Code Chapter 271 Pertaining to Disorderly Houses
The Council of the City of Saint Paul Does Ordain:
Section 1.
That Saint Paul I.egislative Code Chapter 271 entitled "Disorderly Houses" is hereby amended to
read:
Sec. 271.01. Disorderiy house de�ned.
A disorderly house in this chapter means any building, dwelling, place, establishment or premises
in which actions or conduct occur in violation of any law or ordinance relating to the following:
(1) Sale or regulation of intoxicating liquor or nonintoxicaung malt liquor.
(2) Gambling.
(3) Prostitution, solicitation to vice, or lewd and indecent behavior.
(4) Sale or use of drugs or controlled substances.
If the building, dwelling, place, establishment or premises is a multi-unit dwelling or residence,
hotel, or motel, or commercial or office building, this definition only includes the dwelling unit,
room or suite of rooms in the hotel or motel, office rooms or suite, or store in which the actions
or conduct occur.
Sec. 271.02. Operation.
No person shall own, operate, manage, maintain or conduct a disorderly house, or invite or
attempt to invite others to visit or remain in such disorderly house.

violation of anv law or ordinance relatin¢ to those enumerated in Sec. 271.01.
Sec.271.04. Evidence.

Evidence of unlawful sales of intoxicating liquor or nonintoxicaring malt liquor, or of gambling
or acts relaUng to gambling, shall be prima facie evidence of the existence of a disorderly house.
Evidence of sales of intoxicating liquor or nonintoxicating malt liquor between the hours of 1:00
a.m. and 8:00 a.m., while a person is within such disorderly house, shall be prima facie evidence
such person knew it to be a disorderly house. Evidence of sales or use of drugs or controlled
substances shall be prima facie evidence of the existence of a disorderly house. Evidence of the
sales or use of drugs and/or controlled substances may include, but is not limited to, the presence
in the house of devices for smoking cocaine or marijuana, scales, sieves or sifters for such drugs,
drug pazaphernalia as defined in section 255.01 of this Legislarive Code, and other items found in
proximity to drugs or controlled substances or containers having trace amounts of drugs or
controlled substances (such items to include tubes, test tubes, forceps, cotton balls, plastic bags,
minors and razor blades).

Sec. 271.05. Disorderly conduct.
No person or persons within the City of Saint Paul shall commit ar suffer to be committed, in any
house or other building or premises by him or her or them occupied, any rioting, quarreling,
fighting, revelling, drunkenness or any other disorderly conduct, calculated to disturb the
neighborhood, or any travelers or others.
Section 2
This amending ordinance shall become effecrive thirty (30) days after its passage,
approval and publication
