THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
8 Section 417.02 of the Saint Paul Legislative Code is hereby amended to read as follows:

11 Except where otherwise expressly stated, the following terms, wherever used in this chapter, shall have the
12 meanings respectively ascribed to them in this section:

14 "Parking lot" or "parking lot or building" means and includes any premises where ten (10) or more motor
15 vehicles are parked, stored or allowed to remain, and where the owner or person storing or parking such
16 vehicle is charged a fee therefor. "Parking lot" excludes any parking area other than a parking gazage that
17 is exclusively used by or leased to occupants of a residence on the same or other premises for use Qn1y in
18 connection with and as accessory to the occupancy of such residence.

20 "Parking garage" means a building or structure, or part thereof, in which the primarv use of at least one a
21 shuctural level (a structural level is a level with space below �r'�° �°-�.�e� +'^°' ���'-� ����. is ase�
22 for pazking, storing, or maintaining motar vehicles. `

24 "Govemment parking garage" means any garage owned by a governmental unit where the owner or person
25 storing or parking such vehicle is not charged a fee.

"Private parking garage" means any parking garage which is exclusively used by or leased to occupants of
a residence or business on the same or other premises for use only in connection with and as accessory to
the occupancy of such residence or business, and where the owner or person storing or pazking such
vehicle is not charged a fee.
"Light color" means any surface color with a minimum light reflective value of sevenTy-five (75) percent
or more as indicated by standard paint color charts.
"Type I structural condition survey" means �vs� visual observations performed under the direct
supervision of a professional en¢ineer licensed by the State of Minnesota of a11 structural components
including, but not limited to, the top and bottom side of all structural floors, helixes, and all supporting
beams, columns, or walls.
Type II structural condition survey" means a Tvpe I survev -����•"' �'�°°n�°*���° plus nondestructive tests
such as, but not limited to, chain dra�eine, half-cell testine, and drillinp for chloride ion concentration
tests, andlor destructive tests such as, but not limited to, removal of concrete for �e compression

(1) No structural condition survey is required for five (5} years after initial construcrion.
(2) A minimum of a Type I structural condition survey is required bv the end of �g the sixth year.
(3) A minimum of a Type I structural condition survey is required bv the end of �g the seventh year.
(4) A Type � II structural condition survey is required bv the end of �i�rg the eighth year.
� Followingthe end of the eighth vear as a minimum a three-vear cvcle of a Twe I condition surve�,
foliowed bv another Tvpe I condition survev and then a Type II condition survey shall be
maintained.

In the event that structural condition survevs have not been�erformed uer the schedule above DSI's staff
structural en�ineer must aoorove the level of survev to be performed.
A written renort documentingthe results of the survev shall be vrovided to the Department of Safetv and

resulting in the actual age of the structure not being a true indicator of potential distress.
(2) Documentation of on-site engineering involvement during recent restoration work.

114 This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and
