WHEREAS, Pursuant to Minnesota Statutes §462.357 and §61.800 of the Legislative Code, Marathon
Ashland Petroleum, in Zoning File # 04-164-232, duly petitioned to rezone 852 and 862 Johnson Pkwy.
be�ng legally described as TRACYS OUTLOTS IN THE TOWNSHIP OF NEW CANADA, RAMSEY
CO., AND STATE OF MINNESOTA LOTS 3 AND 4, BLK 10, PINs 27-29-22-32-0071 and 27-29-22-
32-0070 from RT1 Two-Family Residential to B3 General Business to expand an auto convenience
market, the petition having been certified by the Planning Division on September 23, 2004, as having
been consented to by at least 67 percent of the owners of the area to be rezoned, and further having
been consented to by at least iwo-thirds of the owners of the property situated within 100 feet of the
total contiguous property within one year preceding the date of the petition; and
4VHEREAS, the Zoning Committee of the Planning Commission held a public hearing on October 28,
2004, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the
Administrative Code, submitted its recommendation to the Planning Commission for approval; and

WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly
published in the official newspaper of the City on November 4, 2004, and notices were duly mailed to
each owner of affected property and property situated wholly or partly within 350 feet of the property
sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on November 17, 2004, at
which all interested parties were given an opportunity to be heard, the Council having considered all
the facts and recommendations concerning the petition; now, therefore

W HEREAS, theZoning Conmittee ofthe Pianning Commission, on October28, 2004, held a pubiic nearing
at which ail persons present were given an opportunity to be heard pursuant to said appiication in
accordance with the requirements of §61.303 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee atthe pubfic hearing as substantiailyreflected in the minutes, made the foilowing findings offact:
�. The applicant is purchasing the two residential lots north of the existing Super America to rebuiid and
expand the auto convenience market. The two residential lots are zoned RT1 and require a rezoning to
B3 to match the zoning of the existing business.
Johnson Parkway and E. 7th Street is a commercial node that includes a mortuary and a lumber yard
o�ce. The parkway in this area is also narrowed to the standard street width and thus loses much of
its parkway char�cter. The expansion of this business is compatibfe and consis±en! tivith the
deve!opme^t in ,he immedfate area.
The B3 General Business District is intendad for use along major tra�c arteries. Johnson Parkway is
a"B" minor arteriai, and E. 7th Street is a collector street in the Transportation Policy Plan. The genera(
policies of the comprehensive p7an also support ensuring that land resources with potentia! for business
use are made avai(able. The proposed rezoning is consistent with the comprehensive p(an.
The proposed rezoning is consistent with the existing business uses at this intersection. Auto
convenience markets are required to receive a conditional use permit and undergo site plan review,
which shouid ensure that this proposed developmentwill not have an adverse impact on the surrounding
area.
The existing auto convenience market cannot expand without this rezoning. There is an alleyto the wesY
of the existing business, so expansion along E. 7th Streef is not an option and would not be as
appropriate as expansion along a minor arteria! street.
A petition of two-thirds of the property owners within 100 ft. of the proposed rezoning was found to be
su�cient on September 23, 2004: 98 parceis eligible; 12 parce(s required; 12 parcels signed.
NOW, THEREFORE, BE IT f2ESOLVED, that the Saint Paul Planning Commission recommends to City
Council that the application of Marathon Ashland Petroleum for a rezoning from RT1 Two-Family

Larry Soderhoim reported Chazlie Hales, former Portland City Commissioner, will be speaking
on "bringing the streetcars back"at four different events in Saint Paul on November 17-18,
2004.
Mr. Soderholm stated Penny Sunison, PED planner, received an awazd from the Minnesota
Chapter of the American Institute of Architects, saying she has been very active with the
Governor's Design Team, where volunteer planners, azchitects, landscape azchitects, etc., go to
small towns throughout Minnesota to help develop a plan for the town. Ms. Simison has been
one of the leaders of this for the last 4-5 yeazs. Ouc congratulations to Ms. Simison.
Mr. Soderholm reported on Ciry Council business last week and announced the agenda items for
next week that pertain to Commission business.

Upon the question of Commissioner Alton, Ms. James expiained they meet the sign area standards that are permitted in
the zoning district and the approval of the site plan is contingent on the signage being approved by the L(EF staff.
Michael Cronin, representative of the applicant, introduced several people: Derrick Knight of Marathon Ashland, who is
responsible for the construction and design of the store, AI Stewart who works for Speedway Super America and is
responsible for the operation of the store, and Carol Shukhold, in charge of operations. Mr. Knight presented photos of
the development and stated the set back mirrors the set backs across the street, and it is consistent with the sefback of
the neighboring homes. There will be a 26 ft. greenspace rafher than the eight or ten feet that is typical between houses.
He also presented a brief summary of fhe Super America development. He stated when he collected the signatures from
� neighbors, issues were discussed and a number o'them are reflected in the site pian. He also expiained they
nded the fencing, added additional trash receptacles on the bus stop street corner, and agreed that there will be no
phones inside or outside. They are proposing limiting the use of the vacuum irom 7:00 a.m to 10:00 p.m. He also
requested tnai, wiin the conditions applied and wifh the understanding that this gives no rights to the sign package, that
the Zoning Committee recommend approval of the app(ication.
At the question of Commissioner Alton, Mr. Cronin, exp(ained that even with the ice coolers and the propane cage, they
wil! be able ta maintain the required walkway.
Upon question of Commissioner Kramer, Cronin stated that everything on the exterior of the bui(ding will be brick.
Gary Unger, President of District 2 Community Council, stated he was excited wifh the project and requested the Zoning
Committee to recommend approval to the Planning Commission.
Chuck Repke, Executive Director of District 2 Community Council, stated they are in support of the conditions of the staff
report with strong emphasis on the conditiorrs addressing the nuisance type issues which consist of the vacuum cleaner
being off in the evening hours of 10:00 p.m. to 7:00 a.m., no public telephone, and to provide and maintain a trash
receptacle near the bus stop.

2. Johnson Parkway and E. 7th Street is a commercial node that includes a mortuary and a
lumber yard office. The parkway in this area is also narrowed to the standard street width and
thus loses much of its parkway character. The expansion of this business is compatibie and
consistent with the development in the immediate area.
3. The B3 General Business District is intended for use along major traffic arteries. Johnson
Parkway is a"B" minor arterial, and E. 7th Street is a coilector street in the Transportation
Policy Plan. The general policies of the comprehensive plan also support ensuring that land
resources with potential for business use are made available. The proposed rezoning is
consistent with the comprehensive plan.

4. The proposed rezoning is consistent with the existing business uses at this intersection. Auto
convenience markets are required to receive a conditional use permit and undergo site plan
review, whicin should ensure that this proposed development wiil not have an adverse impact
on the surrounding area.
5. The existing auto convenience market cannot expand without this rezoning. There is an alley
to tfie west of the existing business, so expansion along E. 7th Street is not an option and
would not be as appropriate as expansion along a minor arterial sfreet.
6. A petition of twathirds of the property owners within 100 ft. of the proposed rezoning was
found to be sufficient on September 23, 2004: 18 parcels eligible; 12 parcels required; 12

Speedway S¢perAmerica has the opportunity to expand its present store siTe at Johnson Parkway
and East Seventh Street by thz purchase of the ttivo adjacent homzs to our north at 8�2 and 862
Johnson Parkway. City approvals necessary to realize this opportunity ara rezonina of the
residences from RT-i to B-3, approvai of the required Special Conditions Use Permit for the
new store and approval of the requestzd variances to reduce the required setback from the
Parkway from 25 ft to 16.5 ft and reduce the required onsite parkin� from 17 spaces to 13 sgaces,
reco�nizin� the parkina provided atthe pumQ islands.
The proposed plan wili extend the site between Johnsoa Parkway and the al(ey 115 ft north,
doublinQ the area of the present s?ore site from 14,253 sf to 28,680 sf. This !ur�er site wil:
permit us to construct a state of the art store of 3760 �ross square feet. This �vill allow us to
serve our nei�hbors and the community better and more compatibly. The additional site area will
allow us to increase the variery and type of products in our store, improve the the general on site
circulation and the desian of the fuei service, introduce si�nificant landscaped area to the site and
inerease the number of dedicated on site parkin� spaces from 6 to 13. The new store will comply
with all current City perFormance standards, and will incorporate techniques to calm the desisn
and operation of the store which will be recorded and enforced throuah the SCUP process. �
A. The Proposed Site and Buildina Plan
The proposed site plan roates the orientation of the site and moves the canopy, pump islands and
the store deege: ir.ta the site while pullia� the store clos�, io 3ahnson Pa:kway. The footprirt o;
the new store buildina will be an approximately 50 ft by 80 ft rectan�le. The store will have a
�ross floor area of 3760 sf. The exterior wili be brick. The same materials witl be used on aIl
sides of the store and for the walls of the covered trash enclosure. The hip roof will have asphalt
shinales. HVAC equipment will be located at �rade, east of the store buildina and behin3 the
trash enclosure. The new store will be open 24 hours each day.
Four pump dispenser islands, located under a canopy, will provide fuelina for up to 8 vehictes.
The canopy will have a 4 ft metal composite fascia which will be striped. �but not illuminated.
Noise from the speakers at the canopq used for the required communication with customers will
be controlled and miti�ated by the use of fuel dispenser mounted, fueling point specific
microphones and speakers for this required communication. These speakers, located in each fuel
dispenser, are located at the ear level of the customer rather than overhead, and are individua(ly
assigned to each dispenser. This atlows the speakers in the system to be more focused operate
effectively at a lower volume. This type of speaker system was installed at the recently rebuilt
store at Maryland and Arkwri�ht.
The present drive on East Seventh will be relocated approximately 50 ft east, away from the
intersection with Johnson Parkway. No significant chan�e in the location of the drive on Johnson
• Parkway is proposed. Parkin� will be provided in front of the store and extendin� alon� the
buildin� line towards Johnson Parkway. The 13 spaces, includin� the handicapped space,

provide the practically needed parkin� for the store. In addition, the 8 spaces at the pump istands •
will be the most used parking spaces on the site. A loadina area for delivery trucks is provided
alona the west side of the site, over the underaround tanks.
The permitted si�n area for this site is 225 sf. The proposed sian area deseribed on the sheet
"Si�naae Plan Details" wiil be reduced to the permitted sign area by reduction of the area of the
freestandin� sisn.
The site will be illuminated by two freestanding fixtures, one at each drive and the liehting under
the canopy. A third fixture, installed at the request of our neiahbors in the northeast corner of the
site, will illuminate the atley. The present fence alonQ the alley will be extended as an 8 ft tall
board to board wood fence alona the aliey and on our shared property line with our Johnson
Parkway neiahbor, extendin� to the front of their home.
The lardscape plan provides almost 8,000 sf of �reen space, 28% of the site. All landscaped
areas wi!I be irri�ated. A decorative fence with a hedae on the inside, similar to the fence at the
store at Marytand and Arkwriaht, with piers matchin� the zxterior of the store, will be installed
alon� Johnson Parkway and aiona our nei�hbor's front yard to meet the wood fence This fence
will add character to the edae of the site, provide an enclosure and shield for the activity on the
site, and a buffer for pedestrians usin� the sidewalk.
B. Zonin� Amendment
The intersection of East Seventh and Johnson Parkway, a County Hi�hway, is by its tradition, its •
development, and by the plans and regulations of the City part of the recoQnized commercial and
indush district extendina alons the spine of East Seventh. And, the riQht of way of Johnson
Parkway sisnificandy narrows between East Seventh and the raiIroad viaduct to the north,
creatina a two block lona historical exception to the character of the Parkway. The proposed plan
will provide a sia ificant landscaped area at the corner of East Seventh and the Parkway, easina
the transition into this exception to the Parkway character. �Vhile no small area plan has been
prepared for this district, the investment represented by our redevelopment will be consistent
with St. Paul Plan provisions by reinforcina and maintainins into the future the traditional role
this intersection has served in the neighborhood and community. The expansion of our site atono
Johnson Parkway will permit a modern, viable and successful automobile convenience market to
reinforce this commerciaf district.
In addition to reinforcin� the district, the expansion of the tequested B-3 district alona Johnson
Parkway will allow a larger store site which will permit a state of the art store increasin� the
variety and type of products offered, improving the desian of the fuel service and general on site
circulation. The new store will comply with all current City performance standards, and will
incorporate techniques to calm the desi an and operation of the store which will be recorded and
enforced throu�h the SCUP process.
The requested expansion of the B-3 Zonin� District north alon� Johnson Parkway is an
expansion of the zoning desi�nation of the present Super.america store, and the other corners of
the intersection west of the Parkway. B-3 type uses, in confarmance with current codes and •
standards, have proven compatible with residences throughout the City.
