18 (a) Minimum distance establtshed. A minimum distance of hvo (2) miles shail be required between buildings
19 licensed for bingo halls under the provisions of this chapter. This minunum distance requirement shall not be
20 applicable where the license is to be held in a place located in the downtown business district as defined in section
21 411.04(b)(4) of this Code.
22 (b) Waiver of distunce requirement. The minimum distance requirement herein imposed may, to nromote
23 resnonsible ownerslun and accountabilitv_, be waived by the �uncil upon� a finding�bv the council that the location
24 of the nronosed site would nrovide economic develonment bene`fits without siQnificant neeative unnacts on
25 residential or commercial uses:provided, however, that (� the waiver could allow no more than one licensed bin¢o
26 hall within two miles of another licensed bingo hall, and (, such a waiver could not begranted to the fee owner of

2(c) No consideration for consent to waivers. No licensee under this chapter shall request, accept or keep any
3 consideration in retum for his or her consent to the location of a proposed bingo hall as provided under subsection
4(b) above. No applicant for the location of a proposed bingo hall shall pay or offer to pay any consideration to any
5 person in return for obtaiiuug a consent to the location of a bingo hall in a specific locarion as provided in
6 subsection (b) above. "Consideration" for the purpose of this section means and includes any and all legal
7 consideration, money, real or personal property, promises or contractual obligations, negotiable or other instruments
8 given to or received by any person, including the licensee, his or her friends or relatives, his or her creditors, any
9 other person acting on his or her behalf, and any other person at the d'uection or request of the licensee.
10 (d) Adverse action authorized. The council may consider and impose adverse action against any person, firm or
11 corporation holding any license of the City of Saint Paul, or against any applicant for any such license, after notice
12 and hearing as provided in section 310.05 of the Legislative Code, based on a violation of the prohibitions
13 contained in subsection (c) above, as well as on other violations of law or ordinance relating to such a matter.

Currently, the waiver o£ distance requirement for bingo halls requires written
consent from operators of bingo halls located within a two mile radius and a
finding by the City Council that no negative impact be placed on residential
ses. This waiver procedure is not feasible and has never been used because it
is impossible to satisfy.

As many of you witl recali the placing of a bingo hall in the Hillcrest Shopping Ce�nter
was quite cocm'oversiat. Community members speculated that the number of cars in the
parkiag lot of bingo customers would make doing retail in the certer impossible. The
attached story from the East Side Review shows the impact of bingo on the mall and �+rill
hopefully lead the Council towards making better public policy. The passing of Ronald
Jewelers fxom the East Side busirness community is a uue loss to the neighborhood. I
hope that yoiu desizes to protect other local merchants will guide youc vote on item 30.

18 (a) Minimum distance establtshed. A minimum distance of hvo (2) miles shail be required between buildings
19 licensed for bingo halls under the provisions of this chapter. This minunum distance requirement shall not be
20 applicable where the license is to be held in a place located in the downtown business district as defined in section
21 411.04(b)(4) of this Code.
22 (b) Waiver of distunce requirement. The minimum distance requirement herein imposed may, to nromote
23 resnonsible ownerslun and accountabilitv_, be waived by the �uncil upon� a finding�bv the council that the location
24 of the nronosed site would nrovide economic develonment bene`fits without siQnificant neeative unnacts on
25 residential or commercial uses:provided, however, that (� the waiver could allow no more than one licensed bin¢o
26 hall within two miles of another licensed bingo hall, and (, such a waiver could not begranted to the fee owner of
2� an existine, licensed bineo hall within a two-mile radius.

2(c) No consideration for consent to waivers. No licensee under this chapter shall request, accept or keep any
3 consideration in retum for his or her consent to the location of a proposed bingo hall as provided under subsection
4(b) above. No applicant for the location of a proposed bingo hall shall pay or offer to pay any consideration to any
5 person in return for obtaiiuug a consent to the location of a bingo hall in a specific locarion as provided in
6 subsection (b) above. "Consideration" for the purpose of this section means and includes any and all legal
7 consideration, money, real or personal property, promises or contractual obligations, negotiable or other instruments
8 given to or received by any person, including the licensee, his or her friends or relatives, his or her creditors, any
9 other person acting on his or her behalf, and any other person at the d'uection or request of the licensee.
10 (d) Adverse action authorized. The council may consider and impose adverse action against any person, firm or
11 corporation holding any license of the City of Saint Paul, or against any applicant for any such license, after notice
12 and hearing as provided in section 310.05 of the Legislative Code, based on a violation of the prohibitions
13 contained in subsection (c) above, as well as on other violations of law or ordinance relating to such a matter.
