THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 7 Section 409.27 of the Saint Paul Legislative Code is hereby created to read as follows: 409.27 2:00 a.m. Closine Licenses 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 (a) Issuance of license A 2�00 a m closinQ license may be issued subiect to the approval of the li uor control commissioner, to the proorietor of anv establishment that holds an on-sale intoxicating liquor license issued under this chaoter provided that the licensee obtains a permit from the State of Minnesota, and pavs the license fee in the amount listed in section 310.18 of this code. �bl Notice. Prior to issuance of a new 2:00 a m closing license the deroartment of safetv and inspections shall notifv bv mail all owners of residential prooertv within three hundred fiftv (3501 feet of the establishment to be licensed and all communitv oreanizations that have previously registered with such department. The three hundred fiftv (350) feet calculated and computed as the distance measured in a straight line from the nroperty line where intoxicatine liquor is sold consumed or kept for sale to the nearest point of the property line owned. If the director is recommendin� issuance of the license, but the affected neiehborhood organization(s) or other interested nersons give notice within forty-five (451 davs of receipt of the notice obj ection to issuance of the license, the matter shall be referred for a hearin� before the le�islative hearin� officer, who shall give notice of the time, place and date of the hearing to the affected neighborhood or¢anization(s) and the applicant The legislative hearine officer shall take testimony from all interested uersons and shall make a recommendation to the council at a public hearin� to consider the license as to whether the matter should be referred for a hearing before an independent hearing examiner in accordance with the vrocedures set forth in section 310.05 If the new 2:00 a.m. closin� license is issued in coniunction with any new on-sale license then the notice provisions anplicable to the on-sale license shall avplv. (c) Existin� permit holders.
