An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof:
WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.400 of the Legislative Code,
Nou Vang, in Zoning File 06-289-537, duly petitioned to rezone 892 Hamline Ave N, being
legaliy described as HERSEY WOOLSEY ADDITION SUBJ TO RD & ESMT; VAC ST
ACCRUING & LOTS 12 THRU LOT 17 BLK 3, PIN 272923420081, from 11 (Light Industial)
to TN2 (Traditional Neighborhood); and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
January 4, 2007, for the purpose of considering the rezoning petition, and pursuant to
§107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held
on January 12, 2007, and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was
duly published in the official newspaper of the City on January 22, 2007, and notices were
duly mailed to each owner of affected property and property situated wholly or partly within
350 feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on February 7
2007, at which all interested parties were given an opportunity to be heard, the Council
having considered all the facts and recommendations concerning the petition; now,
therefore

property located at 892 Hamiine Ave N, Parcel Identification Number (PIN) 272923420081, legaliy
described as HERSEY WOOLSEYADDITION SUBJ TO RD & ESMT; VAC STACCRUING & LOTS
12 THRU LOT 17 BLK 3; and
WHEREAS, the Zoning Committee ofthe Planning Commission, on January 4, 2007, heid a public
hearing at which ali persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of ' 64.300 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the eudence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the f�llowing findings
of fact:
1. The applicant has purchased this property and would like to convert it to residential use to house
her extended family. Completelyresidential uses are not permitted in the 11 Industrial district.
2. The proposed zoning is consistent with the way this area has developed. The building used to
house offices for Koppers Twin City Coke Co., a heavy industria� use than has been gone for many
years. The`surrounding property has been redeveloped for other, light industrial uses and a
• charter school. The residential development south of Pierce Butler Route has not changed.
Zoning this sizabie parcel to TN2 permits both the present intended residential use of the property
and future potential commercial or limited production and processing uses.
3. The proposed zoning is consistent with the Comprehensive Plan. Land Use Plan policy 5.2.1
supports compatible mixed uses in separate buiidings in close proximity. Objective 5.3 calis for
having a range of housing types and values in every neighborhood of the city. The Hamline
Midway Community Plan (2000) supports life-cycie and affordable housing as well as smoothing
the transitions between industrial, commercial, and residential uses. TN2 zoning is compatible
with these policies.
4. The proposed zoning is compatibie with the light industrial uses to the west, the charter schooi to
the east, and the low density housing to the south.
NOW, THEREFORE, BE IT RESOLVED, that the Saint Paui Pianning Commission recommends to
the City Councii that the application of Nou Vang for a rezoning from 11 (Light Industiai) to TN2
(Traditionai Neighborhood) for property at 892 Hamiine Ave N be approved.

Larry Soderholm reported on planning-related business at the City Council for last week and their
agenda for nea�t week.
IV. PUBLIC HEARING: Arcade Sfreet Small Area Plan
Item from the Neighborhood and C�rrent Planning Committee.
(Penrry Simison, 651/266-6554)
Penny Simison gave the staff report. She explained that planning work for the Arcade Street
Small Area Plan has taken a long time and has been broken into three parts. Rezoning work for
the commercial district was adopted previously. Now additional planning work is ready for the
commercial area as a small area plan for incorporation into the Comprehensive Plan. This is what
the public hearing is on today. She will be doing more analysis of the residential blocks within
the Arcade Street small area plan boundaries and will bring the residential part of the plan to the
•
Planning Commission for acrion later this year. It will probably include some residenrial •
rezonings.
Chair Alton read the rules of procedure for the public heazing and announced that nofice of the
public hearing was published in the Legal Ledger on December 18, 2007.
One person spoke at the heazing:
Ms. Leslie McMurray, 1014 Payne Avenue, Saint Paul, MN 55130. Ms. McMurray spoke on
behalf of the Payne Phalen District Five Planning Council. District Five recommended approval
of the Arcade Siseet Small Area Plan, and thanked the Arcade Street Task Force for its hazd work
and efforts to include a comprehensive community process that invoived businesses, agencies and
residents to shape the future of this important commercial corridor. Ms. McMurray thanked
Chair Kathi Donnelly-Cohen for her leadership in bringing this plan forwazd, and also Penny
Simison for her dedication and professionalism in support of the community engagement process.
She passed out copies of the letter of support from the Payne Phalen District Five Plaunnzg
Council.
MOTTON: Commissioner ponnelly-Cohen moved to close the public hearing but to accept
written testimony until noon today, and to refer the matter back to the Neighborhood and
Current Planning Committee. Commissioner Bellus seconded the morion.

Commissioner Morton stated District 4 recommended modification of the permit with revised
conditions. Eight people spoke in support. One spoke in opposition. The public heazing was
closed. The Zoning Committee's recommends approval of modifying the permit with conditions
on a vote of 7-0.
MOTION: Commissioner Morton moved the Zoning Comminee's recommendation to approve
the »zodification of the permit with revised conditions. The motion carried unanimously on a
voice vofe.
College Pazkine Annual Review Procedure — Discussion and recommendation regarding
procedure for conducting annual review of college parking. (Yang Zhang, 651/266-6659)
Commissioner Morton stated the Zoning Committee recommended approval to forward to the
Planning Commission on avote of 7-0.
MOTION: CommissionerMorton moved the Zoning Committee's recommendation to approve
the changes to the procedure for the annual review of co[Zege parking. The motion carried

Commissioner Morton announced the Zoning Committee Agenda for the 7anuary 18, 2007
meeting.
VL Comprehensive Pla�ning Committee
Commissioner ponnelly-Cohen announced the next meeting of the Comprehensive Plan is
scheduled for January 23, 2007.
Lazry Soderholm repor[ed that Penny Simison and he have briefed four City Council members
about the process the Planning Commission is using to prepare the Comprehensive Plan 2008.
He has appointments to brief two more members.
VII. Neighborhood and Current Planning Committee

VIII. Communications Commission
Larry Soderhoim reported that Luis Pereira and he have been working on the annual report and
that it should be ready for the next Planning Commission meeting on January 26, 2007.

IX. Task Force Reports •
Commissioner Smitten announced the next meeting of the Downtown Cenh Corridor Task
Force will be on Tuesday, January 24, 2007, at 4:30-630 p.m. in the City Hall Anne� 11`� Floor.
The next public open houses with Urban Strategies consultants will be on Febrnary 15 and 16,
2007, location to be announced. Discussion will be on the Final V ision and Development
Strategies. Norices for the open houses notices will be sent out.
Commissioner Porter reported on the UniversiTy Avenue Ceniral Corridor Task Force and said
the next meeting is on January 25, 2007, at 5:00 p.m., at the Central Corridor Resource Center,
1080 UniversiTy Avenue.
Larry Soderholm announced the Como Avenue in St. Anthony Park Task Force is meeting on
January 18, 2007. Commissioner Nelson co-chairs the task force and Commissioner Commers is
a member.

Ford Site Plannine Task Force
Merritt Clapp-Smith, PED's lead planner for the Ford site planning process, gave a brief report on •
the process and timeline. A resolurion for consideration and materials recommending the
appointment of inembers to the Ford Site Planning Task Force were passed out.
MOTION: Commissioner NeLson moved approval of the resolution to establish the Ford Site
Planning Task Force and its members as proposed by ChairAlton. Commissioner ponnelly-
Cohen seconded the motion. The motion carried unanimously on a voice vote.

The meefing was chaired by Commissioner Morton.
Nou Vang - 06-289-537 - Rezoning from 11 (Light Industial) to TN2 (Traditional
Neighborhood), 892 Hamline Ave N, NE corner at Pierce Butler Route
Patricia James presented the staff report with a recommendation of approval for the Rezoning.
Patricia James also stated District 11 made no recommendation, and there were no letters in
support, and no letters in opposition.
Toua Xiong, representing his wife, the applicant, stated he would answer questions and he
wants to house his extended family in the building.
• At the question of CommissionerAlton, Mr. Xiong stated he would be using the whole building
for his extended family.
No one spoke in support or opposition.
The public hearing was ciosed.
Upon question of Commissioner Alton, Ms. James stated the residential use would more likely
to be affected by nearby the industrial uses than the reverse, and that fhe orientation of the
building separates it from the more industrial uses to the east. She also stated a singie family
home does not require a certificate of occupancy and there will be no separate units in the
building. If, in the future, the owner wanted to create additional units in the building, or use it for
a rooming house, building permits would alert the City to this change, and the buiiding owner
wouid be required to get all required approvals, including a certificate of occupancy.
Commissioner George Johnson moved approval of the Rezoning. Commissioner Carole Faricy
seconded the motion.
After further discussion the motion passed by a vote of 7-0-0.

Piease consider the problems in rezoning this property. We aiready have a
problem with traffic on Pierce Butler due to its use as a truck route which
is what it was intended for, to alleviate this kind of traffic on University
and other streets. Starting the charter schooi across the street has
already caused more of a safety problem there. I have witnessed many
accidents on this corner myself and believe if you really insist on changing
the zoning then a traffic light should be installed to help with the safety
of any new residents and the school that is already present. This does
somewhat defeat the truck route purpose in slowing it down.....

to house offices for Koppers Twin City Coke Co., a heavy industrial use than has been gone
for many years. The surrounding property has been redeveloped for other, light industrial
uses and a charter school. The residential development south of Pierce Butler Route has not
changed. Zoning this sizable parcel to TN2 permits both the present intended residential use
of the property and future potential commercial or limited production and processing uses.
3. The proposed zoning is consistent with the Comprehensive Pian. Land Use Plan policy 5.2.1
supports compatible mixed uses in separate buildings in close proximity. Objective 5.3 calls
for having a range of housing types and vaiues in every neighborhood of the city. The
Hamline Midway Community Pian (2000) supports life-cycle and affordable housing as well
as smoothing the transitions between industrial, commercial, and residential uses. TN2
zoning is compatible with these policies.
4. The proposed zoning is compatible with the light industrial uses to the west, the charter
school to the east, and the low density housing to the south.
STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of the
rezoning from 11 (Light Industial) to TN2 (Traditional Neighborhood).

2. I make this Affidavit based on personal l�owledge of the property and current
family needs. .

5. This property is currentlq being used as an office building. It is located on the
corners of Hamliue Ave North and Pierce Butler Route.
6. Prior to owning this building I have worked with the previous owner, Hamline
Court, LLC or Kou Vang which he is a friend of mine. I have been discussing
about p�chasing this building for the last year a balf with him. I know Kou
was having a tough time reirting office spaces in the building and I believe it was
so due to the fact that it is located too isolated from the main traflic flows.
7. Currently, there are a couple of tenants in the building but they aze paying low
rents vs other areas such as University Ave.
8. Bq looking from the outside, the property looks like a big house with six car
garages, not an offce building. I ha�e resided in this neighborhood since 1989 I
never realized it was an office build'u�g, not a residence, until Kou owned it.
9. I wish to apply for a property rezoning for this properiy from an Il to. TN2.
I0. If zo ning is approved, I intend to oCCUpy this property as my main residence to
meet my fanuly's needs. Currently, there aze 11 famiTy members in my family
and the family members are: me and my husband, five children (ages 22, 20, 19,
12, & 10), my brother in-law and his wife, and my parents.
