WHEREAS, Pursuant to Minnesota Statutes § 462.357 and § 64.400 of the Legislative
Code, Abdalla Tobasi duly petitioned to rezone 857 Selby Ave, being legally described as
NININGER & DONNELLY'S ADDITION TO HOLCOMBE'S ADDITION TO ST. PAUL LOTS
10, 11, & SUBJ TO ESMTS, LOT 12 BLK 4, PIN 022823120074, from B2 Community
Business to TN2 Traditional Neighborhood; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
October 8, 2009, for the purpose of considering the rezoning petition, and pursuant to
§107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held
on October 16, 2009, and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was
duly published in the official newspaper of the City on September 29, 2009, and notices
were duly mailed to each owner of affected property and property situated wholly or partly
within 350 feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on November
18, 2009, at which all interested parties were given an opportunity to be heard, the Council
having considered all the facts and recommendations concerning the petition; now,
therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 19, as incorporated by
reference in §60.301 of the Saint Paul Legislative Code, as amended, is hereby further
amended as follows:

hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of § 61.303 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantiaily reflected in the minutes, made the following findings

The applicant is seeking a rezoning from B2 Community Business to TN2 Traditional
Neighborhood for the purpose of accommodating-a planned 5ubway Restaurant on the site.
The proposed zoning is consistent with the way_this,area has developed. The TN2 district is
intended for use in existing or potential pedestrian and transit nodes: Seiby Avenue is a
transit corridor. TN2 is also intended to be part of an area with a variety of uses and housing
types, and the area near Victoria Avenue and Selby Avenue has a variety of business and
residential uses:
The proposed zoning is consiste�t with the Comprehensive Plan. The Summit-University
(District 8) Plan Area Plan Summary states that "priority will be given to commercial
development on the vacant lots and buildings at Selby and. Victoria as weli as vacant
commercial buildings on Selby Avenue west of Dale Street.° The existing adopted
Comprehensive Plan's Summary and General Policy Chapter states that °high priorities for
Saint Paul now are...to ensure th,at Cand resources with potential for business use are made
available and used to their maximum economic and community development.° Rezoning the
site to TN2 woufd permit a productive economic use on an otfierwise vacant site.
Additionally, the proposed Land Use plan has as a major strategy to "target growth in unique
communities," which focuses on sustaining the character of Saint Paul's existing singie family
neighborhoods while providing for the growth of mixed use communities, especially in
established corridors like Selby Ave�ue.
The proposed zoning is compatible with the surrounding land uses.
Court rulings have determined that "spot zoning° is illegal in Minnesota. Minnesofa courts
have stated that this term "applies to zoning changes, typically limited to smalf plots of land,
which establish a use class�cation inconsistent with the surrounding uses and creates an

The meeting was chaired by Commissioner Morton.

Emily Goodman presented the staff report with a recommendation of approval for the Rezoning.
Emily Goodman aiso stated District 8 made no recommendation, and there were 0 letters in support,
and 0 letters in opposition.
Upon inquiry from the Commissioners, Emily Goodman, stated that the Subway restaurant couldn't
open without being rezoned to TN2 because it meets the criteria of a fast food restaurant, according
to the zoning code, and that is not allowed in a 62 zone, because it wouid be a stand aione
restaurant, and not part of a strip malL
� Abdalla Tobasi, the applicant, stated that he has been trying to find a business for this property for
awhile and he believes the Subway restaurant would be a good fit for the neighborhood. He
approached Jackie and Jeff Lunde because he saw how well they transformed a property on
University Avenue into a Subway. He aiso stated that he has a lease with the Jackie and Jeff Lunde.
Patricia Lacy Aiken, 429 Dale Street, spoke in support. She stated that She thinks it would be a great
addition to the neighborhood because it wouid providQ jobs and it wouid brighten up the comer that is
now vacant.
Jackie Lunde spoke in support. She stated that she and her husband have been in the community for
20 years and they are owners of two other Subway restaurants. Mrs. Lunde showed pictures of the
Subway they own on University and stated that they wished to do the same at 857 Selby. She also
stated that they are active owners in their business and with neighborhood groups. She explained
that they gave a presentation to the Summit-University Planning Council and the Neighborhood
Devefopment Committee, committing to tum a vacant property into a well maintained business inside
and out. She stated that on August 18, 2009, they went to the Neighborhood Development
Committee and they voted eleven in favor and two unopposed for the Subway restaurant. She
explained that the two individuals, who voted unopposed, did so to highiight that they wanted the
process of rezoning done right. She stated that the foliowing week the Sumrriit University Planning
Councii affirmed the vote. AArs. Lunde a{so submitted a petition of peopte in support of the proposed
Subway.
Chris Ochs, 850 Dayton Avenue, spoke in opposition. Mr. Ochs stated that he has lived in the
neighborhood since 2000 and actively participates in the community. He stated he has a Masters•in
. urban and regionaV planning and {andscape architecture. Mr. Ochs stated that he doesn't believe the
petition is a good representation of the neighborhood. He explained that he had never been asked to
sign as well as at least eight other people he spoke to. He explained that he respects Mr. Tobasi, and
his reason for opposition is his concern for Selby Avenue. He further explained that he believes that
this is considered spot zoning and the proposed Subway does not meet the recommendations or

requirements listed in the District 8 Plan Summary. Fle also stated that allowing Subway to establish
would set the precedent for other fast food restaura�ts to enter the neigh6orhood. Mr. Ochs stated
that the parking requirement is 22 "spaces and that this would become a nonconforming lof with the
TN2 rezoning. He aiso stated that he doesn't believe the plan encoureges good pedestrian access
and a well Iandscaped area as recommended in the neighborhood plan: He aiso stated that he was
concemed vvith the additional source nf frash in the neighborhood, lighted signs that would be
installed and the parking lot would increase runoff. ,
Ima Landrum, representing Summit-University Planning Council, stated that they are not in support of,
but are u�opposed to the rezoning. She stafed that they have concems they would Iike on the record.
She explairied that they are supportive of the Subway restaurenf, but not the. rezoning. Ms. Landrum
expiained that when they initially heard of the development, fhey believed it was for a Conditional Use
Permit application. She believes the LUndes a�e good business and community oriented people. Ms.
Landrum stated that the Lunde's have agreed to design the interior to reflect the neighborhoQd,
possibly with artwork. She aiso stated the concem of Selby Avenue becoming a fast food corridor if
the rezoning is allowed. �
Jackie Lunde added that the most recent pian does show pedestrian access.
The public hearing was ciosed
Upon inquiry of the Commissioners, Ms. Goodman explained she was unaware of the inconsistency
between what was stated in the legend and the measurements in-regards to the number of parking
spaces. She stated that the Department of Safety and Inspections was responsible for the site plan
review.
After further conversation pertaining to the TN2 zoning district and the ciefinition of spof zoning,
Commfssioner Richard Kramer moved approval of the rezoning. Commissioner Brian Alton seconded
the motion.
The motion passed by a vote of 5-0-0.
