WHEREAS, Pursuant to Minnesota Statutes {462357 and 64.400 of the Legislative Code, Mike Leimer duly
petitioned to rezone property at 959 Randolph being legally described as PIN 11-28-23-24-0202, Lot 21,
Block 12, Michel and Robertson's Addition, from RM-2 (multiple family) to B-3 (general business) to allow
for the expansion of Leitner's Garden Center pazking lot, the petition having been certified by the Planuing
Division on 06/OS/O1 as having been consented to by at least 67% of the owners of the area of the properiy to
be rezoned, and further having been consented to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous property within one year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on 10/11/Ol, held a public hearing for the
purpose of considering the rezoning petifion, and pursuant to { 107.03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be granted; and
16 WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on 10/19/O1 and

WHEREAS, notice of public hearing before the City Council on the said rezoning petirion was duly
published in the official newspaper of the City on 11 /02/O l and notices were duly mailed to each owner of
affected property and property situated wholly or partly within 350 feet of the property sought to be rezoned;
and
WHEREAS, a public hearing before the City Council having been conducted on 11/14/Ol, where all
interested parties were heard, the Council having considered all the facts and recommendations concerning
the petition; now, therefore

WHEREAS, Mike Leitner, File #01-222-995, has applied under the provisions of
§64.400 of the Saint Paui Legislative Code, to rezone property �ocated at 959
RAfVDOLPH (between M+iton and Chatsworth) (PIN # 11-28-23-24-020 legaliy
described as Lot 21, Block 12, Michei and Robertson's Addition, in Ramsey County,
from RM-2 to B-3 to allow the expansion of Leitner's Garden Center parking lot; and
WHEREAS, the Zoning Committee of the Pianning Commission, on October 11, 2001,
held a public hearing at which all persons present were given an opportunity to be ,
heard pursuant to said application in accordance with the requirements of §64.300 of
the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to
its Zoning Committee at the public hearing as substantially reflacted in the minutes,
made the following findings of fact:
1. The property at 959 Randolph is located in a RM-2 district, adjacent to a B-3
zone, It is currently a house. The applicant acquired the site because it is
adjacent to the existing business. Additional parking lot and storage space is
necessary to better serve and more safely serve customers. Additionai parking
will also reduce on-street parking in front of neighboring houses.
2. The property was built by the Leitner family in the late 1800's. It was sold to the
most recent owner in 1958. Due to soil conditions, and the owner's failure to
rebuild the foundation, the building has decayed to unsafe conditions.
3. The proposed zoning is compatible and consistent with the development
proposed for the site and with the adjacent B-3 zoning and commercial land. use.
4. The use is not inconsistent with the provisions of the comprehensive pian.
5. The code provides that an application for rezoning must be accompanied by a

consent petition of the owners of two thirds of the properties within 100 feet of
the property to be rezoned_ Twenty signatures were required. Twenty-one were
received.
6. Under the authority of Section 64.300(b) of the Zoning Code and in conformance
with Pianning Commission Resolution 84-23 delegating authority for the approval
of special condition use permits to the Planning Administrator in all cases where
public hearings have been held in which the Commission has recommended and
the City Council approved a rezoning specifically for a"Special Condition Use,"
the application for a Special Condition Use Permit for expansion of the Leitner's
Garden center parking lot and outdoor storage of bagged products will be
approved by the Planning Administrator once the rezoning is approved by City •
Council.

NOW, THEREFORE, BE IT RESOLVED, by the Saint Paui Planning Commission, that
the application of Mike Leitner to rezone property at 959 RANDOLPH (between Milton

Chair Morton announced Commissioner Johnson is going to be the Co-chair of the Irvine
Avenue Small Area Pian and Commissioner Fotsch wiil be the Co-chair of the Arcade Street
Small Area Plan.
Planning Administrator's Announcements
Mr. Soderholm said how pleased he is to see work now underway at both the West Side Fiats
and the Upper Ladding sites. Five years ago, working on the citywide I.and Use Plan, the
Commission believed that if just one of the proposed urban village sites around the downtown
edges could be built and demonstrate success, then over a period of years the other urban village
sites could come on line. Today, three of them are underway, with the North Quadrant already
selling homes.
Mr. Soderholm announced up-coming communiry meetings for planning projects:
- The Plam�ing Commission has received an invitation to a celebration for the acquisition of
the Trillium Site on Thursday, October 25�' at 5:30 p.m.
— Riverboat Tour on the Mississippi on November 2" arranged by Metro Councii.
— Urban Village Zoning public review draft, two meetings scheduled for community people to •
learn about it on November 1" and 5`" at 7:00 p.m.
— City Council budget hearing on November 7`" at 5:30 p.m.
— Metro Greenway Award presentation on November IS'" at 9:00 a.m. at the L.ower Phalen
Creek Site.
— Universiry of St. Thomas EAW: Planning Commission public hearing on November 7'�,
7:OO,p.m., at Olin Rice Atrium at Macalester College.
Mr. Soderholm gave an update on the Buffalo Sober House case. The City Council upheld the
Commission's decision allowing 16 residenrs. That was vetoed by the Mayor, but his veto was
then ovenidden. The Ciry action allows 16 residents. The group home operators appealed to
district court, claiming fl�at they must have 24 residents, and the judge has enjoined the City
from enforcing the 16-resident-limit until after the court has heazd the case.
Mr. Soderholm reported on City Council actions taken this week:
— Tiger 7ack Rosenbloom's retail premises has become a historic monument that will be given
to the Minnesota Historical Sociery and preserved as an example of smali business on or ,
near Rondo Avenue.
— The City Council is proceeding with acquisition of the Lower Phalen Creek Site from the
Burlington-Northem Santa Fe.
— The zoning cases aze moving ahead. ,
— There was a policy discussion about parking and transit in ihe downtown.
Next Mr. Soderholm gave highlights of the City Council Agenda for next week: �
— Final plat for the Walnut Ridge housing development on the West Side.
— Soil clean-up budget applications for the Parkway (Johnson Liquor) housing site and for the
Lowertown Biuffs housing conversion of the warehouse near the Lower Phalen Creek Site.
— Adoption of the Trout Brook/I.ower Phalen Creek Plan.
— Lincoln Pawn Shop on White Bear Avenue is the subject of an adverse action.
— Redevelopment plans for the District del Sol and Koch-Mobil are being adopted.
— Parking for J.J. Hifl historic buildina and the historic preservation appeal about the We(ls
Fargo building on Kellogg Blvd.
Mr. Soderholm stated he found on the internet that the Seattle Comp Plan of 1994 set a goal of
having 25 percent of all new housing units in the Seattle metro area built in the central city of
Seattle. They had been at six percent. Last yeaz they captured 44 percent of atl of the new
housing, with about half in the downtown and the other half in Seattle nei�hborhoods, for a total
of 14,700 new units built in the central city during one yeaz.

inappropriate methodology to accomp(ish what they wished to accomplish at this site. The SCUP
is a much better approach.

Mr. Joel Spoonheim showed slides and presented the staff report. Mr. Spoonheim stated that the
zoning staff recommends approvai of the rezoning. Mr. Spoonheim explained that under the
Zoning Code the planning administrator has the authority where pubiic hearings have been held
to recommend and act on the Special Condition Use Permit. The information has been provided
to the Planning Commission and all the conditions are met. W ith the approval of the rezoning, the
zoning staff will administratively review and approve the Special Condition Use Permit.
Mr. Mike Leitner, the applicant appeared and stated he would answer any questions.
No one spoke in support or opposition.
The pubiic hearing was closed.
Commissioner Alton moved approval of the rezoning. Commissioner Faricy seconded it.
The motion passed by a vote of 8-0.

It is currently a house. The applicant acquired the site because it is adjacent to the
existing business. Additional pazking lot and storage space is necessary to better
serve and more safely serve customers. Additional parking will also reduce on-street
parking in front of neighboring houses.
2. The property was built by the I.eitner family in the late 1800's. It was sold to the
most recent owner in 1958. Due to soil conditions, and the owner's failure to rebuild
the foundation, the building has decayed to unsafe conditions.
3. The proposed zoning is compatible and consistent with the development proposed �
for the site and with the adjacent B-3 zoning and commercial land use.
4. The use is not inconsistent with the provisions of the comprehensive plan.
5. The code provides that an application forrezoning must be accompanied by a consent
petition of the owners of two thirds of the properties within 100 feet of the property
to be rezoned. Twenty signacures were req�ired. Twenty-one were received.

H. FINDINGS:
The property at 959 Randolf is located in a RM-2 district, adjacent to a B-3 zone. It
is currently a house. The applicant acquired the site because it is adjacent to the
existing business. Additional parking lot and storage space is necessary to better
serve and more safely serve customers.
2. Section 60.564(5) states "Greenhousesfor the retail sale of plants grown on the site,
and sales of lawn furniture, playground equipment and garden supplies subject to
the following conditions: �
a. The storage or display of any materials or products shnll meet all setback
requirements of a structure.
The condition is met. The code (section 61.103) specifies a six foot setback on side
yards for the building and parking.
b. Al1 loading and parking shalt be provided off-street.
The condition is met
c. The storage of any soil, fenilizer or other loose, unpackaged marerials shall
be cbntained so as to prevent any effects on adjacent uses.
The condition is met. I.eimer's has stored products outside for years without a
problem. Products aze bagged, not loose.
3. Section 64300(d) of fhe zoning code reqaiies that befote the planning commission
may grant approval of a principal use subject to special conditions, the commission

a. The extent, location and intensity of the use widl be in substantial correpliance
with the Saint Paul Comprehensive Plan and any appZicable subarea plans
which were approved by the city council.
The condition is met. Randolph is a mixed use corridor where auto-related uses aze
allowed.
b. The use will provide adequate ingress and egress to minimize traffic
congestion in the public streets.
The condition is x�a�+-b�met. LIEP and Public Works staff reviewed the site plan
and approved it.
c. The use will not be detrimental to the existing character of the development
in the immediate neighborhood or endanger rhe public health, safety and
general welfare.
� The condition is met. Other commercial uses are located on Randolph.
d. The use will not impede the normal and orderly development and
improvement of the surrounding property for uses permitted in the district.
The condition is met. As I,eitner's has been a strong community business in the past,
additional pazking space will only improve the service to the community and reduce
parking impacts on adjacent properties.
e. The use shall, in aIl other respects, conform to the applicable regulations of
the district in which it is located.
The condition is met, as noted in the paragraphs above.

WHEREAS, Pursuant to Minnesota Statutes {462357 and 64.400 of the Legislative Code, Mike Leimer duly
petitioned to rezone property at 959 Randolph being legally described as PIN 11-28-23-24-0202, Lot 21,
Block 12, Michel and Robertson's Addition, from RM-2 (multiple family) to B-3 (general business) to allow
for the expansion of Leitner's Garden Center pazking lot, the petition having been certified by the Planuing
Division on 06/OS/O1 as having been consented to by at least 67% of the owners of the area of the properiy to
be rezoned, and further having been consented to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous property within one year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on 10/11/Ol, held a public hearing for the

WHEREAS, Mike Leitner, File #01-222-995, has applied under the provisions of
§64.400 of the Saint Paui Legislative Code, to rezone property �ocated at 959
RAfVDOLPH (between M+iton and Chatsworth) (PIN # 11-28-23-24-020 legaliy
described as Lot 21, Block 12, Michei and Robertson's Addition, in Ramsey County,
from RM-2 to B-3 to allow the expansion of Leitner's Garden Center parking lot; and
WHEREAS, the Zoning Committee of the Pianning Commission, on October 11, 2001,
held a public hearing at which all persons present were given an opportunity to be ,
heard pursuant to said application in accordance with the requirements of §64.300 of
the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to
its Zoning Committee at the public hearing as substantially reflacted in the minutes,
made the following findings of fact:
1. The property at 959 Randolph is located in a RM-2 district, adjacent to a B-3
zone, It is currently a house. The applicant acquired the site because it is
adjacent to the existing business. Additional parking lot and storage space is
necessary to better serve and more safely serve customers. Additionai parking
will also reduce on-street parking in front of neighboring houses.
2. The property was built by the Leitner family in the late 1800's. It was sold to the
most recent owner in 1958. Due to soil conditions, and the owner's failure to
rebuild the foundation, the building has decayed to unsafe conditions.
3. The proposed zoning is compatible and consistent with the development
proposed for the site and with the adjacent B-3 zoning and commercial land. use.
4. The use is not inconsistent with the provisions of the comprehensive pian.

6. Under the authority of Section 64.300(b) of the Zoning Code and in conformance
with Pianning Commission Resolution 84-23 delegating authority for the approval
of special condition use permits to the Planning Administrator in all cases where
public hearings have been held in which the Commission has recommended and
the City Council approved a rezoning specifically for a"Special Condition Use,"
the application for a Special Condition Use Permit for expansion of the Leitner's
Garden center parking lot and outdoor storage of bagged products will be
approved by the Planning Administrator once the rezoning is approved by City •

Chair Morton announced Commissioner Johnson is going to be the Co-chair of the Irvine

Planning Administrator's Announcements
Mr. Soderholm said how pleased he is to see work now underway at both the West Side Fiats
and the Upper Ladding sites. Five years ago, working on the citywide I.and Use Plan, the
Commission believed that if just one of the proposed urban village sites around the downtown
edges could be built and demonstrate success, then over a period of years the other urban village
sites could come on line. Today, three of them are underway, with the North Quadrant already
selling homes.
Mr. Soderholm announced up-coming communiry meetings for planning projects:
- The Plam�ing Commission has received an invitation to a celebration for the acquisition of
the Trillium Site on Thursday, October 25�' at 5:30 p.m.
— Riverboat Tour on the Mississippi on November 2" arranged by Metro Councii.
— Urban Village Zoning public review draft, two meetings scheduled for community people to •
learn about it on November 1" and 5`" at 7:00 p.m.
— City Council budget hearing on November 7`" at 5:30 p.m.
— Metro Greenway Award presentation on November IS'" at 9:00 a.m. at the L.ower Phalen
Creek Site.
— Universiry of St. Thomas EAW: Planning Commission public hearing on November 7'�,
7:OO,p.m., at Olin Rice Atrium at Macalester College.
Mr. Soderholm gave an update on the Buffalo Sober House case. The City Council upheld the
Commission's decision allowing 16 residenrs. That was vetoed by the Mayor, but his veto was
then ovenidden. The Ciry action allows 16 residents. The group home operators appealed to
district court, claiming fl�at they must have 24 residents, and the judge has enjoined the City
from enforcing the 16-resident-limit until after the court has heazd the case.
Mr. Soderholm reported on City Council actions taken this week:
— Tiger 7ack Rosenbloom's retail premises has become a historic monument that will be given
to the Minnesota Historical Sociery and preserved as an example of smali business on or ,
near Rondo Avenue.
— The City Council is proceeding with acquisition of the Lower Phalen Creek Site from the
Burlington-Northem Santa Fe.
— The zoning cases aze moving ahead. ,
— There was a policy discussion about parking and transit in ihe downtown.
Next Mr. Soderholm gave highlights of the City Council Agenda for next week: �
— Final plat for the Walnut Ridge housing development on the West Side.
— Soil clean-up budget applications for the Parkway (Johnson Liquor) housing site and for the
Lowertown Biuffs housing conversion of the warehouse near the Lower Phalen Creek Site.
— Adoption of the Trout Brook/I.ower Phalen Creek Plan.
— Lincoln Pawn Shop on White Bear Avenue is the subject of an adverse action.
— Redevelopment plans for the District del Sol and Koch-Mobil are being adopted.
— Parking for J.J. Hifl historic buildina and the historic preservation appeal about the We(ls
Fargo building on Kellogg Blvd.
Mr. Soderholm stated he found on the internet that the Seattle Comp Plan of 1994 set a goal of
having 25 percent of all new housing units in the Seattle metro area built in the central city of
Seattle. They had been at six percent. Last yeaz they captured 44 percent of atl of the new
housing, with about half in the downtown and the other half in Seattle nei�hborhoods, for a total
of 14,700 new units built in the central city during one yeaz.

zoning staff recommends approvai of the rezoning. Mr. Spoonheim explained that under the
Zoning Code the planning administrator has the authority where pubiic hearings have been held
to recommend and act on the Special Condition Use Permit. The information has been provided
to the Planning Commission and all the conditions are met. W ith the approval of the rezoning, the
zoning staff will administratively review and approve the Special Condition Use Permit.
Mr. Mike Leitner, the applicant appeared and stated he would answer any questions.
No one spoke in support or opposition.
The pubiic hearing was closed.

Under the authority of Section 64.300(b) of the Zoning Code and in conformance with
Planning Commission Resolution 84-23 delegating "authority for the approval of
special condition use permits to the Planning Administrator in all cases where public
hearings have been held in which the Commission has recommended and the City
Council approved a rezoning specifically for a`Special Condition Use'," this
application for a Special Condition Use Permit for expansion of the Leitner's Garden
center parking lot and outdoor storage of bagged products will be approved by the
Planning Administrator once the rezoning is approved by City Council.

permit Greenhouses in a B-3 zone subject to special conditions. These conditions and the
applicant's ability to meet them aze detailed in the Findings section of this report.

G. DISTRICT COITNCIL RECONINIENDATION: The Fort Road Federation (District 9)
is not taking a position due to neighbor's support.
H. FINDINGS:
The property at 959 Randolf is located in a RM-2 district, adjacent to a B-3 zone. It
is currently a house. The applicant acquired the site because it is adjacent to the
existing business. Additional parking lot and storage space is necessary to better
serve and more safely serve customers.
2. Section 60.564(5) states "Greenhousesfor the retail sale of plants grown on the site,
and sales of lawn furniture, playground equipment and garden supplies subject to
the following conditions: �
a. The storage or display of any materials or products shnll meet all setback
requirements of a structure.
The condition is met. The code (section 61.103) specifies a six foot setback on side
yards for the building and parking.
b. Al1 loading and parking shalt be provided off-street.
The condition is met
c. The storage of any soil, fenilizer or other loose, unpackaged marerials shall
be cbntained so as to prevent any effects on adjacent uses.
The condition is met. I.eimer's has stored products outside for years without a
problem. Products aze bagged, not loose.
3. Section 64300(d) of fhe zoning code reqaiies that befote the planning commission
may grant approval of a principal use subject to special conditions, the commission
shall find that: •

a. The extent, location and intensity of the use widl be in substantial correpliance
with the Saint Paul Comprehensive Plan and any appZicable subarea plans
which were approved by the city council.
The condition is met. Randolph is a mixed use corridor where auto-related uses aze
allowed.
b. The use will provide adequate ingress and egress to minimize traffic
congestion in the public streets.
The condition is x�a�+-b�met. LIEP and Public Works staff reviewed the site plan
and approved it.
c. The use will not be detrimental to the existing character of the development
in the immediate neighborhood or endanger rhe public health, safety and
general welfare.
� The condition is met. Other commercial uses are located on Randolph.
d. The use will not impede the normal and orderly development and
improvement of the surrounding property for uses permitted in the district.
The condition is met. As I,eitner's has been a strong community business in the past,
additional pazking space will only improve the service to the community and reduce
parking impacts on adjacent properties.
e. The use shall, in aIl other respects, conform to the applicable regulations of
the district in which it is located.
The condition is met, as noted in the paragraphs above.
I. STAFF RECOMMENDATION: Based on the findings above, staff recommends approval
of the application for a Special Condition Use permit to allow outdoor storage of bagged
products for L.eitner's Gazden Center at 959 Randolph Avenue.
