Section 246.03 of the Saint Paul I.egislative Code is hereby amended to read as follows:
Sec. 246.03. Not applicable on licensed premises.
(a) This chapter shall not apply to or prohibit the sale, possession or consumption of such
liquors or beverages on the premises of any establishment properly licensed under
Chapter 409 or Chapter 410 of the Saint Paul I.egislative Code.
(b) Notwithstanding the prohibitions of section 246.01, the sale and service of alcoholic
beverages within a sidewalk cafe by a food establishment
, which is licensed as a restaurant under Chapter 331A of
the I.egislative Code and which is in compliance with the provisions of section 106.01 of
the I.egislative Code, is pernutted.
(c) The prohibitions of section 246.01 shall not apply to or prohibit the possession or
consumprion of nonintoxicating malt liquor, strong beer or wine purchased and consumed
during a block party, festival or community event which has been duly licensed under
Chapter 366 of the L.egislative Code, when such possession or consumption occurs on a
street which has been blocked off far the block party, festival ar community event in the
downtown business district and the nonintoxicating malt liquor, strong beer or wine is
purchased from a duly licensed vendor.

34 (d) Notwithstanding the prohibitions of section 246.01, the director of the division of parks
35 and recreation may authorize the sale or service of alcoholic beverages on property under
36 its jurisdiction by either a person who is the holder of a state catering pernut and who has
37 complied with the provisions of Saint Paul Legislative Code § 409.01 or by the hoider of

�������t�mporary wine and liquor license issued pursuant to § 409.25 ar temporary 3.2 beer 03 -3R�
2 license issued pursuant to § 410.10, except that in no event can the prohibitions contained'
3 in section 246.05 be waived. Such sale or service must be in connection with an event of
4 limited durarion which has been approved by the director of parks and recreation and is
5 subject to all other requirements and restricrions contained in Minn. Stat. Chapter 340A
6 and Saint Paul I.egislative Code Chapters 409 and 410.

11 This ordinance shall take effect and be in force thirly (30) days following its passage,
12 approval and publication.

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, Wliat, When, Where, Why):
Currently a commercial development district needs to be created if a business
outside of downtown wishes Co establish a sidewalk cafe with alcohol on sale.
This is a very cumbersome and lengthy process requiring a change in the Saint
Paul City Charter and a Special City Council Meeting for each individual
address wishing to establish a commercial development district. This
legislation allows sidewalk cafes to serve alcohol throughout the city.
VANTAGES IF APPROVED:
Streamlining of the process necessary for restaurants to have sidewalk dining
and sidewalk liquor licenses. More outdoor dining in the City of Saint Paul
reating a more hospitable atmosphere for visitors.
ISADVANTAGES IF APPROVED:
rgument by some that alcohol would be easier for minors to obtain and that
there would be more alcohol consumption in general.
ISADVANTAGES IF NOT APPROVED:
