An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, Thomas Lux
duly petitioned to rezone 2041 Grand Avenue being legally described as EX ALLEY LOT 29 BLK 2 OF THE
ROSEDALE PARK PLAT from RM-2 to B-2C to allow for conversion of the first floor from residential to a
kitchen design business, the petition having been certified by the P12nuing Division on July 1, 2003, as having
been consented to by at least two-thirds of the owners of the property situated within 100 feet of the total
contiguous property within one year preceding the date of the petition; and
WIIEREAS, the Zoning Committee of the Planning Commission held a public hearing on July 31, 2003, far
the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative Code,
submitted its recommendation to the Plamiiiig Commission that the petition be granted; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on August 8,
2003, and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly published in
the official newspaper of the City on August 27, 2003, and notices were duly mailed to each ownet of affected
property and property situated wholly or partly within 350 feet or the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on September 3, 2003, at which
all interested parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations concerning the petrtion; now, therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 17, as incorporated by reference in §60301 of
the Saint Paul Legislative Code, as amended, is hereby fmther amended as follows:

WHEREAS, the Zoning Committee of the Pianning Commission, on July 31, 2002, heid a public
hearing at which ali persons present were given an opportunity to be heard pursuant to said
petition in accordance with the requirements of §64.300 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantiaily ref(ected in the minutes, made the
following findings of fact:
The house at 2041 Grand Avenue is being used as a duplex. The owner, Thomas Lux,
Iives ir. the lo�n�er unit. Mr. Lux wishes to move into the upstairs unit and convert the m2in
fioor (1,042 square feet) 4o a kitchen design business. A similar B-2C use (rezoned in
1989) is to the immediate west of the parcel. The intersection of Grand and Cleveland (one
lot removed irom the site) has commercial on all four corners. The only single family uses
in the immediate area are a single home on the south side of Grand and homes fronting on
Summit Avenue to fhe nortf�. The parce( currentfy has a two-car garage and space for at
least three addiiional parking spaces. Curb parking is by permit only in front of the property.

This document is intended to provide you an overview of my intentions and request your
approval to rezone my property at 2041 Grand Avenue.
I thank you in advance for your attention to this request. I have intentionally kept this
information packet brief, but I would be happy to discuss and answer any questions that you may
have.
Enclosed you will find:
1. This Overview (2 pages, single sided).
2. The St. Paul Zoning Code of 62C zoning (1 page, double sided).
3. The "Summary of Your Position to This Rezoning Request" (1 page, single sided}.
4. The "Consent of Adjoining Property Owners for a Rezoning" petition (1 page, single
sided).
5. A return envelope.
I currently live in the lower unit and rent the upper unit to 3 St. Thomas students. At the
conclusion of the current lease, I would like to move into the upper unit and use the lower unit as a
kitchen design and consulting studio.

This kitchen design business will consist of a kitchen designer and myseif. The primary use of
the design studio will be to hold design sessions with clients. Client meetings wili be held at both the
project site as well as in the design studio. Client meetings that are heid at the design studio will be
by appointment onfk We anticipate 4- 6 meetings / week at the design studio.
We will maintain a distribution facility at a different location. All shipping and receiving
activities wili be performed at the distribution facility.
I believe that using the property for this purpose will:
1. Greatly reduce the amount of traffic,
2. Allow me to completely controi the times of the traffic,
3. Allow me to completely control the rypes of activities on the property.
I anticipate the overall level of activity on the property to be significantly reduced. In generai,
I'm switching from the activities of coliege students to business meetings held during business hours
I believe that this is most significant benefit of this proposal.

the 3uly 1Q, 2J03 meeting of the Board of Directors.
The Macaiester-Groveland Community Cour.cil supports the proposed rezonin� at
2041 Grand Avenue from RM-2 to B-2C to ailow a kitchen design business.
