PAUL LOTS 10, 11, & SUBJ TO ESMTS, LOT 12 BLK 4, PIN 022823120074, from B2 Community Business to TN2 Traditional Neighborhood; and WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on October 8, 2009, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code, submitted its recommendation to the Planning Commission for approval; and WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on October 16, 2009, and recommended approval to the City Council; and WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly published in the official newspaper of the City on September 29, 2009, and notices were duly mailed to each owner of affected property and property situated wholly or partly within 350 feet of the property sought to be rezoned; and WHEREAS, a public hearing before the City Council having been conducted on November 18, 2009, at which all interested parties were given an opportunity to be heard, the Council having considered all the facts and recommendations concerning the petition; now, therefore THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. Emily Goodman aiso stated District 8 made no recommendation, and there were 0 letters in support, and 0 letters in opposition. Upon inquiry from the Commissioners, Emily Goodman, stated that the Subway restaurant couldn't open without being rezoned to TN2 because it meets the criteria of a fast food restaurant, according to the zoning code, and that is not allowed in a 62 zone, because it wouid be a stand aione restaurant, and not part of a strip malL � Abdalla Tobasi, the applicant, stated that he has been trying to find a business for this property for awhile and he believes the Subway restaurant would be a good fit for the neighborhood. He approached Jackie and Jeff Lunde because he saw how well they transformed a property on University Avenue into a Subway. He aiso stated that he has a lease with the Jackie and Jeff Lunde. Patricia Lacy Aiken, 429 Dale Street, spoke in support. She stated that She thinks it would be a great addition to the neighborhood because it wouid providQ jobs and it wouid brighten up the comer that is now vacant. Jackie Lunde spoke in support. She stated that she and her husband have been in the community for 20 years and they are owners of two other Subway restaurants. Mrs. Lunde showed pictures of the Subway they own on University and stated that they wished to do the same at 857 Selby. She also stated that they are active owners in their business and with neighborhood groups. She explained that they gave a presentation to the Summit-University Planning Council and the Neighborhood Devefopment Committee, committing to tum a vacant property into a well maintained business inside and out. She stated that on August 18, 2009, they went to the Neighborhood Development Committee and they voted eleven in favor and two unopposed for the Subway restaurant. She explained that the two individuals, who voted unopposed, did so to highiight that they wanted the process of rezoning done right. She stated that the foliowing week the Sumrriit University Planning Councii affirmed the vote. AArs. Lunde a{so submitted a petition of peopte in support of the proposed Subway. Chris Ochs, 850 Dayton Avenue, spoke in opposition. Mr. Ochs stated that he has lived in the neighborhood since 2000 and actively participates in the community. He stated he has a Masters•in . urban and regionaV planning and {andscape architecture. Mr. Ochs stated that he doesn't believe the petition is a good representation of the neighborhood. He explained that he had never been asked to sign as well as at least eight other people he spoke to. He explained that he respects Mr. Tobasi, and his reason for opposition is his concern for Selby Avenue. He aiso stated that he doesn't believe the plan encoureges good pedestrian access and a well Iandscaped area as recommended in the neighborhood plan: He aiso stated that he was concemed vvith the additional source nf frash in the neighborhood, lighted signs that would be installed and the parking lot would increase runoff. , Ima Landrum, representing Summit-University Planning Council, stated that they are not in support of, but are u�opposed to the rezoning. She stafed that they have concems they would Iike on the record. She explairied that they are supportive of the Subway restaurenf, but not the. rezoning. Ms. Landrum expiained that when they initially heard of the development, fhey believed it was for a Conditional Use Permit application. She believes the LUndes a�e good business and community oriented people. Ms. Landrum stated that the Lunde's have agreed to design the interior to reflect the neighborhoQd, possibly with artwork. She aiso stated the concem of Selby Avenue becoming a fast food corridor if the rezoning is allowed. � Jackie Lunde added that the most recent pian does show pedestrian access. The public hearing was ciosed Upon inquiry of the Commissioners, Ms. Goodman explained she was unaware of the inconsistency between what was stated in the legend and the measurements in-regards to the number of parking spaces. She stated that the Department of Safety and Inspections was responsible for the site plan review. After further conversation pertaining to the TN2 zoning district and the ciefinition of spof zoning, Commfssioner Richard Kramer moved approval of the rezoning. Commissioner Brian Alton seconded the motion. The motion passed by a vote of 5-0-0.
