State Fire Code--Adoption. ,3 Pursuant to Minnesota Statutes, Section 299F.011, and Minnesota Rule 7510.351 Q the State Fire Code, one (t) ,� copy of which has been marked as the official copy and which is on file in the office of the city clerk, is hereby adopted ,s as the fire code for the City of Saint Paul, Minnesota, for the purpose of prescribing regulations governing conditions ,s hazardous to life and property from fire or explosion. Every provision contained in the State Fire Code, except as „ hereinafter amended, is hereby adopted and made a part of this chapter as if fuNy set forth herein. Enforcement. z� The chief of Ihe department of fire and safety services (hereinafter for convenience of reference "chief" or "fire chief") z3 or his authorized representatives shall enforce the provisions of this chapter. Definitions. ze The following definitions shali apply to this chapter: zz (1) Ju�isdict�on. Wherever the term "jurisdiction" is used in the Minnesota Uniform Fire Code, it shall be held to mean ao the City of Saint Paul az (2) Code; fire code. "Code" or "fire code," where not more specifically enumerated, shall be construed to include the �3 State Rre Code, as adopted by ihe Sta1e of Minnesota pursuant to Minnesota Statutes, Section 299F.011 and any 3a amendmen[s thereto as adopted by the City of Saint Paul, as welLas other provisions of this Legislative Code having 3s reference to the duties of the department of fire and safety services and the division of fire prevention and prescribing 36 regulations governing conditipns hazardous to life and property from fire or explosion. 31 aa (31 Fire alarm svstem. "False fire alarm" means the activation of a fire alarm svstem which is intended to summon a a3 fire department response bv the fire alarm svstem user owner desiqnated contact person or qerson in control of the aa premises on which the fire alarm svstem is placed throuqh intentional misuse' mechanical failure or malfunction as imoroper installation maintenance or supervision� or nealiqence The term does not include alarms caused bv force ae maieure, or other conditions which are clearlv bevond the control of the alarm user. " Fire alarm svstem user" means a person, emplovee, firm, partnership, association, as corooration, companv, or other entiN, which uses or is in control of a fire alarm svstem at an alarm site, reqardless of as whether the user owns or leases the fire alarm svstem. � s, �) Desiqnated contacf person. Penalties. sa (a) Unless otherwise stated herein, any person who shall violate any of the provisions of this code hereby adopted or ss fail to comply therewith, or who shall vio{ate or faif to comply with any ordet made thereunder, or who shall build in se violation of any detailed statement of specifications or plans submitted thereunder, or any certificate or permit issued e, thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or se modified by the fire chief or his authorized representative or by a court of competent jurisdiction within the time fixed ss herein, shall severally for each and every such violation and noncompliance, respectively, be guilty of a misdemeanor ro violation. The imposition of one (1) penaffij for any violation shall not excuse the violation or permit it to continue; and �, all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when �z not oiherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense. ]3 �a (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. �s (Ord. No. 17270, § 1, 8-27-85) ]6 �� Sec.55.06.Overcrowding. �a Overcrowding and admittance of persons beyond the approved capacity of a place of assembly are prohibited. The �a chief, upon finding overcrowding conditions or obstruction in aisles, passageways or other means or egress, or upon ao finding a condition which constitutes a serious menace to life, is authorized to cause the performance, presentation, e, spectacle or entertainment to be stopped until such condition or obstruction is corrected. az (C.F. Standby personnel. es When, in the opinion of the chief, it is essential for public safety in a place of assembly or any other place where peopl 86 congregate, due to the number of persons, or the nature of the performance, exhibition, display, contest or activity, the e� owner, agent or lessee shall employ one or more qualified persons, as required and approved, to be on duty at such ee place. Such individual's duties shall be the following: 89 90 Be subject to the chiefs orders at all times when so employed and shall be in uniform and remain on duty during the 9, times such places are open to the public, or when such activity is being conducted. Before each pertormance or the vz state of such activity, such individuals shall inspect the required fire appliances provided to see that they are in proper aa place and in good working order. Fees for False Fire Alarms. ,os False �re alarms: fee schedule. Anv person found to be in violation of this ordinance bv summoninq fire personnel ,os shall be issued a warninq for the first two (2) violations thereof. A fee shall be paid bv the fire alarm svstem user to ,oz the Citv for each false fire alarm in excess of two (21 per calendar vear. The fee shall be two hundred fifty dollars ,oa ($250.00) for the third false alarm, three hundred dollars ($300.00) for the fourth false fire alarm, three hundred fiftV ,os dollars ($350.00) for the fifth false fire alarm and five hundred dollars ($500.00) for the sixth false fire alarm. Advantages If Approved: There would be less cost and dsk to the Deparknent of Fire and Safety Services responding to false fire alazms. Disadvantages If Approved: Additional costs to building owners who do not repair their fixe alazm after two malfuncrions each year. Disadvantages If Not Approved: The Department of Fire and alarms.
