WHY): In the vast majority of cases, the W ater Board has the authority to shut off water service to properties who fail to pay their water and sewer bill. However, in cases where a property is served by both their own well and city water, the customer can elect to pay oniy the city water and sewer portion. In that case, the only remedy for nonpayment of sewer charges on private water use is to certify the delinquent amount to the County for collection with their property taxes. This ordinance amendment will allow the Water Board to initiate shut off procedures of their city water service if any sewer bill is delinquent on a properry with both city and private water sources for more than thirty days. YES ACINITY NUMBER NO FINANCIAI INFORMATION: (EXPLAIN) � ls��� OZ,- Soa BOAAD OF WATER COMMI55{ONERS RESOLUTION — GENERAL fORM PRESENTEO ev Blakey COMMISSIONER No 4827 April 9, 2002 WHEREAS, Board of Water Commissioners (`Boazd") staff recommends that Sections 41.12 and 91.14 of the Saint Paul Legislative Code ("Code") be amended to include sewer service charges when unpaid service chazges are evaluated for certification to properry taxes or shutoff; and WHEREAS, Board staff has prepared a City of Saint Paul Ordinance ("Ordinance") which amends the Code to provide for this addition, copy of the Ordinance being attached hereto and incorporated herein;and WHEREAS, the Ordinance has been reviewed and recommended far approval by Saint Paul Regional Water Services General Manager, and the form has been approved by the Assistant City Attorney; now, therefore, be it RESOLVED, that the Board of Water Commissioners does hereby approve the attached Ordinance amending Chapter 91 of the Saint Paul Legislative Code; and, be it FURTHER 12ESOLVED, that the Board of Water Commissioners does hereby request that the Honorable Council of the City of Saint Paul approve and adopt said Ordinance.
