Chapter 87. Water Code--Water Service Connections
14 Sec. 87.01. Definitions.
15 "Water service connections" and fi�e "fire services" aze defined as the pipe which extends
16 from the street main to the first stop ahead of the water meter, or in the case of a yazd
17 meter setting, shall be defined as extending to the inside of the first building serviced,
18 when such pipe is used for the conveyance of the public water supply for domestic,
19 commercial, industrial and fire protection uses only.

The Council of the City of Saint Paul Does Ordain:
Section 1
That the following section 87 of the Saint Paul Legislarive Code is hereby
amended as follows:

contract has been executed. All street service connections shall be instailed based on
actual cos�t, includine labor equipment materials and overhead except for those listed in
sections 87.14 and 87.15.

21 (a) Charges for street service connections shall be in accordance with the following Table

23 Actual costs, including labor, equipment, materials and overhead, shall be charged for
24 street service connections in the foliowing categories:
25 1. Ali connections in the downtown area. The downtown area shall be defined as follows:
26 An azea bounded by and including University Avenue on the north, Lafayette Road and
27 State Tnmk Highway 3 on the east, Shepazd and Warner Roads on the south and Chestnut
28 Street to Sununit Avenue to John Ireland Boulevard to Rice Street on the west.
29 2. All connections in rock azeas and tunnels, as determined by the water utility.

31 The schedule charges in Table I below include the cost of installation, the initiation and
32 maintenance of the account, the first meter setting and turn-on, and the guarantee as

NOTE: The foliowing provisions apply to Table I:
Chazges for street service connections in a cul-de-sac aze to be based on a street width
equivalent to seventy-five ('75) percent of the cul-de-sac diameter.
15 If a street has two (2) mains on opposite sides of the street, the schedule for a street of
16 one-half the width shall be utilized to establish the charge, but in no case shall the chazge
17 be less than the chazge for a sixty-foot street.
18 For a second pipe in same ditch, the charge shall be in accordance with Table I.

22 Where an open cut is not permitted in a street by a governmental unit, and, consequently,
23 a casing tube is required for the street service connection installation, the property owner
24 shall obtain the necessary permits and provide the casing tube and casing tube
25 installation, all at the owner's sole expense.

(b) An administrative fee of seventy-five dollazs ($75.00) shail be chazged for each street
service connection or fire service installed by a contractor in conjunction with new street
mains described in section 87.03 and each connection installed bv a contractor in
conjunction with a new private water main. This fee will compensate the water utility for
account initiation and account maintenance costs which costs are included in the schedule
chazges for service connection installation work performed by the water utility.
Sec. 87.15. Additional costs; street repair and extraordinary excavation charges.
The following charges shall be made in addition to the regulaz schedule chazges of street
service connections, in accordance with Table II below:
(1) Frost chazges, where it is necessary to cut frost in excavating a trench.
(2) City street permit chazges, where excavation requires such pemut from the city.
(3) Winter paving charee, where a temporarv street repair is necessarv. �'�

10 the owner or tenant pays the delinquent chazges rather than have the water service
11 ternunated, a coliection service fee equal in amount to the current tum-on service chazge
12 shall be chazged even though the water service is not actually shut off.
13 (c) Whenever water has been turned off for nonpayment of charges due or for infraction
14 of the rules, ail outstanding charges must be paid or arrangements for payment must be
15 made and approved by the water utility, in addition to the turn-on service charge or
16 collection service fee, before water is tumed on again. Water service will only be turned
17 on during established working hours.

Sec. 91.24. Special purpose lateral mains.
The boazd may, at its discretion, install special purpose lateral mains within street rights-
of-way from the public main in the street to the property line. Special purpose lateral
mains may be used for connections to private water mains, hydrants, and multiple street
service connections. Charges for special purpose lateral mains shall be in accordance
with charges for street service connections and fire services, sections 5�1-=? 87.13, °�', .�
$7�3 and 87.16. Special purpose lateral mains shall be maintained by the water uriliry as
part of the public water main system.

3 No person shall install, extend, attach, repair or replace any plumbing system in any
4 building, structure, premises or property where the total mazket cost of the plumbing
5 work exceeds siY hundred dollazs ($600.00) without first obtaining a pemut from the
6 water utility. However, all plumbing work associated with backflow prevention devices
7 (new installation or repTacement �eg�) will require a pemut regardless of the market
8 value work. Plumbing pemuts must be obtained prior to commencement of the plumbing
9 work.

NOTE: Permit fees for underground piping are for first seventy-five (75) feet of piping
and each seventy-five (75) feet thereafter.
Should any plumber, person, firm or corporation begin work of any kind for which a
permit from the water utility is required under this Code without having secured the
necessary permit therefor, or within twenty-four (24) hours after work is commenced, the
plumber, person, firm or corporation shall be required to pay double the plumbing permit
fee required, except that such time limit shall be exclusive of holidays and Sundays. If
such plumber, person, firm or corporation fails to take out such permit oftener than three
(3) rimes in any calendar year, such plumber, person, firm or corporation shall be guilry
of a misdemeanor and subject to a fine of at least three hundred dollars ($300.00). After

five (5) such violations of the provisions of this Code, the license covering such plumber
in plumbing activities shall be revoked.
Sec. 92.09. Board will license; permits outside city.
4 The board of water couunissioners may accept �-a-�� as master plumbers such
5 persons as have been granted certificates of competency and have a license to practice
6 and engage in business as master plumbers under the provisions of the building code of
7 the City of Saint Paul. The board may grant pemrits to do work on a water supply system
8 of any building, structure, or part thereof, or premises, which is located outside of the
9 City of Saint Paul and is supplied with Saint Paul city water, when the applicant for such
10 pernvt has a master plumber certificate of competency issued by the City of Saint Paul
11 and holds a master plumber's license issued by the Staxe of Minnesota.

Chapter 94. Water Code--Interior Work
Sec. 94.18. Backflow preventers.
Installation, maintenance and testing of backflow preventers shall be according to the
State of Minnesota Plumbing Code. Annual testing of reduced pressure zone backflow
preventers is required. Upon receipt of notice for annual testing from the water utility,
property owners shall have thirty (30) days in which to have backflow preventer testing
accomplished by a licensed plumber with backflow testing certification or by permanent
noncontract staff who possess backflow testing certification and are registered with the
water utility. Test results shall be furnished to the utility. The utility's annual fee for
administering the backflow preventer testing program shall be as follows:

Every two years, the Board of Water Commissioners evaluates and revises fixed charges and fees tor work performed by Saint Paul �

WHEREAS, Boazd of Water Commissioners ("Board") staffrecommends that Chapters 87, 89, 91,
92, 94 and 95 of the Saint Paul Legislative Code of the City of Saint Paul ("Code") be amended so
that certain fees for services more closely reflect the cost of providing those services; and
WHEREAS, Board staff has prepared a City of Saint Paul Ordinance ("Ordinance") which amends
the Code to provide for these fee increases, copy of the Ordinance being attached hereto and
incorporated herein; and
WHEREAS, the assistant city attorney has reviewed and approved the Ordinance as to form, and
the Saint Paul Regional Water Services General Manager recommends approval of the Ordinance;
now, therefore, be it
RESOLVED, that the Board of Water Commissioners does hereby approve the attached Ordinance
amending Chapters 87, 89, 91, 92, 94 and 95 ofthe Saint Paul Legislative Code of the City of Saint
Paul; and, be it
FURTHER RESOLVED, that the Board of Water Commissioners does hereby request that the

PROPOSED WATER CODE REVISIONS
September 18, 2003
Following is a summary of proposed Code revisions, as approved by the Board of Water
Commissioners at its September 9, 2003 meeting. Exact changes are shown on the attached
Ordinance by means of lineouts and underlinings.
The Ordinance proposed at this time reflects increases in the following fixed charges and fees for
2004 and 2005:
1) 5% annual increases for 2004 and 2005 for installation of 1-inch water service.
2) 5% annual increases for 2004 and 2005 for frost charges, and initiation of a Winter
Paving Charge.
3) $10 increase for 2004 and $5 increase for 2005 for water service turn-on.
4) 11% to 25% increase for 2004 plumbing permit fees and 2% to 29% increase for
2005, depending on building type and scope of piumbing improvements.
5) 14% to 17% increase for 2004 and 10% to 14% increase for 2005 for annual backflow
preventer fees, depending on number of devices.
Language changes for housekeeping purposes also appear throughout the Ordinance.

• 80-foot wide streets, such as Grand Ave., would fall into the new 80' to
109' category. Construction on such streets is more costly and the chazges
of the next category better reflected those costs.
Streets wider than 109', such as Summit Ave. sometimes have two water
mains or, if only one, the installarion is either very short or very long.
Charging actual costs for work on these streets is more fair and equitable.
3. Elimination of redundant or misleading language: Housekeeping.

1. Creates a new "Winter Paving Charge" where temporary winter repair is required.
Charge to be equal to 50% of the bituminous street repair charge.

3. Increases frost charge by 5% for 2004 and 5% for 2005.

1. Winter Paving Charge:
Asphalt mix for pezmanent repair is not available during winter months.
Consequently, crews must apply a temporary patch, dig it out in the spring and
then apply the permanent asphalt. The extra cost of these temporary winter repairs
averages $219.
Proposed new Winter Paving Charge (50% of the bituminous charge):
2004 = $210
+5% in 2005 to $220
2. 5% annual increases in street repair charges:
The current restoration charge of $400 for a typical street is $1001ess than the
averaged cost to accomplish the repair. Although the cunent charge is 54°Io
greater than 17 years ago, many more bituminous streets now have concrete curbs
and driveway aprons.

A frost charge is coliected for service installations paid for from October through
March the following year, but is refunded if less than one foot of frost is
encountered. Although less than five 1-inch street service connections are usually
installed in frost each year, the avezage cost of their installation is over $1,200
more than is collected in charges.
