Sec. 82.01. Water surcharge.
(a) Statement of purpose. The City of Saint Paui is committed to a program for the separation
of its storm sewage system from its sanitary system far the purpose of abating combined
sewer overflow into the Mississippi River and to reduce the amount of cleaz water
flowage into the sewage treahnent plant operated by the Metropolitan Waste Control
Commission. This program is being conducted by the city pursuant to mandated state
legislation and authority contained in Minnesota Statutes, Section 116.19. To accomplish
this program the city is authorized by said Section 116.19 to exercise the powers of a
municipality contained in Chapters ll 5, 117, 412, 429, 435, 444, 471 and 475 of
Minnesota Statutes. This program will require the separation of storm sewage from
sanitary sewage by means of the construction and reconstruction of sewers and public
streets within the city during the ensuing years until the program is completed.
Construction and reconshuction of the sewers wiil require in many instances the
relocation of certain public water utilities located within the public streets and owned and
maintained by the Saint Paul Water Utility. The City of Saint Paul is obligated by the
provisions of Chapter 110, Special Laws of Minnesota for 1885, to reimburse the water
utility for all costs incurred in relocating its water facilities when the relocation is caused
by the construction or reconstruction of the street in which the water facilities aze located.
The council intends by this water surchazge to provide funds to pay for the costs to be
incuned in the relocation of the water facilities necessitated by the sewer separation
program.
(b) Water surcharge established. For the purpose of paying the costs incurred by the City of
Saint Paui in relocating water utility facilities made necessary in conjunction with the p{)g��s}}gp
city's construction, reconstruction, repair, enlargement and improvements necessitated by

the separation of the combined sewer system in Saint Paul, there is hereby established a v`_��'
chazge upon all properties within the City of Saint Paul which aze connected to the city's
water system. The charge shall be based upon the volume of water usage, and is hereby
established at the rate of five cents ($0.05) per one hundred (100) cubic feet of water
consumption. This surcharge on water rates far properties located within the City of Saint
Paul shall be calculated and collected by the board of water commissioners and shall be
deposited with the office of financial services in a
separate and distinct activity within the public works sewer service fitnd to be known as
"Water Surcharge" to be expended for the purposes as set forth in this section.
(c) Surcharge expiration. The water surcharge hereby established shall terminate and shall
not be applicable to billings rendered from and after December 31, 1995, unless extended
by ordinance adopted by the city council.
