11 Section 33.02 of the Saint Paul Legislative Code is hereby amended to read as follows:

13 Sec. 33.02. Mfinnesota State Building Code--Adoption.
14 (a) Pursuant to Minnesota Statutes, Secrions 16B.59 through 16B.73, the Minnesota State Building Code, as
15 adopted pursuant to laws of Minnesota, is hereby adopted by reference.
16 (b) The following appendix is not a mandatory part of the Minnesota State Building Code, but is adopted by
17 reference for the City of Saint Paul and is incorporated into this chapter as if set out in full: Uniform Building Code
18 Appendix Chapter 33.
19 (c) Chapter 5230 of the Minnesota Rules, "Steamfitters Rules and Code for Power Piping Systems," as amended, is
20 adopted by reference by the City of Saint Paul and incorparated into this chapter as if set out in fixll and shall be the
21 minimtun standard used by the building official in the inspection of high-pressure piping system materials and
22 construction.
23 (d) Section 109 of the Uniform Building Code, a part of the Minnesota State Building Code in Minnesota Rule
24 13001200, is amended for the City of Saint Paul to read as follows:
25 SECTION 109 - CERTIFICATE OF OCCUPANCY
26 109.1 Use and Occupancy. No building or structure shall be used or occupied, and no change in the existing
27 occupancy classification of a building or structure or portion thereof shall be made until the fire marshal has issued
28 a certificate of occupancy therefor as provided herein.
29 EXCEPTION: Group R, Division 3 and Group U Occupancies.
30 Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this
31 code or of other ordinances of the jurisdicrion. Certificates presuming to give authority to violate or cancel the
32 provisions of this code or other ordinances of the jurisdicrion shali not be valid.
33 109.2 Change in Use. Changes in the character or use of a building shall not be made except as specified in Section

109.3 Cert�cate Issued. After the fire mazshal inspects the building or structure and finds no violations of the
provisions of this code or other laws that are enforced by the code enforcement agency, the fire mazshal shall issue a
certificate of occupancy that shail contain the followiug:
1. The building pemrit number.
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the building for which the certificate is issued.
9 5. A statement that the described portion of the building has been inspected for compliance with the requirements of
10 this code for the group and division of occupancy and the use for which the proposed occupancy is classified.
11 6. The name of the building official.
12 109.4 Temporary Certifzcate. If the building official finds that no substantial hazazd will result from occupancy of
13 any building or portion thereof before the same is completed, a temporary certificate of occupancy may be issued
14 for the use of a portion ar portions of a building or structure prior to the completion of the entire building or
15 structure.
16 109.5 Posting. The certificate of occupancy shall be posted in a conspicuous place on the premises and shall not be
17 removed except by the fire marshal.
18 109.6 Revocation. The fire marshal may, in writing, suspend or revoke a certificate of occupancy issued under the
14 provisions of this code whenever the certificate is was issued in error, or on the basis of incorrect information
20 supplied, or when it is deterxnined bv the fire marshal that a use of the building or structure or portion thereof mav
21 constitute a nuisance as described in Minnesota Statutes. Section 617.81, subdivision (21, or is in violation of any
22 ordinance or regulation or any of the provisions of this code.

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why):
In 1999, Chapter 33 was updated to remain consistent with the 1997 Uniform
uilding Code. However, a provision which,allowed the fire marshal to suspend
or revoke a certificate of occupancy for-nuisance properties were left out.

11 Section 33.02 of the Saint Paul Legislative Code is hereby amended to read as follows:

13 Sec. 33.02. Mfinnesota State Building Code--Adoption.
14 (a) Pursuant to Minnesota Statutes, Secrions 16B.59 through 16B.73, the Minnesota State Building Code, as
15 adopted pursuant to laws of Minnesota, is hereby adopted by reference.
16 (b) The following appendix is not a mandatory part of the Minnesota State Building Code, but is adopted by
17 reference for the City of Saint Paul and is incorporated into this chapter as if set out in full: Uniform Building Code
18 Appendix Chapter 33.
19 (c) Chapter 5230 of the Minnesota Rules, "Steamfitters Rules and Code for Power Piping Systems," as amended, is
20 adopted by reference by the City of Saint Paul and incorparated into this chapter as if set out in fixll and shall be the
21 minimtun standard used by the building official in the inspection of high-pressure piping system materials and
22 construction.
23 (d) Section 109 of the Uniform Building Code, a part of the Minnesota State Building Code in Minnesota Rule
24 13001200, is amended for the City of Saint Paul to read as follows:
25 SECTION 109 - CERTIFICATE OF OCCUPANCY
26 109.1 Use and Occupancy. No building or structure shall be used or occupied, and no change in the existing
27 occupancy classification of a building or structure or portion thereof shall be made until the fire marshal has issued
28 a certificate of occupancy therefor as provided herein.
29 EXCEPTION: Group R, Division 3 and Group U Occupancies.
30 Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this
31 code or of other ordinances of the jurisdicrion. Certificates presuming to give authority to violate or cancel the
32 provisions of this code or other ordinances of the jurisdicrion shali not be valid.
33 109.2 Change in Use. Changes in the character or use of a building shall not be made except as specified in Section

109.3 Cert�cate Issued. After the fire mazshal inspects the building or structure and finds no violations of the
provisions of this code or other laws that are enforced by the code enforcement agency, the fire mazshal shall issue a
certificate of occupancy that shail contain the followiug:
1. The building pemrit number.
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the building for which the certificate is issued.
9 5. A statement that the described portion of the building has been inspected for compliance with the requirements of
10 this code for the group and division of occupancy and the use for which the proposed occupancy is classified.
11 6. The name of the building official.
12 109.4 Temporary Certifzcate. If the building official finds that no substantial hazazd will result from occupancy of
13 any building or portion thereof before the same is completed, a temporary certificate of occupancy may be issued
14 for the use of a portion ar portions of a building or structure prior to the completion of the entire building or
15 structure.
16 109.5 Posting. The certificate of occupancy shall be posted in a conspicuous place on the premises and shall not be
17 removed except by the fire marshal.
18 109.6 Revocation. The fire marshal may, in writing, suspend or revoke a certificate of occupancy issued under the
14 provisions of this code whenever the certificate is was issued in error, or on the basis of incorrect information
20 supplied, or when it is deterxnined bv the fire marshal that a use of the building or structure or portion thereof mav
21 constitute a nuisance as described in Minnesota Statutes. Section 617.81, subdivision (21, or is in violation of any
22 ordinance or regulation or any of the provisions of this code.

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why):
In 1999, Chapter 33 was updated to remain consistent with the 1997 Uniform
uilding Code. However, a provision which,allowed the fire marshal to suspend
or revoke a certificate of occupancy for-nuisance properties were left out.

11 Section 33.02 of the Saint Paul Legislative Code is hereby amended to read as follows:

13 Sec. 33.02. Mfinnesota State Building Code--Adoption.
14 (a) Pursuant to Minnesota Statutes, Secrions 16B.59 through 16B.73, the Minnesota State Building Code, as
15 adopted pursuant to laws of Minnesota, is hereby adopted by reference.
16 (b) The following appendix is not a mandatory part of the Minnesota State Building Code, but is adopted by
17 reference for the City of Saint Paul and is incorporated into this chapter as if set out in full: Uniform Building Code
18 Appendix Chapter 33.
19 (c) Chapter 5230 of the Minnesota Rules, "Steamfitters Rules and Code for Power Piping Systems," as amended, is
20 adopted by reference by the City of Saint Paul and incorparated into this chapter as if set out in fixll and shall be the
21 minimtun standard used by the building official in the inspection of high-pressure piping system materials and
22 construction.
23 (d) Section 109 of the Uniform Building Code, a part of the Minnesota State Building Code in Minnesota Rule
24 13001200, is amended for the City of Saint Paul to read as follows:
25 SECTION 109 - CERTIFICATE OF OCCUPANCY
26 109.1 Use and Occupancy. No building or structure shall be used or occupied, and no change in the existing
27 occupancy classification of a building or structure or portion thereof shall be made until the fire marshal has issued
28 a certificate of occupancy therefor as provided herein.
29 EXCEPTION: Group R, Division 3 and Group U Occupancies.
30 Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this
31 code or of other ordinances of the jurisdicrion. Certificates presuming to give authority to violate or cancel the
32 provisions of this code or other ordinances of the jurisdicrion shali not be valid.
33 109.2 Change in Use. Changes in the character or use of a building shall not be made except as specified in Section

109.3 Cert�cate Issued. After the fire mazshal inspects the building or structure and finds no violations of the
provisions of this code or other laws that are enforced by the code enforcement agency, the fire mazshal shall issue a
certificate of occupancy that shail contain the followiug:
1. The building pemrit number.
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the building for which the certificate is issued.
9 5. A statement that the described portion of the building has been inspected for compliance with the requirements of
10 this code for the group and division of occupancy and the use for which the proposed occupancy is classified.
11 6. The name of the building official.
12 109.4 Temporary Certifzcate. If the building official finds that no substantial hazazd will result from occupancy of
13 any building or portion thereof before the same is completed, a temporary certificate of occupancy may be issued
14 for the use of a portion ar portions of a building or structure prior to the completion of the entire building or
15 structure.
16 109.5 Posting. The certificate of occupancy shall be posted in a conspicuous place on the premises and shall not be
17 removed except by the fire marshal.
18 109.6 Revocation. The fire marshal may, in writing, suspend or revoke a certificate of occupancy issued under the
14 provisions of this code whenever the certificate is was issued in error, or on the basis of incorrect information
20 supplied, or when it is deterxnined bv the fire marshal that a use of the building or structure or portion thereof mav
21 constitute a nuisance as described in Minnesota Statutes. Section 617.81, subdivision (21, or is in violation of any
22 ordinance or regulation or any of the provisions of this code.

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why):
In 1999, Chapter 33 was updated to remain consistent with the 1997 Uniform
uilding Code. However, a provision which,allowed the fire marshal to suspend
or revoke a certificate of occupancy for-nuisance properties were left out.
