05-263Council File # � 0��� Ordinance # Green sheet # 3025568 ORDINANCE OF SAINT PAUL, MINNESOTA � Presented By Referred To Committee: Date 2 0 THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: � Section 1 10 11 12 13 14 15 16 17 18 An interim ordinance adopted pursuant to Minnesota Statute 462355, Subd. 4, preserving the status quo with respect to the use of properiy in the eastern section of the Phalen Corridor. � �( g 6 '05 Statement of legislative intent: The City's 19991and use component of the Comprehensive Plan calls for refining corridor planning studies to insure that any amendments to the zoning code resulting from conidor studies conform with the Comprehensive Plan. Studies of various City corridors have recently taken place in keeping with the City's strong tradition of corridor planning. In 1999 and 2000, the Planning Commission coordinated a planning study for the Phalen Corridor, resulting in the Phalen Corridor Development Strategy, which was adopted by the City Council on Apri14, 2001. The Planning Commission and the City Council also reviewed and adopted the amendments to the PhaZen Corridor Development Strategy for the Westminster Junction and Middle Section areas of the Corridor. 19 Plans for these areas were prepared as construction of Phalen Boulevard proceeded, so that controls over land 20 contemplated for development would be in place once road construction was completed. 21 22 23 24 25 26 27 28 29 30 31 32 33 Work is now proceeding for conshuction of the third segment of Phalen Boulevard, between Arcade Street and Johnson Pazkway. Work is also underway on a planning studies and zoning recommendations for the eastern portion of the Corridor, between Earl Street and Johnson Parkway, and for the Middle Section South area, south of Phalen Boulevard and west of Arcade Street. Pending the completion of the planning study and the Planning Commission's recommendations to amend the City's Comprehensive Plan and Zoning Code and the City Council's adoption of such recommendations, and for t}�e overall purpose of protecting the City's planning process, a moratorium of ]imited duration must be enacted for the purpose of prohibiting developments which may be inconsistent with comprehensive plan development and zoning code objectives for the eastern portion of the Phalen Corridor: �� �� Section 2 34 � �3 ���� 35 1Vloratorium imposed; lands affected: Pending completion of said study and any other necessary studies or 36 study recommendations, and the adoption of any amendments to the Comprehensive Plan and Zoning Code 37 based upon the study or studies, as provided under Minn. Stat. 462355, Subd. (4), the issuance of approvals 38 for plats, lot splits or building and zoning permits for any parcel of land or part thereof within the area of the 39 eastern portion of the Phalen Corridor, as set forth below, shall be prohibited for a period of time not to 40 exceed twelve (12) months from the effective date of this ordinance. Until such time as said study has been 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 completed and the Council has reviewed its recommendations for possible adoption, city departments 45�°��� receiving written applications for the approvals noted above shall accept the applications and immediately process them in accordance with the provisions of Minn. Stat. 15.99, Subd 2 and with the intent of this interim ordinance. The lands affected by this interun ordinance sha11 be within the following boundary: From the intersection of Eazl Street and East'1"' StreeY north to York Avenue, from York east to Frank Street, from Frank north to Case Avenue, from Case east to the eastern boundary of the Duluth Playground and thence northeasterly along the eastem boundary of the Duluth Playground and extending northeasterly to Magnolia Lane, northeasterly along Magnolia Lane to Johnson Pazkway, south along Johnson Pazkway to the alley between East Seventh Street and Ross Avenue, west along the alley between East Seventh and Ross to Earl Street, north on Eazl to the point of beginning at East Seventh, as depicted on the attached map which is incorporated herein by reference. Additionally, from the intersection of Minnehaha Avenue and the Bruce Vento Regional Trail, north along the Bruce Vento Regional Trail to Phalen Boulevazd, east along Phalen Boulevazd to Arcade Street, south along Arcade Street to Minnehaha Avenne, west along Minnehaha Avenue to the point of beginning at the Bruce Vento Regional Trail; additionally parcels south of Minnehaha with the following Property Identification Numbers: 322922 1 1 000 1, 322922110002, 322922 1 1 0003, 322922 1 1 0021, 322922 1 1 0022, 3 22922 1 1 0023, 32292211002, as depicted on the attached map which is incorporated herein by reference. 58 59 Section 3 60 61 Moratorium, exemptions: The following are exempted from the moratorium provisions imposed under 62 Section 2: 63 64 1. Building, plumbing, mechanical and electrical permits for repairs or minor alterations to conforming or 65 non-conforming structures, or for work on dangerous or vacant buildings administered under Leg. Code 66 Chapter 43, or for work on single or multi-family residential structures or uses. 67 68 2. 69 70 3. 71 72 73 Demolition permits for nuisance buildings pursuant to Leg. Code Chapter 45. For work on single or multi-family residential structures and instifutional uses on residentially-zoned land.
