Excep[ as hereinafter provided, the head of each executive department shall be appointed and removed as provided by Section 3.013, and shall have such educational and professional qualifications as may be prescribed by ardinance. If an executive department so established shall be restricted in function to police activities, then, and only in such event, the chief of police appointed pursuant to Section 12.12 shall be head of such department. Every office, agency or function of city government not otherwise assigned by this Charter or by ordinance shall be included in the office of the mayor, and no power or duty confened by this Charter upon a particular office or agency shall be transfened to any other. The language was submitted to the Commission by the Charter Revision Committee, a subcomxnittee of the Commission. After two readings, the Commission voted to submit the ordinance to the Council pursuant to Minn. Stat. §41 Q.12, subd. 7. It was requested that the Charter Commission's reasons for the proposal be provided to CouncIl members in writing. The Charter Commission has reviewed the proposed amendment at its meeting in September and again in October and voted unanimously to recommend the change to strike the words: ". .. not to exceed six (6)" in Section 9.01 REASONS FOR CHANGE 1. It is a"housekeeping" change to make the Charter designation of administrative strucwres consistent with cunent operating practices. 2. Specifically setting the nuinber of departments in the Charter is an artificial limitation on the flexibility needed manage the functions of city government as conditions change. 3. The philosophy for a basic governing charter has been defined by the L,eague of Minnesota Cities as "A city charter shouid deal only with the fundamentals of govemmental organization of the clty and leave the council free to exercise its grant of authoxity by ordinancz." This would include specific lunitations which may become obsolete, or ignored. 4. On the City Web page, under the "Departments" heading there are actually 22 different entities listed. Five of them are formally defined as "departments" but Community Services is not listed at all. Others are very large, manage many assets and function as departmants. For instance, Parks and Recreat3on is named a"Division" yet iYs manager is appointed by the mayor and holds the title of "department director." There is also a"deputy director." 5. In the St. Paul I,eague of Women Voters' study of the City Charter, one of the fmdings from interviewing a large cross-section of off'icials and former mayors who have worked under the City Charter, limiting the number of departments in the Ciry Charter is inflexible and often circumvented in actual practice. In comparing ciues of a similar size, the study found that six is a very small number of departments. 6. In former management theory the thought had been that six departments was the optimal span of control for one chief administrator to manage. Specifically setting the nuinber of departments in the Charter is an artificial limitation on the flexibility needed manage the functions of city government as conditions change. 3. The philosophy for a basic governing charter has been defined by the L,eague of Minnesota Cities as "A city charter shouid deal only with the fundamentals of govemmental organization of the clty and leave the council free to exercise its grant of authoxity by ordinancz." This would include specific lunitations which may become obsolete, or ignored. 4. On the City Web page, under the "Departments" heading there are actually 22 different entities listed. The Charter Commission approved the language by a majority vote of its members. The language was submitted to the Commission by the Charter Revision Committee, a subcommittee of the Commission. After two readings, the Commission voted to submit the ordinance to the Council pursuant to Minn. Stat. §41012, subd. 7. It was requested that the Charter Commission's reasons for the proposal be provided to Council members in writing.
