WHEREAS, Pursuant to MinnesoYa Statutes §462.357 and §61.800 of the Legislative Code, Allen
Hohenwald duly petitioned to rezone property on the east side of Iroquois Ave. being legally described
as BEAVER LAKE HEIGHTS L0710 BLK 6, PIN 26-29-22-31-0007, from VP Parking to R4 One-
Famify Residential to construct single family home; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on July 22,
2004, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the
Administrative Code, submitted its recommendation to the Planning Commission for approval; and
14 WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on July 30,

WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly
published in the official newspaper of the City on August 26, 2004, and notices were duly mailed to
each owner of affected property and property situated wholly or partly within 350 feet of the property
sought to be rezoned; and
WFtEREAS, a public hearing before the City Council having been conducted on September 22, 2004,
at which all interested parties were given an opportunity to be heard, the Council having considered
all the facts and recommendations concerning the petition; now, therefore

Commissioner L,onetti stated she was contacted by some of the neighbors because this is azound
the azea where she lives, with real concezns about pa,�k'na issues and ttaffic going back and forth.
Commissioner I,onetti said they were very upset about the idea of excavating the back yazd and
taking out a couple of very lazge h�ees and changing the character of the neighborhood, so
keeping the garage and keeping the yazd as is, is important to them. She stated there are no side
wallcs on Finn Street and so the children of the neighborhood tend to bike up and down Palace
along the street which is where the cazs aze going to be coming and going, and they didn't want
the parking 2ot there either. There are real concems about how many cars aze coming and going.
Commissioner I.onetti said initiatly there was a petition they had signed but they didn't seem to
click real well with the appficant to find out what was happ�ino with it and understanding that
the applicant was planning on taking down the garage and then excavating and so thaYs where •
the controversy started coming in. The neighbors aze interested in keeping it residential upstairs

Casey MacCallum (intern) presented the staff report with a recommendation for approval of the rezoning from
VP (P1) to R4. One letter of concern was received. Mr. Torstenson stated that the letter, which was received
from a neighboring property owner, is not in opposition to the rezoning but is concerned about old barrels of oii
stored here because of the previous use, a gas station. This is a notice to the property owner and to LIEP that
buiiding permits should reflect this information and the proper adjustments to the site plan should be made.
Mr. Torstenson stated that the letter does not affect whether residentiai zoning is appropriate here.

F. HISTORY/DISCUSSION: In 1975 the property was classified as P1(parking). The lot was never
paved or used for parking.
G. DfSTRICT COUNCIL RECOMMENDATION: District 2 had not commented at the time the staff
report was prepared.
H. FINDINGS:
1. The applicant, Allen Hohenwald (the fee owner), is planning to sell the lot to Lifestyle Properties
Group LLC. The new owner proposes building a single family home with an attached garage. The
garage will be piaced behind the house for better visual appeal. The driveway to the garage will
be along the southern edge of the lot, beiween the new house and the adjacent B2 Business lot.
2. The proposed R4 One-Family zoning is compatible and consistent with the proposed one-family
house, and is also compatible and consistent with the R4 zoning and one-family development in
the surrounding area. The proposed single-family home would be more compatibie with the
surrounding area than a parking lot.
3. The proposed rezoning is consistent with the Saint Paul Comprehensive Plan chapter on
Housing, whicfi recommends creating more smaifer housing units (Ffousing Policy 5.1).
4. The current VP Vehicular Parking zoning, which allows only use as a vehicuiar parking facility,
does not provide for reasonable use of the property. The current zoning has been in place since
1975, and the lot has never been paved or used for parking.
• I. STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of fhe
