THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: y =�N:� Section 1. � �� �� Section 3 A 1.3 of the Charter of the City of Saint Paul is hereby amended to read as follows: Sec. 3.01.3. The mayar shall appoint, with the advice and consent of the council, to the positions of city attorney, eity eterl� and all heads of executive departments, which appointees shall serve at the mayor's pleasure, except as provided otherwise in this Charter. Section 2. Chapter 4 of the Charter of the City of Saint Paul is hereby amended to add a new section as follows: Sec. 4.06.1. There sha11 be included in the council an office of the city clerk, with such functions as prescribed by this charter, the ordinances and other law. The council bv resolution shall appoint a city clerk, who shall serve at the pleasure of the council. Section 3. Section 9.01 of the Charter of the City of Saint Paul is hereby amended to read as follows: Sec. 9.01. Executive departments. There shall be an office of the mayor, office of the city attorney, and such additional executive departments as may be established by ordinance. Each executive department so established shall have such functions as are prescribed by ordinance. Except as hereinafter provided, the head of each executive departxnent shall be appointed and removed as provided by Section 3.013, azid shall have such educational and professional qualifications as may be prescribed by ordinance. If an executive department so established shall be restricted in function to police activities, then, and only in such event, the chief of police appointed parsuant to Section 12.12 shall be head of such deparhnent. Every office, agency or fixnction of city government not otherwise assigned by this Charter or by ordinance sha11 be included in the office of the mayor, and no power or duty conferred by this Charter upon a particular office or agency shall be transfened to any other. ��� a a�-�-� 42 43 44 45 46 47 48 Section 4. � 5 . 3 o3�� � 7��/� This ordinance, having been recommended by the Charter Commission and having been passed unanimously by all members of the City Council, shall become effective 90 days after its passage, approval and publication. � �! Dear Mayor Coleman and Council Members: On February 14, 2007, the City Council adopted resolution #07-128 asking the Saint Paul City Charter Commission (hereinafter "Commission") to consider a proposed Charter amendment placing the City Clerk under the authority of the City Council. The Commission considered this proposed amendment on February 26, 2007, during their regularly scheduled meeting. After a presentation and discussion with Trudy Moloney and Shari Moore, the Commission voted to remove the words "approved by the mayor" fmm the proposed section 4.061. The Commission believed these words were redundant in light of Charter sections 3A17 and 6.08 requiring the approval of the Mayar far all resolutions to be effective. With that amendment to proposed section 4.06.1, the Commission voted unanimously to recommend the proposed Charter amendments to section 3.01.7, 4.06.1 and 9.01 be adopted by ordinance pursuant to Minnesota Statutes § 41012, subd. 7(2006). Unfortunately, the amendment was not passed during the one month time frame as required by Minnesota Statutes Section 410.12„ Subd. 7(2006), because there was not full membership of the council present to vote on the matter. Since the fime expired before the amendment could be passed, the proposed amendment was brought back befare the Charter Commission at a special meeting on May 21, 2007, for a vote to recommend the amendment. The Charter Commission voted unanimously to recommend the proposed amendment as it had been presented on February 26, 2007.
