07-314Council File # � 7 �� Green Sheet # 3p3$QSi� ORDINANCE CITY OF SAINT PAUL, MINNESOTA r!� Presented By 2 3 4 5 6 7 An ordinance amending Chapter 200 to disqualify certain individuals from licensing dogs in the City of Saint Paul THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 Chapter 200.02 of the Saint Paul Legislative Code is hereby amended to read as follows: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 Sec. 200.02. License required. �, �.. ' � � (a) No person shall own, harbor, keep ar maintain in the city any dog over three (3) months of age without a license. A license is required if the dog is owned, harbored, kept ar maintained for three (3) consecutive days or more, except that no license shall be required for dogs whose owners are temporarily within the city, nor to dogs brought into the city for the purpose of participating in any dog show. Any properly identified service dog which aids persons who are totally or partially blind or deaf, or have physical or sensory disabilities, shall be issued a dog license at no charge upon providing proof of certification of training as a service dog. No license shall be issued to any person under the age of eighteen (18). A minor who owns a dog in the city must have the dog license issued in the name of a parent or guardian on his/her behalf. (b) New and renewal applications for licenses shall require the owner, in addition to any other information required by the animal control supervisar, to supply the name, age, breed, sex, color and markings, proof as to whether the animal has been spayed or neutered and proof of up-to-date rabies vaccination shots, if any, of each dog sought to be licensed. Proof of rabies vaccination shots may be in the form of a certificate signed by the administering veterinarian or verbal confirmation by the veterinarian that rabies shots have been given. In addition, the owner shall be required to provide inforxnation on whether the animal has been declared dangerous or potentially dangerous in any other municipality. If the owner has been convicted of a violation of section 200.10, relative to the dog sought to be licensed, the application shall require proof of public liability insurance in the minimum amount of three hundred thousand dollars ($300,000.00). (c) Licenses shall be available for purchase at the city animal control facility and at the office of license, inspections and environmental protection (LIEP). Veterinarians, pet shops, animal facilities and pet grooming facilities who provide a service for dogs may also act as deputy license vendors. Procedures far the issuance of such licenses shall be established by LIEP. Owning or maintaining a do� which has been declazed dan¢erous because it has e�ibited unusually agg;ressive behauior, such as an attack on another animal• 3. OwninQ or maintainin¢ a do� which has been declazed dan�erous because it has bitten one (1 or more persons on two L) or more occasions: 4. Owniue or maintainine a doe which has been declazed danterous because it has been found to be potentiallv daneerous and/or the owner has versonal laiowledqe of the same, and the animal aggressively bites attacks, or endangers the safetv of humans or domestic animals: 5. Owning or maintainine a dog which has fresh wounds. scarrin or is observed in a fig.ht, or has other indications which to a reasonahle person evidences that the animal has been or will be used, trained or encouraeed to fi�,ht with another animal: 6. Violatin� Minn. Stat. §343.21: or 7. Having a doe removed nursuant to Minn. Stat. &§ 343.12 343 22 343 29 or 34331. Denial of a license under this section shall be apnealable to the Directar of LIEP or his/her desi ee.
