 spaces in a subterranean parking level and eight spaces in a surface
parking lot adjacent to the skilled nursing facility with access from Geraniurri Street; a
single family residential structure on Geranium will be demolished for construction of the
surface parking lot. An existing parking lot for the skilled nursing facility will be
reconfigured to provide 21 parking spaces. In addition, the applicant proposes to
construct a ground-level link between the existing skilled nursing facility and the proposed
assisted living facility.
2. The proposed zoning is consistent with the way this_area has developed. The area is
developed as a miic of residential uses. The applicant operates a skilled nursing facility
adjacent to the proposed project site; the skilled nursing facility is zoned RM2 Medium

Density Multiple Family Residential district_ Single family residential is the predominate
development in the surrounding neighborhood. V_
3. The proposed zoning is consistent with the Comprehensive Plan. The current Land
Use and Housing chapters of the Comprehensive Plan support tFie production of housing. •
The Housing chapter (Policy 5.2) promotes the development of housing that addresses .
new and emerging market needs and complements existing neighborhoods; the policy, in
part, is: -Promote good design solutions for housing that meets newer markef needs and
complemenfs existrng Saint Paul neighborhoods. .._ The Land Use ciiapter (Policy 5.3.1)
states that each of the 97 planrting districts should have life-cycle housing, includi�g senior
housing, so that peopie of all ages should be abie to live convenientiy in every part of.the
city; tFie poficy is: Each of the 17 planning districts in fhe city should have life cycle
housing, fhat is, a mixture of single-family housing, townhouses, condoininiums;
apartments, and seniors housing.
The preliminarily approved Housing and Land Use ehapters of the Comprehensive Plan-
update also suppoct the production of housing. The Housing chapter (Policy 2.18)
promotes the expansion of housing choices for seniors, particularly in neighborhoods that
are underserved; the policy is: Support the expansion of housing choices for seniors,
particularly in neighborhoods fhat are undersenied. The Land Use chapter includes two
policies, including promoting housing choices for people of all ages (Policy 1.39 — Promote
the development of housing that,provides choices for people of ali ages, including singies
and young couples, families, empty-nesters, and seniors.) and a range of housing types
and values in eacF� of the 17 pianning districts (Policy 1.40 — Promote the development of
a range of housing types and housing va/ues in each of fhe 17 planning districts).
The adopted North End-South Como District Plan (District 6) includes an unnumbered
paragraph that reads, in part, Among fhe priorities for new housing is the development of a .
variety of unit fypes to meet fhe life-cycle needs oineighborhood residents. Spec�ca!!y
missing from fhe current stock are units designed tor older persons.
4. The proposed development is compatible with residential uses, including the skilled
nursing facility and a multipie family residential building, both to the south of the proposed
project. .
I. STAFF RECOMMENDATION: Based on tfie above findings, staff recommends approval of
a rezoning from R4 One-Family Residential to RM2 Mulfiple Family Residential.
