Chapter 5. �epartm�at Office of Technology
Sec. 5.01. �epartm�nt Office generally.
(a) - Office estabiished. There is hereby established an executive depai4mecrt
office of the City of Saint Paul to be known as the deparUrtertt off ce of technology-x�
. The head of such $ep�rfinei�f office shall be the director, who,
prior to such appoinUnent, shall possess such qualifications as the council may by
ordinance provide. The $eparhner�t off ce of technology shall
be organized into the divisions ,

2 mayor and, subject to supervision and control, shall administer the affairs of the
3 $epartmexct office. The director sha11 have general authority and control over all
4 $epartmenta} office staff and shall oversee the proper fulfillment of all tasks and duties
5 assigned to the depxrtmerrt office. The director shali have the power to prescribe such
6 rules and regulations as aze deemed necessary or expedient for the proper operation of the
7 �eparhxieriE office and to that end shall keep informed of the latest administrative
8 practices. The director may designate, with the approval of the mayor, an employee of the
9 depxrtmerrt office of technology to perform the functions and
10 duties assigned to the director by law during the absence or disability of the director. The
11 directot shall have the power and dury to take all personnel acYions, including hiring,

Section 5, Department of Technology and Management Services, of the Saint Paul
Administrative Code is hereby amended to read as follows:
Sec. 5.(1d2. Information services division.
Within the departmetrt office of technology there sha11 be a division
of information services. Under the supervision of the director, the division shall be responsible
for:
(1) Promoting information technology as a sirategic asset to the city;
(2) Creating a healthy information technology environment that supports the attainment of
city-wide as well as department and office strategic goals;

(3) Providing access to electronic data while protecting data privacy;

3 (4) Enabling employees' and citizens' use of technology tools and standards;

5 (5) Providing connectivity within the city and promoting connectivity with citizens and
6 organizations in the wider community;

(6) Applying information technology appropriately to reduce costs and improve services;
(7) Managing the azea of common information technology needs;
(8) Developing and deploying the city's technology management and support staff.

Section 5, Department of Technology and Management Services, of the Saint Paui
Administrative Code is hereby amended to read as follows:
Sec. 5.053. Cable communications office.
(1} Establishment. Within the c�epartment off ce of technology
there shall be an office of cable communications. The cable communications officer shali
be appointed by the mayor with the consent of the council and sha11 be in the classified
service consistent with civil service commission regulations.
(2) Functions. The office shall be responsible for the administration of the cable
communications franchise and for the planning and development of cable
communications services. The cable communications officer's duties and responsibilities
shall include, but not be limited to, the following:
(a) Serve as liaison between the city, franchisee, state and federal authorities concemed with
cabie communications;
(b) Receive and investigate compiaints concerning the operation of the cable
communications system;
(c) Assure franchisee's compliance with all applicable ardinances and laws and, upon
determination of any violation of same, take all necessary and appropriate action to
enforce the applicable law;
41 (d) Monitor the franchisee's performance and adherence to the terms of the franchise,
42 including, but not limited to, consriuction schedule, installation policy, rates, operational
43 standards, maintenance, technical standards, system design, use of public ways, service
44 continuity and the provision of support and facilities for access and community
45 programming;

47 (e} Receive for review and evaluation all data and reports required of the franchisee and,
48 where appropriate, forward such data to interested or affected city departments; and
49
50 (f} Make such recommendations and reports to the city council and mayor as may be deemed
51 necessary to the regulation and development of the cable communications system.
