16 Section 310.19 of the Saint Paul Legislative Code is hereby amended to read as follow:

19 Sec. 310.19. Discount from certain license fees.
20 A discount will be provided for on-sale and off-sale liquor licenses, on-sale and off-sale 3.2 malt liquor licenses and
21 on-sale strongbeer and wine licenses. °�a -°°„ -_�.,__ _.._ti Such fees mentioned shall be reduced in section
22 310.18 by approximately seven (7) percent, in the exact amounts as fiuther provided herein, contangent upon each
23 of the following conditions:
24 (1) Driver's license guide; compilation of laws. The licensee shall maintain on the premises, in a location accessible
25 at a11 times to all employees of the licensed establishment:
26 a. A current driver's license guide, which shall include license specifications for both adults and minors for each
27 state (including Canadian provinces), and shall list such information from at least five (5) years prior to the present
28 date; and
29 b. A current compilation of the laws relating to the sale and possession of alcoholic beverages in the State of
30 Minnesota as outlined in Chapter 7515 of the State of Minnesota Rules and Chapter 340A of the Minnesota
31 Statutes. This compilarion must also include Chapters 240 through 246, 409 and 410 of the Saint Paul Legislative
32 Code.
33 (2) Signage. The licensee shall maintain on the premises, in all customer areas, current signage relating to underage

1 consumption of alcoholic beverages, and relating to driving under the influence of alcohol. One (1) sign must�e
2 located behind the baz, and one (1) sign must be present in each additional room or section within the lounge area in
3 which the writing on the sign behind the bar is not clearly legible. The sign(s) must have dimensions of at least one
4(1) foot by one (1) foot with letters at least one-half (1/2) inch in height. All signs must be comfortably readable
5 from a distance of fifteen (15) feet.
6(3) Contract with security agency.
7 a. GeneraZly. The licensee shali participate in a training program with an approved private security agency, firm or
8 association (hereafter "security agency") which is selected and contracts with the City of Saint Paul for the purpose
9 of providing investigations and traiuing to the licensee pursuant to this subsection. The city contract shall provide
10 (i) that the security agency shall not be refrnbursed by the city, but that it shali recover its costs and profit by fees
11 collected from the licensees which choose to receive the training program and investigative services, and (ii) that
12 the security agency shall chazge the same amount to all licensees who choose to receive such services, so that all
13 such licensees are treated equally and without discriminarion.
14 b. lnvestigation. The contract with the city shall provide for and require one (1) ar more investigations by the
15 security agency each calendar year into the practices of the licensee with respect to (i) age identification of
16 customers in order to prevent sales of alcoholic beverages to minors, and (ii) preventing the sale of alcoholic
17 beverages to persons who are obviously intoxicated. The contract shall require that the security agency disclose the
18 results of all such invesrigations to both the licensee and, at no cost to the city, to the Office of License, Inspecrions
19 and Environmental Protection, within ten (10) days after such invesrigations are concluded. Failure to do so will be
20 grounds for adverse action against the licensee's licenses. The contract shall require that all such investigarions shall
21 include unannounced and random attempts by minors to purchase alcoholic beverages in the licensed premises, and
22 surveillance within the licensed premises. The security agency shall employ reasonable measures to minimize or
23 eliminate conflicts of interest in providing and reporting on investigations of licensees.
24 c. Training. The contract shall also provide for alcohol awareness training by the security agency of all officers,
25 employees or agents of the licensee who work in the licensed premises at least once during the calendar year. All
26 newly hired employees or new officers ar agents hired during the calendar yeaz shall receive such training within
27 four (4) weeks following their hiring, and shall not work in the premises after that four-week period until they have
28 received such training.
29 d. Standards for approval. In addition to the requirements specified elsewhere in this subsection, the security
30 agency and its investigations and training must meet or exceed the following:
31 1. The alcohol awazeness course shall cover all of the topics listed herein. The content of each training course shall
32 include, but need not be limited to:
33 (a) Pertinent laws and ordinances regarding the sale of alcohol.
34 (b) Verification of age, forms of identification, and forms of false or misleading age identification.
35 (c) The effect of alcohol on humans and the physiology of alcohol intoxication.
36 (d) Recognition of the signs of intoxication.
37 (e) Strategies for intervention to prevent intoxicated persons from consuming further alcohol.
38 (� The licensee's policies and guidelines, and the employee's role in observing these policies.
39 (g) Liability of the person serving alcohol.
1(h) Effect of alcohol on pregnant women and their fetuses, and in other vulnerable situations. � o-a3 �

4 2. The security agency shall have a minimum of two (2) yeazs actual experience in alcohol awareness tranung. The
5 courses may be given by one (1) or more instructors, but each instnxctor must have a formal education and/or
6 training in each azea they teach. The courses may be supplemented by audio-visual instruction.
7 3. The security agency shall have sufficient personnel and physical resources to provide an aicohol awareness
8 training course to newly hired employees within four (4) weeks after their hiring by the licensee with whom there is
9 a contract. The cost covering the trainin� and investigation service provided to license holders shall be identified
10 and chaz�ed equallv to each participant

Currently, the incentive to take alcohol awareness training, created by
reducing the liquor license £ee by 7%, is only available to on-sale liquor
licenses. This ordinance would make it available to all liquor related
establishments.
VANTAGES IF APPROVED:
Other liquor establishments would receive the 7°s discount on their license
fees, creating the incentive needed to attend alcohol awareness training.
ISADVANTAGES IF APPROVED:
small decrease in revenue generated from these license fees.

licenses. This ordinance would make it available to all liquor related
establishments.

fees, creating the incentive needed to attend alcohol awareness training.

�ection 310.19 of the Saint Paul Legislative Code is hereby amended to read as follow:

19 Sec. 310.19. Discount from certain license fees.
20 A discount will be provided for on-sale and off-sale liquor licenses on-sale and off-sale 3.2 malt liquor licenses and
21 on-sale strone beer and wine licenses uch fees mentioned shall be reduced in section
22 31Q.18 by approximately seven (7} percent, in the exact amounts as fiirther provided herean, conringent upon each
23 of the following conditions:
24 (1) Driver's license guide; compilation of Zaws. The licensee shall maintain on the premises, in a location accessible
25 at all times to all employees of the licensed establishment:
26 a. A current driver's license guide, which shall include license specifications for both adults and minors for each
27 state (mcluding Canadian provinces), and shall list such information from at least five (5) years prior to the present
28 date; and
29 b. A current compilation of the laws relating to the sale and possession of alcoholic beverages in the State of
30 Minnesota as outlined in Chapter 7515 of the State of Minnesota Rules and Chapter 340A of the Minnesota
31 Statutes. This compilation must also include Chapters 240 through 246, 409 and 410 of the Saint Paul Legisiative
32 Code.
33 (2) Signage. The licensee shall maintain on the premises, in all customer areas, current signage relating to underage

1 consumption of alcoholic beverages, and relating to driving under the influence of alcohol. One (1) sign must �e I!
2 located behind the baz, and one (i) sign must be present in each additional room or section within the lounge area in
3 which the writing on the sign behind the bar is not cleazly legible. The sign(s) must have d'unensions of at least one
4(1) foot by one (1) foot with letters at least one-half (1/2) inch in height. All signs must be comfortably readable
5 from a distance of fifteen (15) feet.
6(3) Contract with security agency.
�
7 a. Generally. The licensee shail participate in a training program with an approved private security agency, firm or
8 association (hereafter "security agency") which is selected and contracts with the City of Saint Paul for the purpose
9 of providing investigations and training to the licensee pvrsuant to this subsection. The ciry contract shall provide
I 0(i) that the security agency shall not be reimbursed by the city, but that it shall recover its costs and profit by fees
11 collected from the licensees which choose to receive the iraining program and invesrigative services, and (ii) that
12 the security agency shall charge the same amownt to all licensees who choose to receive such services, so that all
13 such licensees are treated equally and without discrimination.
14 b. Investigation. The coatract with the city shall provide for and require one (1) or more investigations by the
15 security agency each calendar year into the practices of the liceasee with respect to (i) age identification of
16 customers in order to prevent sales of alcoholic bevenges to minors, and {ii) preventing the sale of alcoholic
17 beverages to persons who aze obviously intoxicated. The contract shall require that the security agency disclose the
18 results of all such investigations to both the licensee and, at no cost to the city, to the Office of License, Inspections
19 and Environmental Protection, within ten (10) days after such investigations aze concluded. Failure to do so will be
20 grounds for adverse action against the licensee's licenses. The contract shall require that all such investigarions shall
2 t inctude unanuaunced and random attempts by minors to purchase alcoholic beverages in the licensed premises, and
22 surveillance within the licensed premises. The security agency shall employ reasonable measwes to m;n;T,,;�e or
23 eluninate conflicts of interest in pmviding and reporting on investigations of licensees.
24 c. Training. The contract shall also provide for alcohol awareness training by the security agency of all officers,
25 employees or agents of the licensee who work in the licensed premises at least once during the calendaz yeaz. All!
26 newly hired employees or new officers or agents hired during the calendaz year shalI receive such training within
27 four (4) weeks following their hiring, and shall not work in the premises after that four-week period until they have
28 received such training.
29 d. Stand¢rds for approval. In addition to the requirements specified elsewhere in this subsection, the security
30 agency and its investigations and �aining must meet or exceed the following:
31 1. The alcohol awareness course shall cover all of the topics listed herein. The content of each training course shall
32 include, but need not be limited to:
33 (a) Pertinent laws and ordinances regarding the sale of atcohol.
34 (b) Verification of age, forms of idenrification, and forms of false or misleading age identificafion.
35 (c) The effect of alcohol on humans and the physiology of alcohol intoxication.
36 (d) Recognition of the signs of intoxication.
37 (e) Strategies for interven6on to prevent intoxicated persons from consuming fiuther alcohol.
38 ( fl The licensee's policies and guidelines, and the employee's role in observing these policies.
39 (g) Liability of the person serving akohol. �
1(h) Effect of alcohol on pregnant women and their fetuses, and in other wlnerable situations. Q° a 3�
2 1i) Trainin¢ available in IanQUaees other than English that are spoken bv the license holders and/or the license
3 holders emplovees.
4 2. The security agency shall have a minimum of two (2) yeazs actual experience in alcohol awazeness h The
ourses may be given by one (1) or more instructors, but each instructor must have a formal education andlor
training in each area they teach. The courses may be supplemented by audio-visual instruction.
7 3. The security agency shall have sufficient personnel and physical resources to provide an alcohol awareness
8 training course to newly hired employees within four (4) weeks after their hiring by the licensee with whom there is

17 beverages to persons who aze obviously intoxicated. The contract shall require that the security agency disclose the
18 results of all such investigations to both the licensee and, at no cost to the city, to the Office of License, Inspections
19 and Environmental Protection, within ten (10) days after such investigations aze concluded. Failure to do so will be
20 grounds for adverse action against the licensee's licenses. The contract shall require that all such investigarions shall
2 t inctude unanuaunced and random attempts by minors to purchase alcoholic beverages in the licensed premises, and
22 surveillance within the licensed premises. The security agency shall employ reasonable measwes to m;n;T,,;�e or
23 eluninate conflicts of interest in pmviding and reporting on investigations of licensees.
24 c. Training. The contract shall also provide for alcohol awareness training by the security agency of all officers,
25 employees or agents of the licensee who work in the licensed premises at least once during the calendaz yeaz. All!
26 newly hired employees or new officers or agents hired during the calendaz year shalI receive such training within
27 four (4) weeks following their hiring, and shall not work in the premises after that four-week period until they have
28 received such training.
29 d. Stand¢rds for approval. In addition to the requirements specified elsewhere in this subsection, the security
30 agency and its investigations and �aining must meet or exceed the following:
31 1. The alcohol awareness course shall cover all of the topics listed herein. The content of each training course shall
32 include, but need not be limited to:
33 (a) Pertinent laws and ordinances regarding the sale of atcohol.
34 (b) Verification of age, forms of idenrification, and forms of false or misleading age identificafion.
35 (c) The effect of alcohol on humans and the physiology of alcohol intoxication.
36 (d) Recognition of the signs of intoxication.
37 (e) Strategies for interven6on to prevent intoxicated persons from consuming fiuther alcohol.
38 ( fl The licensee's policies and guidelines, and the employee's role in observing these policies.
39 (g) Liability of the person serving akohol. �
1(h) Effect of alcohol on pregnant women and their fetuses, and in other wlnerable situations. Q° a 3�
2 1i) Trainin¢ available in IanQUaees other than English that are spoken bv the license holders and/or the license
3 holders emplovees.
4 2. The security agency shall have a minimum of two (2) yeazs actual experience in alcohol awazeness h The
ourses may be given by one (1) or more instructors, but each instructor must have a formal education andlor
training in each area they teach. The courses may be supplemented by audio-visual instruction.
7 3. The security agency shall have sufficient personnel and physical resources to provide an alcohol awareness
8 training course to newly hired employees within four (4) weeks after their hiring by the licensee with whom there is
