Definitions. The followin¢ definitions shall applv in the intemretation and enforcement of this chapter: 17 fa) Chan�e of ownership means a licensed business is sold or transferred to another person, business or 18 corporation. A chan� of ownershio, as it relates to an environmental plan review, does not include the 19 chanein� or addinQ of officers to an existingpartnership or comoration or chanae of a mailine address. 20 (bl Director means the director of the environmental health section of the city office of license, insnections 21 and environmental urotection or his/her desi agn ted aeent• 22 (c) Remodel means any reconshuction, alteration or repair that rec�uires structural. plumbine. mechanical 23 and/or electrical permits; changin¢ the location of walls; expanding the azea of the facilitv; substantially 24 chan i�nq or expandine the character of the business. Remodel doas not include replacine a roiece of 25 equipment with a like piece of equipment: repiacing wall, floor or ceilin¢ finishes: repositioninQ equipment: 26 providin� new equipment that does not significantly alter the chazacter of the business. The director shall 27 have discretion in determining when this section a�plies. 28 (da) Tanning equipment means ultrauiolet or other lamps and equipment containing lamps intended to 29 induce skin tanning through the uradiation of any part of the living human body with ultraviolet radiation. 30 (eb) Tanning facility means a location, place, area, shucture or business or part thereof which provides 31 consumers access to tanning equipment. Tanning facility includes, but is not lunited to, tanning salons, 32 health clubs, apartments or condominiums, regardless of whether a fee is charged for access to the tanning 33 equipment. 34 (fe) Ultraviolet radiation means electromagnetic radiation with wavelengths in air between two hundred �. � .� ; 1 � 2 3 4 5 6 7 '3 (200) nanometers and four hundred (400) nanometers. (C.F. No. 93-1733, § 3, 12-9-93) Section 2 Section 380.04 of the Saint Paul Legislative Code is hereby amended to read as follows: Sec. 380.04. Fee. 03-�� 9 The fee required for a license along with the fees for an environmental plan review and chan¢e of ownership 10 review shall be established by ordinance as specified in section 310.09(b) of the Legislative Code. The 11 licensee shall display the license in a prominent place on the premises at all times. The license shall be 12 renewed annually on the anniversary date of such approval. 13 (C.F. Inspection and change o ownership review reguired. The director shall inspect each tannin f��priar to issuin¢ a license for a new establishment or chanee of ownership to determine compliance with the requirements of this chapter. A license sha11 not be issued until the corrections required bv the director, as a result of the environmental plan review or chan¢e of ownershiu review inspection have been made, to the satisfaction of the office. 7 Section 4 Section 380.09 of the Saint Paul Legislarive Code is hereby amended to read as follows: 03-�°�'� Sec. 380.09. Submission of plans and snecifications. Environmental plan review required. A person shall not be¢in to conshuct, remodel, or alter a taiming facilitv until the director has reviewed and approved the plans and specifications required bv this subsection. The tamiine facility shall be constructed and finished in conformance with the a�proved plans. The director may inspect the tatuiin facility as frequentiv as deemed necessary durin¢ construction to ensure that construcuon occurs in conformance with this chapter. The director shall conduct a final inspection prior to the start of operations and issuance of an approved license. Currernly the Environmental Health Section does not collect fees for the extra work involved in,conducting plan review activities. The staff time required for this activity is extensive.
