06-425Council File # Q(p — �{� �S Green Sheet # , 3n.3'Ot�,� _�����— ORDINANCE ; c�T�{, Presented by �.-- ��' MINNESOTA t AN ORDINANCE AMENDING CHAPTER 60 OF THE SAINT PAUL LEGISLATIVE CODE 2 PERTAINING TO ZONING FOR THE CITY OF SAINT PAUL WITH CHANGES FOR THE 3 LOEB LAKE AREA ZOIVING MAPS a� 5 WHEREAS, the City Council is authorized under Minnesota Statutes Section 462357 and Section 64.400 6 of the Legislative Code to adopt the suuunary of the Loeb Lake Small Area Plan as an addendum to the 7 Comprehensive Plan and to adopt zone changes implementing the Plan summary; and 9 WHEREAS, the Planning Commission initiated a 40-Acre Study in February 2005, for the purposed of lo considering amendments to the Saint Paul Legislative Code pertaining to the Loeb Lake/Maryland and I t Dale area; and 12 13 WHEREAS, the Planning Commission held a public hearing on the Loeb Lake Small Area Plan sumxnary 14 and 40-Acre Study on Mazch 10, 2006, notice of which was duly mailed to all affected property owners 15 and was duly given in the Saint Paul Pioneer Press on February 17, 24, and March 3, 2006; and 16 17 WHEREAS, after consideration of the public testimony and the recommendations of the City staff, the 18 Planning Commission on Apri17, 2005, recommended approval of the rezoning as proposed in the 40-Acre 19 Study with amendments; and 20 21 WHEREAS, notice of a public hearing before the City Council on Loeb Lake area zoning proposals was 22 duly mailed to all property owners in the study area and was duly published in the official newspaper of the 23 City on a�/,�.�; and 24 25 WHEREAS, a public hearing before the City Council having been conducted on May 17, 2006, at which 26 all interested parties were given an opportunity to be heard, the Council having considered all the facts and 27 recommendations concerning the Loeb Lake azea zoning proposals; NOW THEREFORE 28 29 THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: 30 31 32 Section 1. 33 The Council of the City of Saint Paul does hereby amend the Saint Paul Zoning Ordinance by amending 34 the zoning classifications for the following properties on the zoning maps of the City of Saint Paul, Sheets 35 No. 4 and 12, as incorporated by reference in Section 60301 of the Saint Paul Legislative Code: 36 37 38 39 40 41 42 �t1��5���3 _,, . k:.
