An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertauung to zoning for the City of Saint Paui with changes for the University-Dale area zoning maps
WI-IEREAS, the City Council is authoriaed under Minnesota Statutes Section 462357 and Section 64.400 of the
Legislative Code to adopt the summary of the Universify-Dale Transit-Oriented Development Study as an addendum to
the Comprehensive Plan and to adopt zone changes implementing the TOD Study summary; and
WI�REAS, the Planning Commission initiated a 40-Acre Study on February 14, 2003, for the purposed of considering
amendments to the Saint Paul Legislative Code pertaining to the University-Dale area; and
WI�EI2EAS, the Planning Commission held a pubiic hearing on the Universiry-Dale Transit-Oriented DevelopmentStudy
summary and 4�-Acre Study on December 14, 2003, notice of which was mailed to all property owtiers in the study area
and was published in the Saint Paul Legal Ledger on December 4, 2003 and in the Saint Paul Pioneer Press on November
29, December 6 and December 13, 2�03; and
WI�REAS, after consideration of the public testimony and the recommendations of the City staff, the Planning
Commission on January 9, 2004, recommended approval of the rezonings as proposed in the 40-Acre Study; and
WI�REAS, notice of a public hearing before the Ciry Council on University-Dale zoning proposals was duly rnailed to
all properry owners in the study area and was duly published in the official newspaper of the City on 2^l 2- o�� � Zy e�(

WIIEREAS, a public hearing before the City Council having been conducted on 2^(�-• y at which all interested parties
were given an opporiunity to be heard, the Council having considered all the facts and recommendations conceming the
University-Dale zoning proposals; now therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
The Council of the City of Saint Paul does hereby amend the Saint Paul Zoning Ordinance 6y amending the zoning
classifications far the following properties on the zoning maps of the Ciry of Saint Paul, Sheet No. 12 and 20, as
incorporated by reference in Sectiott 60301 of the Saint Paul Legislative Code:
That the following lots of record, pursuant to Minnesota Statutes 4623597, shall be assigned an interim zoning
classification of OS-2 while the new TN zoning classifications are presently under consideration for approval. The
interim OS-2 classification shall immediately terminate upon the effective date of the new TN zoning classification
and the following properties shall thereafter be regulated under the TN2 zoning classification. In the event that the TN
classifications are not approved, the interim zoning classification OS-2 shall become permanent.

VJHEREAS, the Planning Coxnmission is authorized under Minnesota Statutes Section
4b2.357(5) and Section 64.400 of the Saint Pau1 Legislative Code to initiate a 40-acre study for
the purpose of amending the Zoni+�g Code; and
WHEREAS, the Planning Commission initiated a 40-acre s±udy I� February 2003 for tne purposP
of considering amendments to Chapter 60 and 61 of the Sa1,t Paul Legislative Code pertaiaing io
the University and Dale area; and
WHEREAS, the Planning Comtnissior. held a pub]ic heazing on the University and Dale Transit-
Oriente�l TjPt.ei�Yr:�er:t �+n�?y s•�-r� ary and ±?:e related 40-ac:e sfiady on Jecember 19, 2003,
notice oi wnich was duiy given in the gaint Fan? Legai Ledger on December 4, 2vG3 a,nd i_n t�e
Saint t�aul Pioneer Press on November 29, December 6 and December 13, 2003; and
u�fIEREAS, ihe Planning Comznission, in accordance with state statues, has determined that:
