11 Saint Paul Legislative Code §225.04 is hereby amended to read as follows:

14 See. 225.04. Carrying firearms.

16 (a) No person shall carry on his person, or have in his possession or
17 control in any public place, any firearm except as provided in section
18 225.06, and except the following persons:
19
2Q (1) Peace officers.
21
22 (2) Military personnel while on duty.
23
24 (3) Persons holding permits to carry a firearm pursuant to section
25 225.05 while carrying on their occupations.
26
27 (4) Employees of the Como Zoo and persons working under the supervision
28 and control of the director of said zoo while carrying on the
29 duties of their occupations.

31 �� Animal Control Officers, while carr�ing on the duties of their
32 occupation.

34 (b) For the purposes of this chapter, ��public place" includes private
35 gatherings in buildings or locations not ordinarily considered public
36 places if, on the occasion of the gathering, ten (10) or more unrelated
37 persons are present, but "public place" shall not include private
38 residences, premises licensed for the sale of firearms, activities held
39 under the sponsorship of a registered target shooting or sportsmen's

2 events for which a permit has been issued by the chief of police.

4(c) No person shall carry or transport any firearm while under the in£luence
5 of drugs or alcohol.

12 Sec. 225.10. Discharge of £irearms.

14 (a) When discharge permitted. No firearm shall be discharged or attempted to
15 be discharged within the city save in the following cases:
16
17 (1) In lawful defense of person or property against an unlawful act.
18
19 (2) By persons holding permits to carry a firearm pursuant to section
20 225.05, peace officers or military personnel in the course of their
21 duties and in necessary connection with enforcement of the laws.
22
23 (3) Discharge of blank ammunition in connection with a public event for
24 which a permit has been issued under section 225.09(3) or as a
25 starter's gun for an organized athletic event.
26
27 (4) Upon an indoor target range operated under the supervision of a
28 registered target shooting or sportsmen's club.
29
30 (5) Upon an outdoor target range operated under the supervision of a
31 registered target shooting or sportsmen's club where shotguns are
32 used.
33
34 (6) In connection with a licensed carnival, where the weapon is so
35 secured as to prevent its being fired except within the confines of
36 an enclosed range impervious to the passage of bullets.
37
38 (7) By employees of the Como Zoo in the course of their duties.
39
40 �8) By emplovees of the Animal Control Division in the course of their
41 duties.

43 (b) Acts deemed attempt to discharge firearm. For the purposes of this
44 section, any person who does any of the following acts is guilty of an
45 attempt to discharge a firearm:
46
47 (1) The person draws a loaded firearm from a bag, holster or any other
48 container or place of concealment;
49
50 (2) The person draws an unloaded firearm from a bag, holster or any

other container or place of concealment and the ammunition for such
firearm is readily available;

(3) The person points a loaded firearm at or toward their person,
another person, an object or skyward;
(4) The person points an unloaded firearm at or toward their person,
another person, an object or skyward and the ammunition for such
firearm is readily available;
(5) The person is carrying a firearm in a public place, or transporting
a firearm in a vehicle in a public place, in a manner that would
violate section 225.06 of this Code if that section governed the
carrying or transport of firearms and the firearm was loaded or the
firearm was unloaded and the ammunition for such firearm is readily
available;
(6) The person is in possession of a firearm in a room where controlled
substances are found and the firearm was loaded or the firearm was
unloaded and ammunition for such firearm is readily available;
(7) The person does any other act, with the intent to discharge a
firearm, which constitutes a substantial step toward and is more
than preparation for the discharge of a firearm.
Definitions. For the purpose of this section, the following terms have
the meaning given them:
(1) Readily available With respect to ammunition, this term shall mean
any ammunition in the person's possession, or within the person's
reach, whether boxed or otherwise, or in any device designed for
rapid loading of the firearm.
(2) Controlled substance shall be defined by the provisions of
Minnesota Statutes, section 152.01, subdivision 4.

2 defining firearms and handguns.
