An Ordinance Amending Chapter 293.09 Of The Saint Paul Legislative Code To
Include Noise Variance Fees In Chapter 310
THE COUNCIL OF TAE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
Section 293.09 of the Saint Paul Legislative Code is hereby amended to read as follows:
Sec. 293.09. Variances.
(a)

Authority. The city council shall have authority, consistent with this section, to grant variances
from the sound level restrictions contained in section 293.09.
Application. Any person seeking a variance shall file an application with the department on a form
prescribed by it. The application shall include the following information:
(1) Name ofresponsible person.
(2) Dates during which the variance is requested.
(3) I,ocation of particular noise source and times of operation.
(4) Nature of the noise source and equipment involved.
(5) Reasons why a variance is sought.

Steps taken to minimiae the noise level from the source.
A noise impact statement, if required by the department.

(c) Fee. The application shall be accompanied by the payment of a fee, which fee shall be listed in

(d) Norice:
(1) The department shall notify by mail all property owners within two hundred (200) feet of
the source of the proposed variance, measured from the property line of the noise source. If
the department finds, however, that more than one hundred fi$y (150) property owners are
within two hundred (200) feet of noise source, it may, in its discretion, send no more than
one hundred fifty (150) notices to such property owners as it determines will be most
affected by the noise source. Further, if more than one hundred fifty (150) property owners

43 aze determined to be affected, the department shall cause to be published in newspapers of
44 general circulation a notice whose contents shall be in conformance with this chapter and in
45 a form customarily used for governmental announcements. The deparhnent may, if feasible,
46 place the notice in community newspapers serving the azea. The departrnent shall also
47 notify the city councilmember(s) and district planning council(s) whose areas aze affected.

49 (2) The notice shall include a statement describing the variance request, the date of the public
50 hearing before the city council on the variance request, and a statement that written comments
51 or objections may be filed with the department witYun fifteen (15) days of the mailed notice.

Section 2
55 This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and
56 publication.
