preserving the status quo with respect to the use of property in the azea presently
under study for Irvine Avenue pending completion of the study and any possible

THE COUNCIL OF THE CITY OF SA1NT PAUL DOES ORDAIN:
Section 1
8 Statement of le�islative intent: The City of Saint Paul's 1999 comprehensive municipal plan conrinues
9 Saint Paul's legacy of strong neighborhood areaplanning. State lawrequires city zoning regulations to be consistent
10 with the ci,ty's comprehensive plan. The 14991and use component of the comprehensive plan ca11s for refining
11 neighborhood area planning srixdies to insure that any amendments to the zoning code resulting from neighborhood
12 area studies conform with the comprehensive plan.
13 In keeping with the city's uadition of neighborhood area planning, a study of Irvine Avenue has been undertaken,
14 at the request of the Ciry Council (File #O 1-1013) and is neazing completion. The said study will require planning
15 commission review and recommendation and Council approval before it is adopted as part of the comprehensive
16 plan.
17 Pending the deparhnent of planning and economic developmenYs completion of the said study, a planning
18 commission recommendation to amend the City's comprehensive plan and zoning code and the Council's adoption
19 of such recommendations and for the overail purpose of protecting the City's planning process, a moratorium of
20 limited duration must be enacted for the purpose of prohibiting developments which may be inconsistent with
21 comprehensive plan development objectives for the Irvine Avenue area.

Section 2
Moratorium imnosed; lands affected: Pending completion of the said study and any other necessary
studies or study recommendations, and the adoption of any amendments to the comprehensive pian and zoning code
based upon the study or studies as provided under Minnesota Statute § 462355, Subd. (4), the issuance of plan
approvals and lot splits or building and zoning permits for any zoned parcel of land or part of thereof in the area
bounded by Summit Avenue, Western Avenue, Ramsey Hill, Pleasant Avenue and the public stairs as depicted on
the attached map, shall be prohibited for a period of time not to exceed six (6) months from the effective date of this
ordinance. Until such tune as the said study has been completed and the Council has reviewed its recommendations
far possible adoption, city departments receiving written applicarions for the items noted above sha11 accept the
applicafions and immediately process the applications in accordance with the provisions of Minn. 5tat. § 15.99,
Subd. 2 and with the intent of this interim ordinance.

2 Moratorium. exem hn •ons: The following aze exempted from the moratorium provisions imposed under

4 1. Building, plumbing, mechanical and electrical permits for repairs or minor alterations to confonning or
5 non-conforming structures, or for work on dangerous or vacant buiidings admiuistered under Legislative
6 Code Chapter 43.
2. Building, plumbing, mechanical and electricat pernuts for repairs or minor alterations to conforini.ng or
non-confornung structures, or for work necessary to maintain health and safety of occupants.
9 3. Demolition pernuts for nuisance buildings pursuant to Legislative Code Chapter 45.
10 4. Building permits for permitted, non-residential or non-commercial accessory structures as defined in
11 Legislative Code § 60.201.A.

2 Commission's Irvine Alley Study Area dated March 5, 2002.

5 The restrictions enacted herein may be extended by the Council of the City of Saint Paul for additional
6 periods not to exceed an additional eighteen (18) months in the event the studies and recommendations of the
7 Planning Commission and the deliberations of the Saint Paul City Council require such e�tensions.
