An ordinance amending Administrative Code Chapter 9 Department of Fire and Safety Services
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

10 Chapter 9 of the Administrative Code is amended to read, as follows:

12 Sec. 9.01. Department generally.
13 (a) Department established. There is hereby established an executive depariment of the City of Saint Paul
14 to be known as the department of fire and safety services. The head of such deparhnent shall be the fire
15 chief, who shall be appointed in accordance with the provisions of the City Charter and shall have such
16 qualificarions as the council may by ordinance provide.

18 (b) Departmental funetions. The deparhnent sha11 be responsible for the establishment, maintenance and
19 administration of an organized method for fire fighring and fire prevention within the city, and shall
20 perform the following funcrions:

22 (1) Take all necessary steps for the extinguishment of fires within the city, including utilization of
23 all necessary personnel and equipment therefor, the destruction of any building or structure and the
24 removal of any obstruction for the purpose of checking or extinguishing any such fire.

26 (2) Establish the location, relocation or removal of a11 public fire alarm boxes.

(3) Possess the police powers necessary to carry out the duties imposed upon them by law, while
engaged in the service of fire extinguishment.
(4} Assist in the re-establishment of order in the event of civil disturbance, disaster or riot or any
other declared emergency.
(5) Provide for and administer a program for the training of firefighters.
(6) Maintain a record of all fires which occur within the city requiring the services of the
department.
(7) Carry out the terms and provisions of all fire service contracts entered into with other
governmental subdivisions.

(8) Investigate the causes of all fires and provide for written reports of all suspected arsons.
(9) Possess the police powers necessary to carry out the duties imposed upon them by law, while
engaged in the service of fire protection.
(10) Inspect all buildings and structures as provided for by the state fire code, and for the issuance
and renewal of certificates of occupancy.
(11) Provide rescue and ambulance service.

52 (c) Fire chief,• powers and duties. The fire chief shall be appointed by the mayor with the consent of the
53 council and shall serve far a term of six (6) years. The fire chief shall be in the unclassified service of the
54 city. The fire chief shall be accountable to the mayor and, subject to the mayor's supervision and control,
55 shall administer the affairs of the department. The fire chief shall have general authority and control over
56 all deparhnental staff and shall oversee the proper fulfillment of all tasks and duties assigned to the
57 deparhnent. The fire chief shall have the power to prescribe such rules and regulations as the fire chief
58 deems necessary or expedient for the proper operation of the department and to that end shall keep
59 informed of the latest administrative practices. The fire chief shall have the power and duty to take all
60 personnel actions, including hiring, assigning and reassigning employees, including supervisory personnel,
61 within the department and shall supervise their performance.

77 This ordinance shall take effect and be in force thirty (30) days following its passage, approval and
