Code to clazify that the Library Director serves at the pleasure of the
Mayor, and to modify the budgetary powers previously given to the
Library Agency
THE COUNCIL OF THE CTTY OF SAINT PAUL DOES ORDAIN:
Section 1
Section 14.01 of the Administrauve Code is hereby amended to read as follows:
Section 14.01. Creation of Agency
(a) Pursuant to the authority granted under Laws of Minn. 2002, Chapter 390, § 36, it is hereby
established an independent library agency to be lrnown as the Saint Paul Public Library Agency, a body
corporate and politic, which shall be a governmental subdivision of the State of Minnesota.
(b) There shall be a D'uector of the Saint Paul Public Library Agency, who shall be appointed by the
Mayor, and approved by the City Council, and sha11 be responsible for the administration of the affairs
of the Agency. The Director shall report to the �ibrarq-$o� Mavor and serves at the pleasure of the
Mavar.
(c) The employees of the Saint Paul Public Library Agency shall be employees of the City of Saint
Paul, and shall be entitled to all of the rights and benefits of such employment.
Section 2
Section 14.05 of the Administrative Code is hereby amended to read as follows:
Sec. 14.05. Budaet and Fiscal Matters.

(a) Budget. The Director shall annually prepaze and uansmit a comprehensive budget for
operations, debt service and capital improvements, which shall be presented to the Mayor, for review and
recommendations, by 7une 15�f`of each yeaz. Prior to this, the D'uector shall have presented a needs and
resource assessment to the Library Board, with a list of the Director's priorities, no later than April 1.
The Boazd shall review and present the Board's list of priorities for the next yeu's budget to the Mayor
by May 1. The Mayor will present the proposed library budget to the Library Board and the public within
one week of the City Charter prescribed deadline for the Mayor to submit the City budget to the City
Council. This presentation will take place in a Saint Paul Public Library. The Board will take action t��jg���
approve the budget by November 15u each year. The library budget shall be formally adopted by
December 21'�of each year. �: 14 •Q3
(b) Levy. The City shall, at the request of the library boazd, levy a ta�c in any yeaz for the benefit of
the library agency. Such levy must be separately listed from the remaining amount of the City's levy on Q� ^ SSS
the Truth in Tasation notice of proposed property taxes. A ma�mum library property tax levy for the
year shall be set by September 15rdi.
�c) The Agency shall participate with the Joint Property Tas Advisory Committee, comprised of the
City of Saint Paul, Ramsey County and Independent School District 625, in order to plan for and manage
property taxes levied against the Saint Paul taac base.
(d) The Agency shall be authorized to participate with other community and library organizarions to
pursue federal and state grants, corporate support, and foundation and individual grants. The Agency
will continue to seek partnerships with the Friends of the Saint Pael Pablic Library to pursue grants to
address unmet needs of the library and new initiauves.
(e) The Agency is authorized to accept gifts of money, collection materials and real or personal
property to be used for the direct benefit of the Agency.

(� The Agency will budget through €mdsthat are accounted for and audited separately, independent
of Ciry funds. The Aeencv will not maintain its own cash nool to meet cash flow needs in its operating
budget. The Aeencv's cash flow needs in its ooerating budeet shall be met bv the Citv through pmdent
use of the Citd s cash nool, nursuant to aereement between the Citv and the Aeencv. Such aereement
shall nreclude or siEnificantiv minimize anv cost to the Ciri or the Aeencv resultine from the use of the
City's cash pool.

amendments mav onlv be initiated by the Mavor. The nrovisions of Sections 10.07, 10.071, 10.07.2,
10.073 and 10.07.4 of the Citv Charter and Secuon 57.09 of the Administrative Code applv to the
Aeencv and Mavor, excent that the Board assumes all of the vowers and duties and restrictions that those
sections imnose upon the Citv. Couu���

This ordinance shall take effect and be in force thirty (30) days following its passage, approval
and publication.
