An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462.357 and §61.800 of the Legisiative Code, J& A
Properties, in Zoning File 05-063-464, duly petitioned to rezone 619 and 625 Snelling being legally
described as ROSSMAN ADDITION LOTS 2 AND 3 BLK 2(PIN 33-29-23-11-0074; 33-29-23-11-
0073), rezoning from 62 Community Business to TN2 Traditional Neighborhood; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on March 3,
2005, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the
Administrative Code, submitted its recommendation to the Planning Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on March
11, 2005, and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly
pubiished in the official newspaper of the City on February 24, 2005, and notices were duly mailed to
each owner of affected property and property situated wholly or partly within 350 feet of the property
sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on , at which ail interested
parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations concerning the petition; now, therefore -
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

W HEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zoning Committee at the
public hearing as substantiafly reflected in the minutes, made the following findings of fact:
1. J& A Properties would like to sell the 619 and 625 Snelling to John Ho and has requested a zoning change
from B2 (Community Business) to TN2 (Traditional Neighborhood). John Ho will redevelop 625 Snelling into a
mixed use residential and Commercial building and convert the five unit residential building at 619 Snelling into
a residentiai dupiex.
2. The proposed zoning is consistent and compatible with the way the area was developed. Many of the buildings
around these two properties are currently being used for residential and mixed commercial - residential.
3. The proposed zoning is consistent with the character of development in the neighborhood and will not be
de4rimental. Under TN zoning, the existing legai nonconforming residence at 619 Sneiling wouid be a
conforming use.
� . The proposed redevelopment is consistent with the comprehensive plan. The comprehensive plan supports
mixed use development within singie buiidings and in separate buildings in close proximiry (1=Land Use Plan

Emily Ulmer presented the revised staff report with a recommendation of approval for the Rezoning. Emily
Ulmer aiso stated District 11 recommends approval, and there was 1 letter(s) in support, and 0 letter(s) in
opposition.
At the question of Commissioner Mejia, Ms. Ulmer stated there were no commercial uses on the block.
At the question of Commissioner Kramer, Mr. Torstenson gave a history of the neighborhood and explained
�y rezoning was the best choice for the property.
John Ho, the applicant, stated he would answer questions.
Upon the question of Commissioner Kramer, Mr. Ho. stated that a real estate office would be a part of the
buiiding.
No one spoke in support or opposition.
The public hearing was ciosed.
Commissioner Carole Faricy moved approval of the Rezoning. Commissioner Richard Kramer seconded the
motion.

Cleaning performed during construction is subject to prevailing wage provisions. In the absence
of a specific wage rate for cieaning classifrcation, the cleaners must be paid the predetermined
wage rate for laborers.
Cleanin� (after complefion of construction and certificate of occupzncy has been issued) in order
to prepare the premises for occupancy which is not part of the construction contract is not subject

RELATIVES
There are no exceptions made in the enforcement on the basis of family relationslup for
relatives who are performing the work of laborers or mechanics (anyone who is perfonning
construction work on the project). They must be paid the prevailing wage rate for the
classification of work performed and be included on the certified payrolls.

4. Chuck Repke, 165 McBoal, Saint Paul, MN. Mr. Repke stated that he was the co-chair of �
ffie Planning Commission's Community Residential Faciiities Task Force in 1989, and the
staff person to the City Council member who authored those changes in 1991. He is very
disappointed to see the City considering radically changing the Zoning Code to
accommodate the appazent needs of one social service provider. He is also very feazful of
the long-range consequences of the zoning amendments the Commission is considering
today. He feels this is a proposal drafted by staff, with limited community inpat, to
dramatically change the code, potenrially impacting the enfire city, in order to accommodate
the needs of one service provider. He also suggested looldng at the possibility of
categorizing the long-term homeless units as a hotel rather than a roommg house, which
could then be licensed by the City.
MOTION: Commissioner Morton moved to forw¢rd this to the Zoning Committee meeting on
March I7, 2005. Commissioner Anfang seconded the motion. The motion carried
unanimously on a voice vote.
MOTION: Commissioner Trevino moved to close the public hearing and accept additionol
writterz testimony untzZ 4:30 p.m., today, March II, 2005. Commissioner porsaeIIy-Cohen

. ZONING CODE CITATION: 66.321 lists uses permitted in TN2 districts; §61.801(b) provides for
changes to the zoning of property initiated by the property owner.
F.HIS70RYiDISCUSSION: In 1916, the property at 619 Snelling Avenue, was built as a single family
home with 1,388 square feet of tiving asea. The property was divided into five small apartments (in fhe
1970s or 1980s), a nonconforming use in the B2 zone. In 1995, Northern Lights Real Estate, the
owner of the property at 619 Snelfing Avenue, applied for a nonconforming use permit (zoning file
#95-010) to establish legal nonconforming status for continued use of the five unit property. The
change in nonconforming use application was approved with the conditon that the permit would expire
upon the safe of the proprty. Now J& A Properties (owned by Allen Peterson who also owns Northern
Lights Real Estate) is selling the property to John Ho, at which fime the nonconforming use permit that
a{4ows continued use of the building for five apartment units will expire.
In January of 2Q05, the building located at 625 Snelling was granted a variance (zoning file #04-
214828) that ailowed the applicant to remodel the building and use approximately 35 percent of the
first floor for commercial use rafher than the required 50 percent.
G. DISTRICT COUNCIL RECOMMENDATION: The District 11 Land Use Committee met on March
2•, 2005, and voted to support rezoning with the understanding that this may not be the most
appropriate long term zoning for this biock face and they will be exploring other zoning options
along the Snelling corridor.
H. FINDINGS:
1. J& A Properties and John Ho have requested a zoning change from 62 (Community
Business) to (Traditional Neighborhood). The owner of these properties would like to
• develop 625 Snelling into a mixed use residential and commerciai building and convert the five
unit residentiai building at 619 Sneiling into a residential duplex.
2. The proposed zoning is consistent and compatable with the way the area has developed.

3. The proposed rezoning to TN2 is consistent with the character of development in the
neighborhood and will not be detrimental. Under TN zoning, the existing legat nonconforming

consistent with the comprehensive plan. The comprehensive pian supports mixed use

Plan policy 5.2.1). Traditional Neighborhood or TN zoning is intended to foster compact growth
and development, encourage a compatible mix of commercial and residentiai uses within
buildings, sites and biocks, and provide additional housing�choices. (68.300 Saint Paul Zoning
Code).
STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of the
rezoning of 619-625 Snelling from 62 (Community Business) to TN2 (Traditional Neighborhood}.

Thank you for your call concerning the rezoning of 619/625 North Snelling.
As we mentioned last night in the Community Meeting on this issue Hamline Midway Coalition
(District I i} will not oppose this request. We do not want to prevent the applicant, Mr. John Ho, from
proceeding ahead with his renovation and use of 619 and 625 No. Snelling. We appreciate Mr. Ho's
commitment to the neighborhood and financial investment to improve two problem properties on
Snelling Avenue.
� However, Hamline Midway Coalition wants to note that we disagree with the process that resulted in
this request for rezoning just two properties o.n a block with a total of seven properties, all of them
currently residential uses within the B2 zoning. In effect, this looks like "spot zoniag" and it did no:
adequately include community participation or participation by the adjacent property owners.
Hamline Midway Coalition intends to return to the Planning Commission to request a land use and
zoning study of this entire block with related public meetings and properiy owner involvement to look at
rezoning the entire block. This rezoning could include a request for even more restrictive zoning than
the proposed TN2.

First, welcome to PED, Emily. I look forward to working with you as projects come up. And, Ailan, I can't even
imagine how much work went into drafting and sorting through all the feedback on the TN zoning classification.
Last night was really the firsY time ! wrestled with it and began to get a littte understanding of the new options it
gives us and the increased responsiveness it provides to community and development concems. Good work!
Second, 1 want to express my appreciation for how each of you handled a somewhat charged and even emotional
meeting. Whenever i deal with some of the folks that attended last nighYs meeting I feel like i am dealing with
people who know the zoning code and process better than I ever wifl and maybe better than most Zoning
Committee and Planning Commission members do.
At the same time last night we had people attending the meeting who clearly had never dealt with zoning issues
before. Yoar responses were clear, you reaity listened and I appreciated your wiilingness to retum to PED and
look at these issues in terms of other options. That meeting could have blown up into a shouting match and it
didn't primarily because each of you listened, laid out the facts and didn't get defensive or react to some of the
sharper, bordering on inappropriate, comments made by some of those who attended. Thanks very much! I look
forvvard to continuing to work with both of you into the future as we deal with 619/625 No Snelling and other
zoning and developmenf questions.
Let me know what you find out about 619l625 this moming. Please leave a message on my voice mail if I am not
here. i will check often.
I copied this to Susan because PED makes such an easy target so often in community meetings and at business
meetings. As i watched your work last night I promised myself I would let Susan know what great work was being
done for PED in the basement of community buildings as neighbors struggle with change and find allies in PED
staff.

Planning Administrator's Announcements
Larry Soderholm reported on City Council business for last week and announced their agenda for
next week.
Mr. Soderholm announced that at this week's City Council meeting new appointments were made
to the Planning Commission. The new Commission appointees aze Reggie Aligada, 7im Bellus,
and Erick Goodlow. The following Commissioners have been reappointed for three more yeazs to
2008: Lawrence Dandrea, Kathi Donnelly-Cohen, Susan McCall, Marilyn Porter, and Marlyn
Trevino.
Mr. Soderholm asked Commissioner Morton, who also serves on the Board of Zoning Appeals, tc
• update the Commission on pazldng for LaGxolla Restaurant on Selby Avenue. Commissioner
Morton explained that sinee the Commission denied the restauranYs application (which was for a
site plan with access to their parking lot from the alley that is mostly used by residents) the two

. 4. Chuck Repke, 165 McBoa1, Saint Paui, NLN. Mr. Repke stated that he was the co-chair of
the Planning Commission's Com Residential Faciuties Task Force in 1989, and the
staii person to the City Council member who authored those changes in 1991. He is cery
disanpoinrEd to see the City considering radically changing the Zoning Code to
accommodate the appazent needs of one social service provider. He is also very fearful of
the long-range consequences of the zoning amendments the Commission is considering
today. He feels this is a proposal drafted by staff, with limiL°d community i�ut, to
dramaticaliy change the code, potenrially impaciing the entire city, in order to accommodate
the needs of one service provider. He also suggested looking at the possibiiity of
categorizing the long-term homeless units as a hotel rather than a roomina house, which
could then be licensed by the City.
MOTION: Commissioner Morton moved to forward this to the Zoning Committee meeting on
March Z7, 2005. Commisszoner tlnfang seconded the motion. The moiion carried
unanimously on a voice vote.
MOTION: Commissioner Trevino moved to close the public hearing ¢nd accept additionnl
written testimony. unizT 4:30 p.m., today, March II, 2005. Commissioner ponneIIy-Cohen
seconded the motion. The motion carried unanimously on voice vote..

Commissioner Morton gave the Zoning Committee report.
