THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: 9 10 11 12 13 14 15 16 17 Secrion 1 Section 33.04 of the Saint Paul Legislative Code is hereby amended to read as £ollows: Sec. 33.04. Establishment of permit fees. (A) Fees required: Befare issuing any permit required by the building code, this chapter or other pertinent provisions of the Saint Paul Legislative Code, the fee as indicated in the following schedule shall be paid. 18 Where work for which any such permit is required is started ar proceeded with prior to obtaining said 19 perxnit, the fee specified shall be collected and, in addition, a penalty fee shall be collected. The penalty fee 20 shall be equal to the specified permit fee. The payment of such penalty fee shall not relieve any person from 21 fully complying with the requirements of the building codes in the execution of the work or from any other 22 penalty prescribed herein. 23 24 25 Building valuation for the purpose of establishing building permit fees shall be as set forth by the valuarion data published by the Building Code Division, Department of Administration, State of Minnesota, as may be amended from time to time. 26 Value of work other fhan that included in the va2uation data published by the Building Code Division, State 27 of Minnesota, must include the cost of installations, alterations, additions or repairs, including all labor and 28 materials supplied by the contractor and other sources. The building code officer may require the contractor 29 to furnish the city with a written statement of the actual cost of the work. When 7 the valuation of the proposed construction exceeds one thousand dollazs ($1,000.00), a plan review fee shall 8 be paid to the building official at the time of submitting plans and specifications for checking review. Plan 9 review fees shall be sixty-five (65) percent of the total building pernut fee as set forth in the table above. 10 (C) Expiration ofplan check: Applications for which no permit is issued within one hundred eighty (180) 11 days following the date of application shall expire by limitation, and plans and other data submitted for 12 checking may thereafter be returned to the applicant or destroyed by the building officiaL The building 13 official may extend the rime for action by the applicant for a period not exceeding one hundred eighty (180) 14 days upon written request by the applicant showing that circumstances beyond the control of the applicant 15 haue prevented action from being taken. No application shall be extended more than once. In order to renew 16 action on an applicarion after expiration, the applicant shall resubmit plans and pay a new plan checking fee. 17 18 (D) Expiration of building permit: 19 (1) Every permit issued by the building official under the provisions of this chapter shall expire by limitation 20 and become null and void if the building of work authorized by such permit is not commenced within one 21 hundred eighty (180) days from the date of such permit or if the building or work authorized by such permit 22 is suspended or abandoned at any time after the work is commenced for a period of one hundred eighty 23 (180) days. Before such work can be recommended, a new permit shall be first obtained so to do, and the fee 24 therefor shall be one-half the amount required for a new permit for such work, provided no changes have 25 been made or will be made in the original plans and specifications for such work; and provided further, that 26 such suspension or abandonment has not exceeded one (1) year. 27 (2) Any permittee holding an unexpired permit may apply for an extension of the fime within which he may 28 commence work under that permit when he is unable to commence work within the time required by this 29 section for good and satisfactory reasons. The building official may extend the time for action by the 30 permittee far a period not exceeding one hundred eighty (180) days upon written request by the permittee 31 showing that circumstances beyond the control of the permittee have prevented action from being taken. No 32 permit shall be extended more than once. In order to renew action on a permit after expiration, the permittee 33 shall pay a new full permit fee. 34 35 36 37 38 39 40 41 (3) Moreover, all work commenced pursuant to the issuance of a building permit by the building official for construction, alteration, repair or remodeling of the exterior portion of a single-family dwelling or two- family dwelling, including an attached or detached garage, must be completed within one (1) year from the date of issuance of the building permit or witlun one (1) yeu from the effective date of this ardinance, whichever is later. The building official may extend the time for completion upon written request of the permittee establishing that circumstances beyond the control of the permittee establishing that circumstances beyond the control of the permittee prevented completion of the wark for which the building permit was authorized. 2 0 6 7 03-Y�q (4) All work commenced pursuant to the issuance of a building permit by the building official for construction, alteration, repair or remodeling of the exterior or the interior portions of R-I properties or commercial properties where the permit valuarion is under $500,000, must be completed within one (1) year &om the date of issuance of the building pernut or within one (1) yeaz from the effective date of this ordinance, whichever is later. The building official may extend the time for complerion upon written request of the pemuttee establishing that circumstances beyond the control of the permittee prevented completion of the work for which the building pernut was authorized. (5) Any person who violates subsecfion 33.04(D) shall be guilty of a misdemeanor. 9 (E) Suspension or revocation of building permit: The building official may, in writing, suspend or revoke a 10 pernut issued under provisions of this chapter whenever the permit is issued in error or on the basis of 11 incorrect information supplied, or in violation of any ordinance or regulation or of any of the provisions of 12 the state building code. 13 14 15 16 17 (F) Refund ofpermitfees: (1) The building official may authorize the refunding of any fee paid hereunder which was erroneously paid or collected. (2) The building official may authorize the refunding of not more than eighty (80) percent of the permit fee paid when no work has been done under a permit issued in accordance with this code. 18 (3) The building official may authorize the refunding of not more than eighty (80) percent of the plan check 19 fee paid when an application for a permit for which a plan check fee has been paid is withdrawn or canceled 20 before any plan checking is done. 21 22 23 24 25 The building official shall noY authorize tke refunding of any fee paid except upon written application filed by the original permittee not later than one hundred eighty (180) days after the date of fee payment. (G) Other permit fees: Permit fees for other than general conshuction shall be as follows: (1) Wrecking of buildings or structures. $4.00 per 1,000 cubic feet or fraction thereof, minimum �553:96 58.00. 26 (2) Moving of buildings or structures. Buildings larger than 12 feet high, 14 feet wide, 25 feet long other 27 than buildings used for Group U, Division 1, occupancies: �9�BB 210.00 per move. Group U, Division l, 28 occupancy buildings larger than 12 feet high, 14 wide, 251ong: �63-69 69.00 per move. For electrical work the permit fee charges shall be made at the following rates; 9 provided, however, the minimum fee for any permit shall be: one-family dwelling electrical work 3�98 10 39.00, multifamily, commercial and industrial work, �66 48.00. 11 12 13 14 (a) Service: New service, change of service, temporary service, addition, alteration or repair on either primary or secondary service up to 600v shall be fartq-faur foriy eight dollars ($�66 48.00). (b) Circuits: The fee for the installation of new circuits and/or feeder additions, alterations or repairs to existing circuits up to 600v shali be irirre ten dollars ($9:66 10.00 . 15 (c) Transformers, capacitors, and generation for light, heat and power: Transformers, capacitors, and 16 generation far light, heat and power shall be computed sepazately at $�5-6@ 28.00 per unit plus $1.00 per 17 KVA, KVAR or fraction thereof. In addition to the above fees, the fee for all transformers for signs and 18 outline lighting shall be �re thiriy four dollars ($33-66 34.00 per sign. 19 (d) Alterations, repairs, or extension of electricai systems: For any alteration, repair or extension of an 20 existing electrical system where the work is of such a nature that the fees for a permit cannot be determined 21 from the above schedule, the permit fee charge shall be based on one percent of the total valuation of the 22 work. Minimum fee shall be frflq-�hree fi ei ht dollars (�53:00 58.00). 23 (e) L,ow-voltage fire alarm systems, remote-control circuits, signal circuits, and low-energy or low-voltage 24 power circuits: For remote control circuits, signal circuits, and low-energy or low-voltage power circuits (in 25 other than single-family dwellings) the permit fee charge shall be: 26 1. 27 28 2. 29 30 31 32 33 34 35 Fire alarms.... (i) Transient projects: For permits on transient projects, including, but not limited to, carnivals and circuses, the inspection fees shall be computed as follows: Power supply units--According to items (a), (b) and (c) of the electric work fee schedule. All rides, devices and concessions shall be inspected, the inspection fee shall be $�'t66 21.00 per unit. (j) Swimming pools: �59:6@ 55.00 plus circuit chazge. 7 (5) Gas burner, oi1 burner, coal burner and other fuel burners. �53-9@ 58.00 for the first l OQ000 btu per 8 hour input or fraction thereof, plus �$�A9 11.00 for each additional 100,000 btu per hour or fraction 9 thereof. Masimum fee for each individual bumer shall be nfr8$6@ 757.00. Where dual fuel installations aze 10 made, the masimum combined permit fee shall not exceed $i�S�A@ 1 375.00. 11 (6) Plastering, stucco and spray-on fireproofing. For plastering and stucco, the fee is $75.00 for the first 200 12 square yards or fraction thereof and $8.00 for each additiona120 squaze yards or fraction thereof. For redash, 13 spray-on fireproofing or patching, the fee is one (1) percent of the valuafion of the work; provided, however, 14 that the minimum fee for any permit is $53.00. 15 E[� (7) Plumbing fees: (a) Drain waste and vent, water supply and fixtures. 17 1. Maximum fee .... fr8-8-8@ 757.00 (8) Standpipes, sprinklers and fire pumps; new installations, repairs or alterations: (a) The minimum fee shall be $42.00, in addition to which the following fees shall be paid: 1. Standpipes: $64.00 for each standpipe for the first five (5) floors, plus $7.00 for each floor above the fifth. 2. Sprinklers: $15.50 for each additional ten (10) sprinkler heads or fraction thereof. 3. Fire pumps: $50.00 for each pump. (b) Fire extinguishing systems utilizing an extinguishing agent other than water, new installations, repairs or � 1 alterations: The fee shall be one percent of the valuation of the installation, repair or alteration with a a � - �� 2 minimum fee of $42.00. 3 (9) Refrigeration: 4 (a) Refi pemut: One (1) percent of total value of work, minimum fee of'�53:9@ 58.00. 5 (b) Total value of work is defined under section 33.04(A). 6 (10) Signs, billboards, marquees and awnings: 7 (a) Wall, roof, projecting and freestanding signs: $1-:9@ 2.10 for each squaze foot with a minimum fee of 8 $53:66 58.00. 9 (b) Marquees over public property: $3z5-6@ 138.00 for each installation. 10 (c) Billboazds: $i�5:9@ 138.00 zoning approval fee plus one (1) percent of the total valuation of the 11 conshuction cost. 12 (d) Awnings projecting over public property: �9@ 2.10 per lineal foot, minimuxn $5'r.66 58.00 for each 13 installation. A separate sign permit is required for awnings with signage. 14 (11) Steamfztting and hot water work: 15 (a) Fee for new construction or alteration shall be one (1) percent of total valuation of the work. 16 Value of work must include the cost of installation, alteration, addition and repairs including heat transfer 17 units, accessories to the heating system, including pipe, fittings, and all labor and materiais necessary for 18 installation. 19 In addition, it shall include all materials supplied by other sources when these materials are normally 20 supplied by the contractor. 21 (b) Minimum permit fee for commercial, industrial, institutional or business occupancies is $53:6A 58.00. 22 (c) The fee for alterarions, additions and repair to existing refrigeration, gas and oil systems shall be based 23 on one (1) percent of total valuation of the work with $53-6@ 58.00 minimuxn. 24 (12) Warm air, heating, ventilation and sheet metal: 25 (a) Mechanical warm air heating systems:$53-66 58.00 for the first 100,000 btu per hour or fraction 26 thereof, plus �66 11.00 for each additional l OQ000 btu per hour or fraction thereof. 27 (b) Ventilation systems, dust collection systems, pollution control systems, etc.: One (1) percent of total 28 valuation of the work. Value of work must include the cost of installation, alterarion, addition and repair, 29 including all labor and materials necessary for installation. The minimum fee shall be $53:66 58.00 for 30 commercial buildings and $3�-@9 34.00 for residential ventilation work and duct modification. 31 (c) General sheet metal: A sepazate permit is required for general sheet metal work. For gutters, flashing, 32 metal chimneys, chutes or general sheet metal work, the fee shall be one percent of the total valuation of the 33 work. The minimum fee is $5's.69 58.00. 34 (13) Incinerators: 35 (a) Domestic incinerators:�r53-6@ 58.00 for each installation. 03-��'i (b) Commercial and indushiai incinerators: One (1) percent of total value of work, minimum $53-8A 58.00 for each installation. 3 (14) Fences: $�$:66 31.00 for the first 2001ineal feet or fraction thereof erected and �6 11.00 for 4 each additional 100 lineal feet or fraction thereof. 5 (15) Other projects: For alterations, repairs or extensions for which the fee chazge cannot be detenniued by 6 items (1) through (14) above, the fee chazge shall be based on one (1) percent of the totai valuarion of the 7 work, with a u�iuiinum fee of $53:6@ 58.00. 8 (16) Reserved. 9 (17) Solid fuel burning freestanding heaters and stoves, nonmasonry freplaces and fire place inserts: �i�6@ 10 58.00. Method for providing positive combustion air must be provided with permit application. 11 12 13 14 15 16 17 18 19 20 (18) Solar heating systems: Permit fees for solaz heating systems shall be one (1) percent of total valuation, with a minimum fee of $5's.6B 58.00. (19) Pazking lots: (a) Permit fees for parking lots shall be one (1) percent of total valuarion, with a minimum fee of $53�@ 58.00. No pazking lot or loading and unloading area requiring approvai under the provisions of Legislarive Code sections 62.103 and 62.105 shall be constructed nor shall any existing unimproved lot be paved without first obtaining a building permit. Such lots shall not be used until the construction has been completed and approved by the building code officer. , • 21 (b) No off-street parking lot or loading and unloading area shall be repaved, modified, reconfigured or 22 enlarged without first obtaining a building permit. The permit fee shall be one (1) percent of the total 23 valuation, with a minimuxn fee of � fiftv ei h�t dollars ($53:8@ 58.00 . 24 25 26 27 28 29 (20) Tank installation and removal.• (a) Tank removal: �98 138.00. (b) Tank installation: One (1) percent of the total valuation, with a minimum fee of $53-60 58.00. (H) Fees, exemption for city: The city shall be exempted from the payment of permit fees required under this chapter where work is done by city employees on city-owned properry not exclusively leased or rented to a party other than the city. 30 It is the intent of this paragraph only that payment of fees are waived. Permits as required by other sections 31 of the Saint Paul Legislative Code aze to be applied for and issued, inspections are to be made as required 32 and compliance with all other requirements must be made. 33 34 35 36 Section 2 Secrion 33.05 of the Saint Paul Legislative Code is hereby amended to read as follows: 37 Sec. 33.05. Certificate of occupancy. a3 �889 1 (A) Use or Occupancy: No building or structure in Group A(Assembly), B(Business), M(Mercanrile), E 2 (Education), F(Factory), I(Institutional), H(Hazardous), R-1 (Multifamily Residential), nuisance dwelling 3 as defined in, and to the extent and for the periods required, in Chapter 42 of the Legisiative Code, or S 4 (Storage) occupancies shall be used or occupied, and no change in the existing occupancy classification of a 5 building or shucture or portion thereof shall be made, until the fire mazshal has issued a certificate of 6 occupancy therefor as provided herein, except for dwelling units occupied by an owner. The word "owner" 7 means a natural person, and does not include a corporation, parinership or other entity. 8 (B) Change in Use: Changes in the chazacter or use of a building shall not be made without the approval of 9 the building official and the fire marshal, and the building may be occupied for purposes in other groups 10 provided the new or proposed use is less hazazdous, based on life and fire risk, than the existing use. 11 (C) Certificate Issued: After final inspecrion by the building official, when it is found that the building or 12 structure complies with the provisions of this Code, the fire mazshal shall issue a certificate of occupancy. 13 (D) Existing Buildings: Every building except one- and two-family dweilings which aze not nuisance 14 dwellings as defined in, and for the periods required by, Chapter 42 of the Legislative Code and residen6al 15 gazages heretofore erected shall have a certificate of occupancy issued by the division of fire prevenrion and 16 posted on the premises. Before such a certificate can be issued, such buildings shall be inspected by the 17 division and found to conforxn to the requirements of the building code at the time of construction or at the 18 time of conversion to its present use and to the provisions of the Saint Paul Legislative Code; except that 19 energy efficient standards in rental dwellings and multiple dwellings shall be enforced on complaint basis 20 only. No building which is required to haue a certificate of occupancy shall continue to be occupied without 21 such certificate. 22 (E) Renewal Required: An inspecfion shall be scheduled by the division of all buildings of Group A 23 (Assembly), E(Education), I(Institutional), H(Hazardous), and B(Business), M(Mercantile), S(Storage), 24 F(Factory), and R(Residential) occupancies which have a certificate of occupancy. Inspections shall be 25 scheduled by the division on a two-year cycle far all buildings of R-1 occupancy which have a certificate of 26 occupancy. Inspections shall be scheduled on a one-year cycle for all nuisance dwellings as defined in, and 27 during the periods required by, Chapter 42 of the Legislative Code. If it is found that such buildings do not 28 conform to the applicable requirements, the certificate of occupancy may be revoked and the building shall 29 not be occupied until such tnne as the building is again brought into compliance with such requirements. 30 (1) Reserved. 31 (2) Nonresidential renewal schedule. The fire mazshal shall establish written guidelines for the renewal of 32 nonresidenrial occupancies based on the hazard of the occupancy. 33 (a) The fire marshal shall provide an annual written report of nonresidential inspections that includes group, 34 property address, and inspection schedule to the city council. 35 (b) Revocarions or condemnations. Where the certificate of occupancy has been revoked, or the building has 36 been condemned, once the certificate of occupancy is restored it shall be scheduled for renewal in one year. 37 (F) Fees for Certificate of Occupancy: 38 (1) Original issue, new buildings. There shall be no fee chazged for an issuance of the certificate of 39 occupancy for new buildings at the completion of their construction covered by a building permit. 40 (2) Renewal fee for R-1 occupancies. Nine dollars ($9.00) per residential unit, minimum fee one hundred 41 dollazs ($100.00), maximum fee three hundred seventy dollars ($370.00). The fee chazged for inspections of G] 1 nuisance dwellings as defined in section 42.01(2) of the Legislative Code shall be in an amount as ��—� 2 established by the fire marshal to recover the costs of the inspections. 3 (3) Renewal fee for A(Assembly), E(Education), I(Institutional), H(Hazardous), F(Factory), M 4 (MercantiZe), S(Storage) and B(Business) occupancies. Seven dollazs ($7.00) per one thousand (1,000) 5 squaze feet, minimuxn fee seventy-five doilazs ($75.00), ma�cimum fee three hundred seventy dollars 6 ($370.00). 7 (4) Reinspection fee. The renewal fee established in subsections (2) and (3) above allows for one (1) 8 inspection and one (1) reinspecrion far the renewal of the certificate of occupancy. A reinspection fee of fifty 9 (SO) percent of the renewal fee shall be levied for each additional reinspection required of nonconfomiiug 10 occupancies. 11 (5) Referral reinspection fee. Whenever a written conection order is issued to the owner or responsible 12 agent of the owner for a violation of this code and after a reasonable tune for compliance has elapsed, a 13 reinspection shall be made. If the violarion has not been corrected at the time of the reinspection, a referral 14 reinspection fee of fifty dollars ($50.00) shall be collected for every subsequent reinspection until the 15 violation is corrected. 16 (6) Partial certifzcate of occupancy fee. Notwithstanding subsection (1) of this paragraph (F), a£ee of one 17 hundred tvventy five thi ei t dollars (�9 138.00 will be charged for each partial certificate of 18 occupancy requested. The issuance of a partial certificate of occupancy is at the discretion of the building 19 official and the portion of the building covered by the certificate must be legally completed and ready to 20 occupy along with all other life and safety requirements. 21 (7) No entry fee. A no entry fee of fifty dollars ($50.00) shall be assessed to the renewal fee and collected 22 whenever an owner or responsible agent of the owner has been notified in writing of the date and time for a 23 certificate of occupancy renewal inspection, or any other reinspecrion, and the owner or responsible agent of 24 the owner fails to notify the fire mazshal's office in writing, by at least 8:00 a.m. on the date of the scheduled 25 inspection, of an altemate date and time for the inspection or reinspection when the owner or responsible 26 agent of the owner will appear for the inspection. 27 (8) Discounted fee. Whenever a certificate of occupancy renewal inspection finds no violations of any 28 applicable code, the renewal fees set forth in subsections (2) and (3) of this paragraph shall be discounted 29 twenty-five (25) percent. 30 (9) Late fees. A late fee shall be charged and collected whenever the owner or responsible agent for the 31 owner makes application for certificate renewal after the expiration date of such certificate. Separate late 32 fees shall also be charged and collected whenever the owner or responsible agent for the owner pays late any 33 other fees due and payable under this section. All late fees shall be ten (10) percent of the certificate renewal 34 fee. A late fee shall accrue for each thirty-day period or portion thereof which has elapsed after the 35 expiration date of the certificate or the date of inspection on which the underlying fee is based. In no event 36 shall any one (1) late fee exceed fifty (50) percent of the certificate renewal fee. The late fee(s) shall be in 37 addirion to any other fee or payment required. 38 (G) Exceptions: The fees for the certificate of occupancy and inspection are provided in section 39 33.04(H)(4)(c) and paragraph (F) of this section shall be required on buildings owned and occupied by any 40 governmental agency, including county and sYate governmental agencies. The City of Saint Paul, and any 41 other agencies specifically exempted from such fees under state law, shall be exempt from payment of such 42 fees. 43 Section 3 10 ' ,.. , 2 Section 33.06 of the Saint Paul Legislative Code is hereby amended to read as follows: See. 33.06. Certificate of compliance. 4 (a) The building official may issue a certificate of compliance for any building or structure in Group R-3 or 5 M occupancies when it is determined that such building or structure complies with the provisions of Chapter 6 34 of the Saint Paul Legislative Code. The fee required for issuance of a certificate of compliance shall be 7 one hundred �ve thirtv ei¢ht dollars ($i�5:90 138.00) for a single-family dwelling and one hundred 8 frE�g-six seventv two dollars (�Sfr.66 17$ 2•QOl for a two-family dwelling. 9 (b) The building official may issue a certificate of compliance for any building or structure in Group R-1 10 occupancy, as defined in the Minnesota State Building Code, when it is found that such building or struchue 11 complies with the provisions of Chapter 34 of the Saint Paul Legislative Code.
