That Section 2 of C.F. No. 00-1043 be amended to read:

15 Moratorium imposed; lands affected, exce tion: Pending compietion of the said study
16 and any other necessary studies or study recommendarions, and the adoption of any amendments
17 to the comprehensive plan and zoning code based upon the study ar studies as provided under
18 Minn. Stat. § 462.355, Subd. (4), the issuance of plat approvals and lot splits or building and
19 zoning permits for any parcel of land or part thereof within the areas of the White Bear Avenue
20 Study Area shall be prohibited for a period of time not to exceed twelve (12) months from the
21 e£fective date of this ordinance. However, the moratorium imposed herein sha11 not rop hibit
22 Sem,�er Development, Ltd. from ap�l�ing for and receivin�permits or approvals necessar�o
23 undertake the construction of a W igreens Drug Store at the southeast corner of White Bear
24 Avenue and Hudson Road. The �roposed dru�store will be scaled and desiened to serve
25 customers from the immediate White Bear Avenue communitv. A neiehborhood drue store is
26 the type of desirable use which has served the needs of the White Bear Avenue communitv and
27 which should be consistent with the future recommended characteristics of the White Bear
28 Avenue Corridor. This tYpe of development should not be limited durin�? the studv.
