WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.400 of the Legislative Code, Alam & Associate,
fnc. duly petitioned to rezone �c Wells St. being legally described as PINs 28-29-22-32-0087 and 28-29-22-32-
0088, Charles Weide's Rearrangement of Block 6 of Neison's Addition to the City of St. Paul Lots 31, 32 & Lot
33 Blk 6, from P-1 Parking to R-4 One Family Residential or RT-1 Two-Family Residentiai to create two lots
for single-family homes; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on November 25, 2003,
for the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code,
submitted its recommendation to the Planning Commission for approval of R-4; and
W HEREAS, the Planning Commission considered the rezoning petition at its meeting held on December 19,
2003, and recommended approval of R-4 to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning pe'tition was duly published in the
official newspaper of the City on January 15, 2004, and notices were duly mailed to each owner of affected
property and property situated wholiy or partly within 350 feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on January 28, 2004, at which all
interested parties were given an opportunity to be heard, the Councii having considered all the facts and

WHEREAS, the Zoning Committee of the Planning Commission, on December 11, 2003, held a
public hearing at which all persons present were given an opportunity to be heard oursuant to said

2. Two planning processes are underway for this area: the Phafen Corridor Middle Section Plan a,^,d
the Arcade Smaif Area P1an. Soih of them also ir�cluda zor��r�g siudies. Tne planning processes
have not made final recommendations for fhis area, but the intent of both is to change the P-1
designation fior the eastern portion of the block so that the existi�g houses are no longer
nonconforming. The p4ans will recommend changing the zoning to either R-4 One Family
Residential or RT-1 Two Family Residential. Because of the size of the property, the tots coufd
accommodate one duplex or two single family homes. The applican±s wish to construct single
famify homes, so either R-4 or RT-1 would be appropriate zoning.
3. The existing zoning prevents any use of these lots besides parking. This permitted use would not
be consistent with the residential uses on thsee sides of the properties. Either of the proposed
zoning classiiications would be compatible with the uses to the west, north, a�d east.

Approval of minutes of December 5, 2003
MOTION: Commissioner Jolznsorz moved approval of the minutes of December S, 2003.
Commissioner T'revino seconded the motion. The motion carried unanimously on a voice
vote.
Chair's Announcements
Chair Morton stated the annual Planning Commission meeting will be held on Friday, February
13'", and said she has appointed Commissioner Trevino as the nominating chair. Chair Morton
reported the Fifth Friday Retreat will be held on Friday, January 30`� , at the Ramsey County
Justice Center. Commissioner Alton, chair, said there will be two agenda
items-implementation of TN Zoning and the Planning Commission's Work Program for 2004.
Planning Administrator's Announcements
Mr. Soderholm thanked Commissioners Alton and Gordon for testifying in support of the TN
Zoning Amendments before the City Council. He said Chair Morton has attended all of the
meetings and given moral support and perhaps political encoura�ement for the Council to move
forward with this. He stated that at 200 pages this is probably the largest ordinance the City
Council has ever received. The City Council laid it over to January 14`� to have more time to
review it and see if more questions emerge.

and community leaders that came to the public meetings. He said there was a Iot of cooperafion
between Districts 7 and 8. The task force received hosprtality from the Lao Family Center, Model
Cities, and Unicersity United. He requested that the City try to make resources avaitable for more
aaalysis of the potential market impacts of this plan so that private developers will understaad the
opportunity that the University-Dale area holds.

Commissiones Johnson stated there is an extremely detailed record keeping and inspection
protocol that is involved with this in the operation. The conditions that were proposed by the
Zoning Committee do essentially deal with some of those types of issues and the conditions aze
certainly appropriate. If there is any concern that these kind of facilities aze not operated
properly, Commissioners should be awaze that the state and the county do very rigorous
inspection and record keeping. He encouraged the Commissioners to vote in favor of this item.

F. HISTORY/DISCUSSION: The half block along the north side of Welis appears to have been
zoned for parking in 1976 when the City adopted a new zoning code. The existing houses on this
side of Welis became legally nonconforming at that time. There is an existing parking lot for
Versa Companies at the west end of the block.
G. DISTRICT COUNCIL RECOMMENDATION: None received at the time the staff report was
written.
