THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1
That the following Sea 87 of the Saint Paul Legislarive Code is hereby amended as follows:
Chapter 87. Water Code-Water Service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(a) Inrtallation. The properry owner or agent must distinctly stake, and mark, the point on the
property line where the street service connection is to enter the premises. Water sexvice connecrions shall
be installed in accardance with water utility standards. The point where the sh service connecrion is to
enter the property must be distinctly marked, by a stake, by the owner or agent before the street service
connection is installed, and said stake shall be marked "water" and shall be no closer to the house drain
location than ten (10) feet horizontally.
(b) Limits of installation and maintenance. The water utility shall install all street service connections
from eacisting street mains to the properry line, and shall maintain them in the manner provided in sections
87.03(e) and 89.10.

When a hole in the building wall is required, such hole and approved sleeve shall be provided by the
owner.
� When the buildine is on the nropertu line, the owner must provide access to the water utilitv, at
reasonable tnnes and upon reasonable notice for installation or maintenance pursuant to this chapter
Failure to nrovide such access shall be deemed a violarion of this code and subject to penalties includine
shutoff, in accordance with the orovisions of Chaptex 91.
3� When the building is located back from the properry line and the service is continued underground
beyond the point where the work is �eae nerformed by the water utIlity, such service shall be installed by a
plumber licensed by the City of Saint Paul and shall be subject to inspection by the water utility. Testing
and flushing of undergound pipmg shall be done by the property owner or developer at the exoense of the
properry owner� or developer�-e�se. In certain situations, as described in the most recent revision of
the water utility standards for the installation of water mains, street service connections may be installed by
contractors in conjunction with conh street mains.
� The balance of the water service connecrion or fire service connection between the properry line
and the metex shall be installed and at all times maintained by the owner. Certain obstacles such as trees,
utilities, retaining walls and other obstructions may make it advisable for the owner or the owner's plumber
to install a replacement water service connection from the meter to the stop valve in the boulevazd. Such an
installauon may be authorized by the water utility i� after review by the utIlity, it is deemed to be in the
best interests of both parties. Service connection piping insraiiea�yme ownerspiumoer�enveen tue -—
property line and ffie stop valve in the boulevazd with water utility approval shall be guazanteed as if it has
been installed by the water utility.

Sec. 8Z13. Cost and payment of street service connections.
(a) Street service connecrions shall be installed by the utility after a contract has been executed. All
street service connecrions shall be installed based on actual cost, including labor, equipment, materials and
overhead, except for those �ist€� addressed in secrions 87.14. ^�a�.T'.".
(b) The council may order street service connecrions made to vacant property and to occupied
properry not presently serviced by city water in advance of any pavement to be laid on the street. The cost
of such street service connection shall be at the rates or actual costs as provided in this chapter and paid
for through assessment against benefited properties upon completion of the work.
(c) Unless installed under provisions of paragraph (b), payment shall be made ox arranged for prior to
installation. Payment shall be at the rate in effect at the time payment is made, and shall include payment
for meter setting costs in accordance with the provisions of Chapter 88.
Sec. 87.14. Charges for street service connections, taos and related work.
(a) Char¢es for 1-inch street service connections and all taps shall be approved by city council
resolution based on the recommendation of the boazd of water commissioners. at the same time
and in the same manner as water chaz¢es, as described in Section 85.01.

(b) One-inch street seroice connections and all taps in the following cate¢ories aze excluded from the
charees approved bv citv council resolution and shall be chazeed actual cost in accordance with section
87.13:
�. � All connections in the downtown area. The downtown azea shall be defined as follows: An area
bounded by and including University Avenue on the north, Lafayette Road and State Trunk
Highway 3 on the east, Shepazd and Warner Roads on the south and Chestnut Street to Swnmit
Avenue to John Ireland Boulevazd to Rice Street on the west.

That the following Sec. 88.07 of the Saint Paul Legislative Code is hereby amended as follows:
Chapter88. WaterCode—Meters
Sec. 85.07. Cost of setting.
The chazee for the first meter settine followine the installation of the street service connection for
domestic and couunercial accounts shall be the actual cost of the water meter. T'�° �-^�-�,:-a �t��-�a�
°'�°"��. For all other metering systems set, and for all meters changed and reset at the request
of the consumer or owner, a charge equal to the current tum-on service chazge shall be paid for each meter
not exceeding one (1) inch in size. Fox each meter one-and-one-half (1 1/2) inches in size or larger, the
actual cost of installation shall be charged.

That the following Sec. 89.19 of the Saint Paul Legislafive Code is hereby amended as follows:

That the following Sec. 90.08 of the Saint Paul Legislarive Code is hereby amended as follows:
Chapter 90. Water Code—Fire Hydrants
Sec. 90.08. Dlegal use of hydrants.
Except for use by personnel of the fire department and water utility, hydrants may only be used by
pernut issued by the utility, and all water taken from a hydrant must be metered. Anyone found using water
from a hydrant without having first obtained a proper permit shall be subj ect to the following:
(�-} 1. A Y�ree-§x�ed- one thousand dollaz $1 000 fine.
(Z� 2. Water utility will confiscate any and all hydrant nozzle adaptors and appurtenances and such
confiscated adaptors and appurtenances will become the property of the water utility.
This secrion shall also apply to unmetered private hydrants.

That the following Sec. 9122 of the Saint Paul Legislative Code is hereby amended as follows:
Chapter 91. Water Code—Miscellaneous Provisions

fee required, except that such time limit shall be exclusive of holidays and Sundays. If such plumber,
person, firm or corporarion fails to take out such permit more than three (3) times in any calendaz year,
such plumber, person, firm or corporation shall be guIlty of a misdemeanor and subject to a fine of one

provisions of this Code, *.he �,��,��,ertificate covering such plumber in plumbing acrivities shall be
revoked.
Sec. 92.07. Plumber's license; pinmbing on one's own premises.
(a) No person, firm or corporation shall engage in or work at the business of plumbing, as herein
defined, either as a master or as a joumeyman plumber, without first having received a certificate of
competency from the boazd of examiners of the City of Saint Paul and a license from the State of
Minnesota.
(b) Anyone not so licensed and certified may do plumbing work which complies with the provisions
of this code and the rules and regulations of the water utility on premises ar that part of premises owned
and actually occupied by that person as a primary residence.
Sec. 92.08. License not transferable.
(a) A master plumber's certificate and license o- °°�,�a�,�a.e-�°°*° is not transferable, and the right of any
firm or corporation to do business under said certificate e� and license depends upon the retention, as an
active member or officer, of the holder of the certificate and license under which they aze authorized to do
business. Hence, if a member of a partnerslup who is the holder of a certificate and license under which the
firm does business, or the officer of a corporation holding a certificate and license under which the firm
does business, for any reason severs his connection or for any other reason is no longer connected with
such fum or corporation, such fum or corporafion is automatically in violation of this chapter until a new
certificate and license is secured.
(b) Any master plumber taking out permits in his or her name for the use of any other person, firm or
corporarion, or employing anyone to do plumbing work who does not have a journeyman's certificate, shall
be guilty of violation of this chaptex.
Sec. 92.12. Inspection.
(a) The board will cause all wark reported to be inspected. The plumber or person doing work on
their own residence will be notified of any work which has not been done in accordance with the water
code, and they will be required to remedy the same.
(b) In all new installarions, the plumber must leave the work exposed until such time as an inspection
has been made and the work approved. This includes all exterior service pipe, which must be inspected
before back filling the trench, and all ��°�� interior piping which must be inspected and tagged
"approved" by the inspector after it has been roughed in and before it is covered over or concealed in the
floors or partitions. The plumber shall give due and sufficient notice when inspection is desired, and shall
call for inspection only when the work is in proper condition and stage of completion.
(c) Water will not be tumed on until after the report of such an inspection has been made and the
wark accepted as sarisfactory.
Sec. 9213. Plumber not to shut off or turn on water.
No plumber or other person shall turn on or shut off the water supply at any stop cock at the main or in
the boulevazd, or allow any person in the plumber's employ to do so, nor shall the plumber have in

Sec. 9215. Cross connection controL
(a) If, in the jud�nent of the water utility, an approved backflow prevention assembly is required for
the safety of the water system, the water uulity shall give notice to said customer to install such an
approved backflow prevention assembly(ies) at specific location(s) on the customer's premises. The
customer shall unmediately install such approved assembly(ies) at customer's own expense; and failure,
refusal or inability on the part of the customex to install, have tested and maintain said assembly(ies) shall
constitute gounds for discontinuing water service to the premises until such requirements have been
safisfactorily met.
(b) The customer's system sheui� shall be open for inspection at all reasonable times to authorized
representatives of the water utility to determine whether cross connec6ons or other structural or sanitary
hazards, including violafions of these regulations, exist.
(c) In the case of premises having (1) intemal cross coanections that cannot be permanently corrected
and controlled, or (2) inhicate plumbing and piping an�angements or where enhy to all portions of the
premises is not readily accessible for inspection purposes, making it impracticable ox impossible to
ascertain whether or not dangerous cross connec6ons e�st, the public water system shall be protected
against backflow from the premises by installing an approved bacl�low prevenrion assembly in the service
line.
(d) In the case of any premises where, because of security requirements or other prohibitions or
resirictions, it is impossible or impractical to make a complete in-plant cross connection survey, the public
water system shall be protected against backflow from the premises by either an approved air-gap
separarion or an approved reduced pressure principle bacl�low prevention assembly on each service to the
premises.

That the following section 94 of the Saint Paul Legislative Code is hereby amended as follows:
Chapter 94. Water Code—Interior Work
Sec. 94.18. Backflow preventers.
Installation, maintenance and testing of backflow preventers shall be according to the State of
Minnesota Plumbing Code. Annual testing of reduced pressure zone bacl�low preventers is required. Upon
receipt of notice for annual tesring from the water utility, properry owners shall have thirty (30) days in
which to have backflow preventer testing accomplished by a licensed plumber with backflow testing
certification or by permanent noncontract staff who possess backflow testing certification and aze registered
with the water utiliTy. Test results shall be furnished to the utility. The utility's annual fee for administering
the backflow preventer testing program shall be as follows:

REPORT ON PROPOSED WATER CODE CHANGES
October 10, 2007
The Boazd of Water Commissioners desires a number of changes to certain sections of the Legislative
Code commonly referred to as the Water Code.
Substantive changes:
Fines aze raised to $1,000 for:
a) illegal use of hydrants (90.08)
b) failing to obtain a plumbing permit for the third time in any calendar year
(92.06) and
c) turn-on or shut-ofFof water supply (92.13)
2. Customer to pay actual cost of the first water meter (88.07)
3. Removing charges for one-inch street service connections, all taps and related work
from the Water Code (87.14 and 87.5). Instead, these charges would be established in
the same manner as water rates (per 85A1 (c).

between the property line and the stop valve in the boulevazd with water utility approval
shall be guaranteed as if it has been installed by the water utility.

90. Water Code—Fire Hydrants
Sec. 90.08. IDegal use of hydrants.
Except for use by personnel of the fire department and water uriliry, hydrants may only
be used by permit issued by the utility, and all water taken from a hydrant must be
metered. Anyone found using water from a hydrant without having first obtained a proper
permit shall be subject to the following:

Sec. 92.07. Plnmber's license; plumbing on one's own premises.
(a) No person, firm or corporarion shall engage in or work at the business of
plumbing, as herein defined, either as a master or as a journeyman plumber, without first
having received a certificate of competency from the boazd of examiners of the City of
Saint Paul and a license from the State of Minnesota.
(b) Anyone not so licensed and certified may do plumbing work which complies
with the provisions of this code and the rules and regulations of the water utiliry on
premises or Yhat part of premises owned and actually occupied by that person as a prunary
residence.

Sec. 92.08. License not transferable.
(a) A master plumber's certificate and license ^- °°-'��,�r°°'° is not transferable, and
the right of any firm or corporation to do business under said certificate e� and license
depends upon the retention, as an active member or officer, of the holder of the certificate
and license under which they are authorized to do business. Hence, if a member of a
parmership who is the holder of a certificate and license under which the firm does
business, or the officer of a corporation holding a certificate and license under which the
fum does business, for any reason severs his connection or for any other reason is no
longer connected with such firm or corporation, such firm or corporation is automatically
in violation of this chapter until a new certificate and license is secured.
(b) Any master plumber taking out permits in his or her name for the use of any other
person, firm or corporarion, or employing anyone to do plumbing work who does not have
a j ourneyman's certificate, shall be guilry of violation of this chapter.

Sec. 92.12. InspeMion.
(a) The boazd wili cause all work reported to be inspected. The plumber or person
doing work on their own residence will be notified of any work which has not been done
in accordance with the water code, and they will be required to remedy the same.
(b) In all new installations, the plumber must leave the work exposed until such time
as an inspection has been made and the work approved. This includes all exterior service
pipe, which must be inspected before back filling the trench, and all ex-te�ie� interior
piping which must be inspected and tagged "approved" by the inspector after it has been
roughed in and before it is covered over or concealed in the floors or partitions. The
pluxnber shall give due and sufficient notice when inspection is desired, and shall call for
inspection only when the work is in proper condiuon and stage of completion.
(c) Water will not be turned on until after the repoxt of such an inspection has been
made and the work accepted as satisfactory.

Sec. 92.13. Plumber not to shut off or turn on water.
No plumber or other person shall turn on or shut off the water supply at any stop cock
at the main or in the boulevard, or allow any person in the plumber's employ to do so, nor

Sec. 92.15. Cross connecfion control.
(a) If, in the judgment of the water utility, an approved backflow prevention
assembly is required for the safety of the water system, the water utility shall give norice
to said customer to install such an approved backflow prevenrion assembly(ies) at specific
location(s) on the customer's premises. The customer shall immediately install such
approved assembly(ies) at customer's own expense; and failure, refusal or inability on the
part of the customer to install, have tested and maintain said assembly(ies) shall constitute
grounds for discontinuing water service to the premises until such requirements have been
satisfactorily met.
(b) The customer's system sliexl� shall be open for inspection at all reasonable times
to authorized representauves of the water utility to determine whether cross connections or
other structural or sanitary hazazds, including violafions of these regulations, exist.
(c) In the case of premises having (1) intemal cross connecrions that cannot be
permanently corrected and controlled, or (2) intricate plumbing and piping arrangements
or where enhy to all portions of the premises is not readily accessible for inspection
purposes, making it impncticable or impossible to ascertain whether or not dangerous
cross connections exist, the public water system shall be protected against backflow from
the premises by installing an approved backflow prevention assembly in the service line.
(d) In the case of any premises where, because of security requirements or other
prohibitions or reslrictions, it is impossible or impractical to make a complete in-plant
cross connecrion survey, the public water system shall be protected against backflow from
the premises by either an approved air-gap sepazation or an approved reduced pressure
principle backflow prevention assembly on each service to the premises.

Chapter 94. Water Code—Tnterior Work
Sec. 94.18. Backflow preventers.
Installation, maintenance and testing of backflow preventers shall be according to the
State of Minnesota Plumbing Code. Annual testing of reduced pressure zone backflow
preventers is required. Upon receipt of nouce for annual testing from the water utility,
property owners shall have thirty (30) days in which to have backflow preventer testing
accomplished by a licensed plumber with backflow testing certification or by permanent
noncontract staff who possess backflow testing certification and aze registered with the
water urility. Test results shall be fiunished to the utility. The urility's annual fee for
administering the backflow preventer testing progrun shall be as follows:

WfIEREAS, Board of Water Commissioners staff recommends that Chapters 87, 88, 89, 90, 91, 92
and 94 of the Saint Paul I.egislative Code of the City of Saint Paul ("Code") be amended to provide
changes in fines, schedule charges and miscellaneous housekeeping; and
WHEREAS, Board's staff has prepared a City of Saint Paul Ordinance ("Ordinance"), wluch
provides such changes, copy of the Ordinance being attached hereto and incorporated herein; and
WHEREAS, the assistant city attomey has reviewed and approved the Ordinance as to form, and
Saint Paul Regional Water Services General Manager recommends approval of the Ordinance; now,
therefore, be it
RESOLVED, that the Board of Water Commissioners does hereby approve the attached Ordinance
amending Chapters 87, 88, 89, 90, 91, 92 and 94 of the Saint Paul Legislative Code; and, be it
FURTHER RESOLVED, that the Board of Water Commissioners does hereby request that the
Honorable Council of the City of Saint Paul approve and adopt said Ordinance.
